AN ORDINANCE
AMENDING ARTICLE THIRTEEN OF THE CIVIL SERVICE RULES
AND REGULATIONS, AS AMENDED, BY ADOPTING AN ENTIRE NEW
ARTICLE NUMBER THIRTEEN AND REPEALING THE PRESENT
ARTICLE THIRTEEN SO AS TO PROVIDE FOR PERFORMANCE
RATINGS SEMI- ANNUALLY AND ESTABLISH PROCEDURE FOR THE
KEEPING OF PERFORMANCE RECORDS; AND DECLARING AN
EMERGENCY.
WHEREAS, THE CIVIL SERVICE BOARD HAS UNANIMOUSLY RECOMMENDED
THAT THE COUNCIL APPROVE AN AMENDMENT TO THE CIVIL SERVICE RULES AND
REGULATIONS SO AS TO PROVIDE FOR PERFORMANCE RATINGS SEMI- ANNUALLY AND
ESTABLISH PROCEDURE FOR THE KEEPING OF PERFORMANCE RECORDS;
NOd, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. THAT, IN ACCORDANCE WITH THE RECOMMENDATION OF THE
CIVIL SERVICE BOARD, ARTICLE THIRTEEN OF THE RULES AND REGULATIONS OF THE
CIVIL SERVICE BOARD, AS AMENDED, BE AMENDED TO HEREAFTER READ AS FOLLOWS:
"SECTION 1. SEMI - ANNUAL REPORTS, HEREAFTER REFERRED TO AS
PERFORMANCE RATINGS, SHALL BE MADE BY EACH DEPARTMENT HEAD
AND /OR DIVISION HEAD SUBJECT TO CIVIL SERVICE RULES AND
REGULATIONS ON THE EFFICIENCY OF SAID EMPLOYEES ON THE FORM,
OR FORMS, PROVIDED FOR SUCH REPORTS BY THE CIVIL SERVICE
BOARD. THESE REPORTS SHALL BE SUBMITTED AT THE END OF JUNE
AND DECEMBER EACH YEAR; PROVIDED, HOWEVER, THAT ADDITIONAL
INTERIM REPORTS MAY BE FILED AT ANY TIME WHEN DEEMED AD-
VISABLE BY EITHER THE SUPERVISOR OR THE CIVIL SERVICE BOARD.
SECTION 2. THE CIVIL SERVICE BOARD SHALL ASCERTAIN THE
PERFORMANCE RATING OF EACH EMPLOYEE AS DETERMINED BY THE
SEMI- ANNUAL, AND ANY INTERIM, REPORTS SUBMITTED AND SHALL
KEEP A RECORD OF SUCH RATING. THE HIGHEST STANDARD OF PER-
FORMANCE SHALL BE INDICATED BY A GRADE OF EXCELLENT; THE
LOWEST STANDARD BY A GRADE OF UNSATISFACTORY.
SECTION 3 THE CIVIL SERVICE BOARD SHALL BY WRITTEN ORDER
RECORDED IN ITS MINUTES, PRESCRIBE THE SUBJECTS, OR FACTORS,
TO BE USED IN DETERMINING EFFICIENCY MARKINGS.
SECTION 4. THE CIVIL SERVICE BOARD SHALL RETAIN UNTO ITSELF
THE AUTHORITY TO ENTER MARKINGS ON PERFORMANCE RECORDS, AND
MAY REVIEW AND AMEND ANY RATING SUBMITTED. THE PERFORMANCE
RATING RECORDS SHALL BE SUBJECT ONLY TO INVESTIGATION BY THE
BOARD, CITY MANAGER, THE DEPARTMENT HEAD AND/OR THE DIVISION
HEAD CONCERNED, THE IMMEDIATE SUPERIOR, AND THE EMPLOYEE OR
HIS REPRESENTATIVE DULY APPOINTED IN WRITING.
SECTION 5 ANY CASE OF FAILURE OF A CLASSIFIED EMPLOYEE TO
MAINTAIN A SATISFACTORY PERFORMANCE RATING SHALL BE SUFFI-
CIENT GROUNDS FOR DISMISSAL OF THAT EMPLOYEE. WHEN AN
UNSATISFACTORY RATING HAS BEEN RECORDED FOR SAID EMPLOYEE,
THE BOARD SHALL CALL HIM BEFORE IT AND GIVE HIM AN OPPOR-
TUNITY TO EXPLAIN HIS LOW GRADE. IF NO SATISFACTORY EX-
PLANATION IS MADE, THE BOARD MAY RECOMMEND TO THE CITY
MANAGER THAT SUCH EMPLOYEE BE DISCHARGED, SUSPENDED OR

DEMOTED, OR THAT HIS SALARY BE REDUCED WITHIN HIS SALARY
GRADE. IF THE CITY MANAGER DISAGREES WITH THE RECOM-
MENDATION HE WILL PROMPTLY FURNISH THE BOARD WITH A
WRITTEN MEMORANDUM SETTING OUT HIS REASONS THEREFORy
AND HIS DECISION SHALL BE FINAL. BEFORE RESORTING TO
THE STEPS NECESSARY FOR DISCHARGES OR DEMOTIONS THE
BOARD SHALL REQUEST THE SECRETARY, IN COOPERATION WITH
THE CITY MANAGERS OR HIS REPRESENTATIVES TO MAKE AN
INVESTIGATION TO ASCERTAIN THE CAUSE OF THE LOW RATING.
IF IT IS POSSIBLE TO CORRECT THE LOW RATING BY ONE OR
SEVERAL ADJUSTMENTS OR CHANGES IN WORKING CONDITIONS,
THESE RECOMMENDATIONS SHALL BE INCLUDED IN THE SECRETARY'S
REPORT TO THE BOARD, WHICH SHALL PROCEED IN SUCH,MANNER
AS IT DEEMS BEST FOR THE SERVICE.
SECTION 6. PERFORMANCE- RATINGS MAY ALSO BE USED TO IN-
FLUENCE DECISIONS ON PROMOTIONS, RE- EMPLOYMENTS REIN-
STATEMENT OR TRANSFERS AND REDUCTION OF FORCES."
SECTION 2. THAT ARTICLE THIRTEEN OF THE RULES AND REGULATIONS
OF THE CIVIL SERVICE BOARD, AS AMENDED) INSOFAR AS THE SAME CONFLICTS WITH
THE PROVISIONS OF THIS ORDINANCE, IS HEREBY REPEALED.
SECTION 3. THE FACT THAT THE AUTHORITY GRANTED HEREIN TO THE
CIVIL SERVICE BOARD IS IMMEDIATELY NECESSARY FOR THE EFFICIENT ADMINIS-
TRATION OF THE CLASSIFIED CIVIL SERVICE SYSTEM OF THIS CITY CREATES A
PUBLIC EMERGENCY AND IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPEN-
SION OF THE CHARTER RULE PROVIDING THAT NO ORDINANCE OR RESOLUTION-SHALL
BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE
OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL
AND THE MAYOR, HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXISTS AND
HAVING REQUESTED THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS ORDI-
NANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH
ORDINANCE TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS
PASSAGE, IT IS ACCORDINGLY SO ORDAINED: di "let"

TION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH
ORDINANCE OR RESOLUTION SHALL BE READ ,AT THREE MEETINGS OF THE CITY
COUNCIL) I, THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE
OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRO-
DUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
