AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER FOR AND
ON BEHALF OF THE CITY OF CORPUS CHRISTI TO EXECUTE
A LEASE AGREEMENT WITH THE KIWANI5 CLUB OF CORPUS
CHRISTI, TEXAS. LEASING UNTO THE SAID KIWANIS CLUB
OF CORPUS CHRISTI, TEXAS, THE BUILDING AND PREMISES
SITUATED ON LOT 12 AND THE S 1/2 OF LOT 11, ALL IN
BLOCK 2�, MEADOW PARK ADDITION TO THE CITY OF CORPUS
CHRISTI TEXAS, SAID LEASE BEING FOR THE TERM OF
FIVE (55 YEARS BEGINNING FEBRUARY 5, 1953, AND END-
ING FEBRUARY II, 1963, FOR AND IN CONSIDERATION OF
THE TERMS AMID CONDITIONS SET FORTH IN SAID LEASE
AGREEPIENT, A COPY OF WHICH IS ATTACHED HERETO AND
MADE A PART HEREOF; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. THAT THE CITY MANAGER IS HEREBY AUTHORIZED AND DIRECTED
TO EXECUTE, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, A LEASE AGREEMENT
WITH THE KIWANIS CLUB OF CORPUS CHRISTI, TEXAS, LEASING UNTO THE SAID KIWANIS
CLUB OF CORPUS CHRISTI, TEXAS, THE BUILDING AND PREMISES AS FOLLOWS:
THE BUILDING AND PREMISES SITUATED ON LOT 12 AND THE
S 1/2 OF LOT 11, ALL IN BLOCK 23, MEADOW PARK ADDITION
TO THE CITY OF CORPUS CHRISTI, TEXAS,
SAID LEASE BEING FOR THE TERM OF FIVE (5) YEARS BEGINNING FEBRUARY 5, 19581,
AND ENDING FEBRUARY 4, 1963, FOR AND IN CONSIDERATION OF THE TERMS AND CONDI-
TIONS SET FORTH IN SAID LEASE AGREEMENT, A COPY OF WHICH IS ATTACHED HERETO
AND MADE A PART HEREOF.
SECTION 2. THE FACT THAT IT IS NECESSARY FOR THE KIWANIS CLUB
OF CORPUS CHRISTI, AS SPONSORS OF A TROOP OF BOY SCOUTS, TO SECURE SAID
PROPERTY FOR THE IMMEDIATE USE AND IN THE INTEREST OF SAID BOY SCOUT TROOP,
CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE
SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED
FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION
SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR,
HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, HAVING REQUESTED
THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY
ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE TAKE EFFECT AND BE
IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO
ORDAINED.

This AGREEMENT made and entered into this the day of February, A.D.,
1958, by and between the OITY OF CORPUS CHRISTI$ THUS, a municipal corporation,
hereinafter called "City" and the KIWANIS CLUB OF CORPUS CHRISTI, TEXAS, a service
club acting as sponsors of a Boy Scout Troop hereinafter called "Lessee ".
V I T N E S S E T H:
The City of Corpus Christi, Texas, for valuable consideration, does by these
presents lease and demise unto the said lessee, the following described premises,
to -wit:
The building and premises situated on Lot 12 and the
S 1/2 of Lot 11, All in Black 23, Meadow Park Addition
to the City of Corpus Christi, Texas,
for the term of five (51) years, said lease beginning on the day of
February, 1958, and ending five (5) years from that day, subject to the following
conditions and covenants:
1., The Kiwanis Club of Corpus Christi, Texas, hereby and by these presents
agrees to accept said premises as completed, to maintain said premises during the
term of this instrument in a clean and sanitary condition, and at the expiration
thereof to return said premises to City in as good condition as received, reasonable
use, wear, acts of God, fire and flood excepted.
2. No additions or alterations shall be made to the premises without the
consent of the City in writing; and any and all improvements placed on said premises
which are unattached to the building may be moved by the Lessee at the expiration
of this lease.
3. It is the intention of the Kiwanis Club of Corpus Christi, Texas, that
the premises shall be for the use of the Boy Scout Troop sponsored by said Kiwanis
Club of Corpus Christi, for the use of the Kiwanis Club with its projects of
collecting and distributing used clothing and other Kiwanis Club projects of said
club and for no other purpose.
4. The Lessee agrees to pay for all utilities used by it on the premises
:leased by it, or used by any activity sponsored by it.

5. Lessee agrees to conform to all rules set out by the City Manager of the
City of Corpus Christi, Texas, for the operation of the leased premises.
6. The Lessee shall, promptly execute and fulfill all the ordinances of the
City of Corpus Christi applicable to said premises, and all orders and requirements
imposed by the Board of Health, Sanitary, Fire and Police Departments, for the
correction, prevention and abatement of nuisances and/or hazards in, ,upon, or
connected with said premises during the term of this lease at its own expense.
7. The City shall not be responsible for damages to property or injury to
persons which may arise incident to the exercise of the rights and privileges
herein granted.
8. This contract contains all the provisions agreed upon by the parties
hereto and displaces all previous verbal or oral agreements.

TIOHSHALL BE PASSED FINALLY ON THE DATE IT -IS INTRODUCED, AND THAT SUCH
ORDINANCE OR RESOLUTION SHALL BE'READ AT THREE MEETINGS OF THE CITY
COUNCILS 1. THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE
OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRO-
DUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
