AMENDING ORDINANCE NO. 5035 PASSED, AND APPROVED BY THE
CITY COUNCIL ON THE 7th DAY OF MAY, 1958, BY AMENDING
SECTION 3 OF SAID ORDINANCE, CORRECTING THE NAMES OF
THE OWNERS AND CORRECTING AND ADJUSTING THE ASSESSMENTS
LEVIED AGAINST ABUTTING PROPERTY OWNERS ON KOST(WZ ROAD
FROM THE SOUTHWEST PROPERTY LINE OF SOUTH STAPLES STREET
TO THE NORTHEAST BOUNDARY LINE OF LEXINGTON BOULEVARD:
AND DECLARING AN EMERGENCY.
BE IT ORDAINED By THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1, That Section 3 of Ordinance No, 5035, passed and
approved by the City Council on the 7th day of May, 1958, is hereby amended
and said Section 3 of said ordinance shall hereafter read as follows, to —wit:
"SECTION 3. That in pursuance of said ordinance, duly enacted,
by said City Council, authorizing and ordering the improvement of Kostoryz
Road from the Southwest property line of South Staples Street to the
Northeast boundary line of Lexington Boulevard, within the limits above
defined, and in pursuance of said proceedings heretofore had and enacted
by said City Council in reference to said improvements and by virtue of
the powers vested in said City with respect to said street improvements
by the Laws of the State of Texas and the Charter of said City, with
particular reference to Chapter 106 of the Acts of the First Called Session
of the 40th Legislature of the State of Texas, known and shown as Article
1105 —B of Vernon °s Annotated Civil Statutes of Texas, as amended, there
shall be, and is hereby levied, assessed and taxed against the respective
parcels of property abutting upon said portion of said streets, and against
the real and true owners thereof, whether such real and true owner or owners
be named or correctly named herein or not, the several sums of money herein —
below mentioned and itemized opposite the description of the respective
parcels of said property, the number of fornt feet of each and the several
amounts assessed against same and the real and true owner or owners thereof,
and the names of the apparent owners thereof, all as corrected and adjusted
by said City Council, being as follows, to —wit:

SECTION 2. The necessity for amending said Ordinance No. 5035 in order
to show the real and true owners of property abutting upon Kostoryz Road from
the Southwest property line of South Staples Street to the Northeast boundary
line of Lexington•Boulevard, and in order to correct and adjust assessments
against same, creates a public emergency and an imperative public necessity, requir-
ing the suspension of the Charter Rule that no ordinance a• resolution shall be
passed finally on the date of its introduction, and that said ordinance shall
be read at three several meetings of the City Council, and the Mayor having declared
that such emergency and imperative public necessity exists, and having requested
that the Charter Rule be suspended and that this ordinance be passed finally on
the date of its introduction and that this ordinance take effect and be in full

FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE
FOREGOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST
FOR THE SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE
SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCEDI AND THAT SUCH
ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY
COUNCIL; I, THEREFORE HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE
