Sample MINUTES CITY OF CORPUS CHRISTI, TEXAS SPECIAL COUNCIL MEETING AUGUST 9, 1978 3:30 P. M. City Manager R. Marvin Townsend City Attorney J. Bruce Aycock City Secretary Bill G. Read Mayor Gabe Lozano, Sr. called the meeting to order in the Council Chambers of City Hall and stated that the purpose of the meeting was to conduct public hearings on three zoning applications. City Secretary Bill G. Read verified that the necessary quorum of the Council and the required Charter Officers were present to conduct a legally con- stituted meeting. City Manager R. Marvin Townsend announced the public hearing on Application No. C778-1, City of Corpus Christi, Texas, for a change of zoning from "I-2" Light Industrial District to "I-3" Heavy Industrial District on Lots 1, 2, 3 and 4, Block 6, Roblex Industrial Area, located on the east side of Flato Road, approx- imately 1,000 feet south of Agnes Street (State Highway 44). Mr. Townsend informed the Council that both the Planning Commission and the Planning Staff recommend approval and that in response to the notices of the public hearing, two in favor and none in opposition had been returned. Chief Planner Larry Wenger located the area on the zoning and land use map, described the land use in the surrounding area, showed slides of the area, and stated that the owner of the tract of land proposes to construct and operate a facility for the production of a liquid anesthetic. No one spoke in regard to this application. Motion by Gulley that the hearing be closed, seconded by Sample, and passed unanimously. Motion by Sample that the Council approve the change of zoning on Appli- cation No. C778-1 to "I-3", as recommended by the Planning Commission; seconded by Gulley; and passed unanimously. 100fILMED SEP 0 31980 Minutes Special Council Meeting August 9, 1978 Page 2 Mr. Brodie Allen, Director of Industrial Development, informed the Council that the company interested in locating their facility on this property will pro- ceed with the construction as soon as a minor problem in regard to the land title is solved. He explained that the product made by the company will be shipped to Europe for pharmaceutical companies. City Manager Townsend announced the public hearing on Application No. 778-3, Harwick Foundations, Inc., for a change of zoning from "R -1B" One -family Dwelling District to "I-2" Light Industrial District on a 13.05± acre tract of land out of Lot 5, Section 7, Bohemian Colony Lands, located on the east side of Greenwood Drive, approximately 309 feet north of Saratoga Boulevard. Mr. Townsend stated that both the Planning Commission and the Planning Staff recommend approval and that in response to the notices of the public hear- ing, two in favor and none in opposition had been returned. Chief Planner Wenger located the area on the zoning and land use map, described the land use in the surrounding area, showed slides of the area, and stated that there is very little land use in the vicinity. He also informed the Council that the applicant plans to operate a business associated with the build- ing industry. No one spoke in regard to this zoning application. Motion by Sample that the hearing be closed, seconded by Juarez, and passed unanimously. Motion by Diaz that the change of zoning on Application No. 778-3 be changed to "I-2" as recommended by the Planning Commission and Planning Staff; seconded by Gill; and passed unanimously. * * * * * * * * City Manager Townsend announced the public hearing on Application No. 778-4, Cliff Zarsky-Texan Homes, Inc., for a change of zoning from "R -1B" One - family Dwelling District to "R-2" Multiple Dwelling District on a 1.55± acre tract of land out of Lot 22, Section 52, Flour Bluff and Encinal Farm and Garden Tracts, located on the south side of Yorktown Boulevard, approximately 355 feet east of Sweet Bay Drive. of i Minutes Special Council Meeting August 9, 1978 Page 3 Mr. Townsend stated that both the Planning Commission and the Planning Staff recommend approval and that in response to the notices of the public hearing, two in opposition had been returned. Chief Planner Wenger located the area on the zoning and land use map, described the land use in the surrounding area, showed slides of the area, and stated that the applicant plans the construction of four-plexes which will contain approximately 20 units. Mayor Lozano noted that the Planning Commission recommends approval and called on those who wished to speak in opposition to the change of zoning. Mr. Joseph A. Smith, 3850 Wagner Lee, expressed opposition to the proposed zoning because density would be increased; there are not enough playgrounds for children in the area; and because there is a problem in the area of low water pressure which would be further aggravated if apartments are constructed. He also expressed the opinion that this area is in the Naval Air Station flight pattern. Mr. Wenger stated that according to the Tracor Studies, this area is not in the flight pattern, but Mr. Smith contended that aircraft do fly over the area. Mayor Lozano expressed concern about the low water pressure in the area, and City Manager Townsend stated that there may well be a problem there but he was not previously aware of it. Mr. Townsend stated that if there is a problem with the water supply, this matter will be investigated and hopefully corrected. He agreed with Mr. Smith's statement that 20 apartment units constructed in the area would further aggravate the water pressure problem. Council Member Gill requested a report on this matter, and City Manager Townsend assured her that the staff will examine the problem and provide the Council with a report. Chief Planner Wenger displayed a map showing the flight pattern in the area, according to the Tracor Study, and indicated that the area in question is not in the flight pattern. City Manager Townsend stated that the AICUZ Study will also be consulted in regard to the flight patterns. Also speaking in opposition to the change of zoning was an unidentified gentleman who resides at the intersection of Jamaica and Yorktown who also objected to the change of zoning which would allow increased density. • Minutes Special Council Meeting August 9, 1978 Page 4 Mayor Lozano called on the applicant to speak at this time. Mr. Cliff Zarsky explained that a request for business zoning on the sub- ject property had previously been submitted; the Planning Commission recommended denial of this request; and since they opposed business zoning for this tract, he felt that "R-2" would be the best use for this property. Mr. Zarsky stated that, in his opinion, the planned multi -family use would be preferable to single- family zoning because the four-plexes will face onto Yorktown Boulevard and will act as a buffer for the adjacent single-family dwellings to the south. He also explained the proposed traffic pattern through Wagner Lee Street. He stated that because of the amount of land involved, no park dedication is required. Mr. Zarsky pointed out that this development will be in keeping with other develop- ment in the neighborhood, that he plans to construct a sewer line to serve the apartment units, and this line will be available for use by other property owners in the area. Council Member Gill inquired about the City's plan to provide parks when several small tracts such as this are developed and no requirement for land dedi- cation is included in the Platting Ordinance. City Manager Townsend explained that the City has no active acquisition plan for parks of that type. Council Member Gill suggested that if park dedication is not required, then some plan should be devised to assure that parks are developed in such areas of the City. No one else spoke in regard to this application. Motion by Diaz that the hearing be closed, seconded by Sample, and passed unanimously. Motion by Gulley that the Council approve the change of zoning on Appli- cation No. 778-4 to "R-2", as recommended by the Planning Commission; seconded by Gill; and passed unanimously. City Manager Townsend presented the ordinances effectuating the changes approved; City Secretary Read polled the Council for their votes; and the fol- lowing ordinances were approved: • Minutes Special Council Meeting August 9, 1978 Page 5 ORDINANCE N0. 14437: AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF CITY OF CORPUS CHRISTI BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON A 20.185 -ACRE TRACT + OUT OF A PORTION OF BLOCK 12 J. C. RUSSELL FARM BLOCKS AND A PORTION OF LOT 1, BLOCK 8, PARTITION OF THE J. C. RUSSELL FARM BLOCKS, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS FROM "I-2" LIGHT INDUSTRIAL TO "I-3" HEAVY INDUSTRIAL DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. The Charter Rule was suspended and the foregoing ordinance passed by the following vote: Lozano, Gulley, Diaz, Gill, Juarez, Sample voting "Aye"; Holt, absent.
