HomeMy WebLinkAbout04976 ORD - 02/19/1958INLS:EB:2 /18/58 TEXAS: AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER FOR AND ON BEHALF OF THE CITY OF CORPUS CliRISTI TO EXECUTE A LEASE AGREEMENT WITH THE UPTOWN KIWANIS CLUB OF CORPUS CHRISTI, TEXAS, LEASING UNTO THE SAID UPT0dN KIWANIS CLUB OF CORPUS CHRISTI, TEXAS, A ROOM AND ADJACENT GARAGE IN THE RECREATIONAL BUILDING OF KIWANIS FIELD, NORTH BEACH, CORPUS CHRISTI, TEXAS, SAID LEASE BEING FOR THE TERM OF FIVE (5) YEARS BEGINNING FEBRUARY 19, 1958, AND ENDING FEBRUARY 18, 1963, FOR AND IN CON- SIDERATION OF THE TERNS AND CONDITIONS SET FORTH IN SAID LEASE AGREEMENT, A COPY OF WHICH IS ATTACHED HERE- TO AND MADE A PART HEREOF; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. THAT THE CITY MANAGER IS HEREBY AUTHORIZED AND DIRECTED TO EXECUTE, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, A LEASE AGREEMENT WITH THE UPTOWN KIWANIS CLUB OF CORPUS CHRISTI, TEXAS, LEASING UNTO THE SAID UPTOWN KIWANIS CLUB OF CORPUS CHRISTI, TEXAS, A ROOM AND ADJACENT GARAGE DESCRIBED AS FOLLOWS: A ROOM APPROXIMATELY 12' 1 3/4° X 34, 9 3/14" BEING IN THE SOUTHWEST CORNER OF THE.RECREATIOCIAL. BUILDING ON KIWANIS FIELD, NORTH BEACH, CORPUS CHRISTI, TEXAS, AND DESIGNATED ON THE PLANS AS "OFFICE' AND THE GARAGE ADJACENT THERETO, SAID LEASE BEING FOR THE TERM OF FIVE (5) YEARS BEGINNING FEBRUARY 19, 1958, AND ENDING FEBRUARY 18, 1963, FOR AND IN CONSIDERATION OF THE TERMS AND CONDITIONS SET FORTH IN SAID LEASE AGREEMENT, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF. SECTION 2. THE FACT THAT IT IS NECESSARY FOR THE UPTOWN KIWANIS CLUB OF CORPUS CHRISTI, AS SPONSORS OF A TROOP OF BOY SCOUTS, TO SECURE SAID PROPERTY FOR THE IMMEDIATE USE AND IN THE INTEREST OF SAID BOY SCOUT TROOP CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY RE- QUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYDR, HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, REQUESTING THAT SUCH CHARTER RULE BE SUSPENDED AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, 49�� IT 15 ACCORDINGLY SO ORDAINED. MAYOR THE CITY OF CORPUS CHRISTI, TEXAS ATTEST: CITY jEGh ETA v r //% V APPROVED AS TO LEGAL FORP9 THIS 1STH DAY OF FE?P.UARY, 1958: CITY ATTORNEY THE STATE OF TEXAS COUNTY, OF NUECES This AGREEMENT made and entered into this the day of February, AZ,', 1958, by and between the CITY OF CORPUS CHRISTI, TEXAS, a municipal corporation, hereinafter called "City" and the UPTOWN K JANIS CLUB, Corpus Christi, Texas, a service club acting as sponsors of a Hoy Scout Troop, hereinafter called "Lessee ". W I T N E S S E T H: The City of Corpus Christi, Texas, for valuable consideration, does by these presents lease and demise unto the said Lessee, the following described premises, to —wit: A room approximately 121 1 3/4t1 x 341 9 3/4" being in the Southwest corner of the recreational building on Kiwanis Field and designated on the plans as "Office" and the garage adjacent thereto. For the term of five (5) years, said lease beginning the T day of February, 1958, and ending five (5) years from that day, subject to the following conditions and covenants: 1. The Uptown Kiwanis Club hereby and by these presents agrees to maintain said premises during the term of this instrument in a clear, and sanitary condition, and at the expiration thereof to return said premises to City in as good condition as received, reasonable use, wear, acts of God, fire and flood excepted. 2. No additions or alterations shall be made to the premises without the consent of the City in writing; and any and all improvements placed on said Premises which are unattached to the building may be moved by the Lessee at the expiration of this lease. 3. It is the intention of the Uptown Kiwanis Club that the premises shall be for the use of the Boy Scout Troop sponsored by said Uptown Kiwanis Club and for no ether purpose. 4. The Lessee agrees to pay for all utilities used by it on the premises leased by it, or used by any activity sponsored by it. 5. Lessee agrees to conform to all rules set out by the City Manager of the City of Corpus Christi, Texas, for the operation of the leased premises. COR S CHRISTI. TEXAS ,195/ TO THE MEMBERS OF THE CITY COUNCIL CORPUS CHRISTI, TEXAS GENTLEMEN: FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FORE- GOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR,RESOLU- TIOH SHALL BE PASSED FINALLY ON THE DATE MIS INTRODUCED, AND THAT SUCH ORDINANCE OR RESOLUTIbH SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCILS 1.- THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRO- DUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
