AN ORDINANCE `CLOSING A 20' ROADWAY EASEMENT ALONG THE SOUTHWEST BOUNDARY LINE OF LOT 13 -A, SECTION 17, OF THE FLOUR BLUFF & ENCINAL _ FARM & GARDEN TRACTS IN THE CITY OF CORPUS CHRISTI, NUECES- COUNTY, TEXAS, TO THE USE OF THE PUBLIC FOR STREET AND '-,TRAFFIC PURPOSES; RELINQUISHING ALL TITLE THERETO; AND'CLOS- j ' t ING A 40' ROADWAY EASEMENT WITH THE CENTER LINE THEREOF BEING ;.g.THE'COMMON'BOUNDARY OF THE NORTHEAST BOUNDARY OF LOT 15, ` SECTION- 17;'FLOUR BLUFF & ENCINAL FARM & GARDEN TRACTS, AND THE SOUTHWEST-BOUNDARY LINE OF LOT 12, SECTION 17, OF FLOUR BLUFF, &_ ENCINAL' -FARM & GARDEN TRACTS, IN THE CITY OF CORPUS yi `a'". `A° r _ r yCHRISTI, ,NUECES COUNTY, TEXAS, TO THE USE, OF THE PUBLIC FOR STREET'PURPOSES; RIZINQUISHIM ALL TITLE THERETO; AND ` DECLARING AN EMERGENCY. ' `-WHEREAS, the City Council of the City of Corpus Christi, Texas, has been petitioned that two certain roadway easements be closed, to-wit: (A) A certain roadway easement being 20' in width along the Southwest ,`,boundary line,of Lot 13 -A, Section 17, of the Flour Bluff & Encinal Farm & Garden Tracts in the City of Corpus Christi, Nuaces County, Texas, as shown by a map or plat thereof recorded in Vol. A. at Pages 41 through 43, inclusive, of the Map Records of Nueces County, Texas, -this tract being a portion of a V dedicated bdunused roadway easement adjacent to the roadway easement here- tofore closed by Ordinance No. 4361; (B) A dedicated roadway easement being 40 in width, as shown on a map or plat of the Flour Bluff & Encinal Farm & Garden Tracts, with a center line being the common boundary line of the Northeast boundary of Lot 15, Sec- a" tion 17, Flour Bluff & Encinal Farm & Garden Tracts, and the Southwest boundary of Lot 12, Section 17, Flour Bluff & Encinal Farm & Garden Tracts, in the City of Corpus Christi, Nueces County, Texas, this being an extension of the road- . way easement above described and likewise unused; . and, WHEREAS, notice of the proposed closing of said easements has been given by publication and by mail to the last known address of all owners of abutting property of said easements and within 450' therefrom in accordance with the Charter of the City of Corpus Christi, Texas, as provided by Article 11, Section 6,- thereof; and', WHEREAS, in accordance with the notice -given as above'set t, a pub -_ lic hearing was held at two o'clock P. M. on the .day of , 1958, in the City Council Chamber in the City Hall_, Corpus Christi, Texas; and, WHEREAS, the public safety, welfare, convenience and necessity will _ ' be better served by the closing of said easements to traffic than by the exist- ` ence and maintenance of said streets: -NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY, OF ' CORPUS CHRISTI, -,TEXAS; + SECTION 1.•° That the following roadway easements: ` `• } `(A)- A certain roadway easement being 20'- in width along the Southwest , -boundary 'line of Lot 13- A,,Section 17., of the Flour Bluff & Encinal Farm &' Garden Tracts in the City of Corpus Christi, Nueces County, Texas, as shown by , a map or plat thereof recorded in Vol. A, at Pages 41 through 43, inclusive, of R((ecords of Nueces County, Texas, this tract being a portion of a- the Map l dedicated bd unused roadway easement adjacent to the roadway easement here- , tofore closed by Ordinance No. 4361; g (B) .A dedicated roadway easement being,40' in width, as di own on a , map or plat of the Flour Bluff & Encinal Farm & Garden Tracts,'with a•center line being the common boundary'line of the Northeast boundary,of Lot 15, Sec -' tion _17, Flour Bluff & Encinal Farm & Garden Tracts, and the Southwest boundary Of Lot_12,- Section 17, Flour Bluff, &.Encinal;Farm & Garden Tracts, in the City of Corpus Christi, Nueces County, Texas, this being an extension of the road- ° way easement•above described and likewise unused; said tracts being developed as a subdivision is the City of Corpus Christi, Noe- ces County, °Texas, said tracts being Lakewood Park, an addition to the City of Corpus- Christi; as shown'by a map -'or plat thereof of record in the Map Records• of Nueces County, Texas, BE; AND THE SAME ARE HEREBY CLOSED,to the public for-, .'. street' and traffic purposes save and except those portions actually situated in ',•�'"s` +� r,; l a the streets - platted'aud • dedicated in said Lakewood Park subdivision, ' '• SECT ION 'Z. That the City of Corpus Christi, Texas, hereby release and relinquishes all right, title and interest in and to said roadway easements described in'Section 1 hereof to the "property owners abutting said street, and the same shall revert to said owners. - ^ SECTION 3. The fact that public convenience and necessity will be better served by the closing of said roadway easements described in Section 1 ; hereof within the limits described," creates a public emergency and public im- perative necessity requiring the suspension of the Charter Rule that no ordi- nance'or'resolution shall be passed finally on the date it is iutroduced'and'- _ 2 _ that such ordinance or resolution shall be read at three several meetings of the City Council, °and the Mayor having declared that such public emergency i and imperative necessity exist, and having requested that such Charter Rule be suspended, and that this ordinance be passed finally on the date of its ry • introduction and take'effect and be in­full-force and effect from and after- its passage, IT IS ACCORDINGLY SO ORDAINED /// a O'er PASSED AND APPROVED this the :Lday of - Y 6• -t-n., � - y 1958. .. ,. , " . " - 3 ?, 0i. 4 " CORPUS CHRISTI, TEXAS 1958 TO THE MEMBERS OF THE CITY COUNCIL CORPUS CHRISTI, TEXAS GENTLEMEN: r FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FORE- GOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; 11 THERE - FORE� HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
