OF THE CITY OF CORPUS CHRISTI, TEXAS,. DETERMINING THAT
CERTAIN STEPS HAVE HERETOFORE BEEN TAKEN IN RELATION TO
THE MATTER OF PERMANENTLY IMPROVING AGNES, LAREDO, SIX-
TEENTH, TWENTY- FIRST, AND ALAMEDA STREETS IN THE CITY OF
CORPUS CHRISTI, TEXAS, WITHIN THE LIMITS HEREIN REFERRED
T0; AND RATIFYING AND CONFIRMING SUCH ACTION; SETTING OUT
A COPY OF THE ENGINEER'S ESTIMATES OF THE COSTS OF SUCH
PROPOSED IMPROVEMENTS;-MAKING APPROPRIATION OF FUNDS FOR
PAYMENT OF THE SHARE "OF'THE COS'T'OF SUCH IMPROVEMENTS TO
BE BORNE BY THE CITY OF CORPUS CHRISTI, TEXAS; ORDERING
THAT A HEARING BE HELD AND GIVEN TO ALL OWNING OR CLAIMING
PROPERTIES ABUTTING UPON THE STREETS TO BE IMPROVED AND AS
TO OTHER RELATED MATTERS; SETTING AND FIXING THE TIME AND
PLACE OF SUCH HEARING AND DIRECTING THAT NOTICE THEREOF
BE GIVEN; RESCINDING ANY OTHER ORDINANCES OR PROCEEDINGS
OF SAID CITY IN CONFLICT2 HEREWITH; AND DECLARING AN
EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS, IN MEETING DULY ASSEMBLED:
SECTION 1: The City Council of the City of Corpus Christ,
Texas, hereby finds and determines:
(a) That the citizens of the City of Corpus Christi, Texas,
have heretofore, in a general bond election, determined
the necessity for and order the improvement of Agnes and
Laredo Streets within the City of Corpus Christi, Texas,
from the west property line of Staples Street to the east
property line of Port Avenue, and Sixteenth; Twenty -First
and Alameda Streets, from the south right -of -way line of
Laredo Street to the north right -of -way line of Agnes Street.
(b) That in furtherance of such edict of the citizens of the
City of Corpus Christi, the City Council of said City,
itself determined the necessity for and ordered the
improvement of said streets within said limits, by duly
enacted ordinances which authorized the employment of
engineers to prepare and file plans, specifications and
estimates of costs, relative to such proposed improvements, v
and said engineers•have heretofore so prepared and duly filed
said plans, specifications and estimates and statements of
other matters relating thereto with said City Council and
same have been received, examined and approved by,said City
Council.
(c) That in furtherance of said declaration of necessity and
order of improvement of said streets, said City Council,
after advertisement for bids for the construction thereof,
awardedito Brown & Root, Inc., a contract for construction
of the improvements within the limits above defined and
authorized the Mayor of said City to execute a written contract in
evidence thereof.
(d) That said Brown & Root, Inc., has executed a performance bond,
together with a proper surety, all pursuant to its proposal
and in accordance with the specifications and notice for bids
and other proceedings of the City Council, all in the form
and manner as approved by the City Attorney, and such contract
and performance bond has been presented to and filed with the

SECTION 1: The City Council of the City of Corpus Christ,

(a) That the citizens of the City of Corpus Christi, Texas,

the necessity for and order the improvement of Agnes and
Laredo Streets within the City of Corpus Christi, Texas,

City Council, and it was found that said contract and
performance bond and the surety on said performance bond
are all in due and proper form and acceptable to the City
Council.
(e) That in providing for and making such improvements, the
City Council has determined to proceed under, and in the
exercise o£, terms and provisions of Section 6 of Article 2
of the Charter of the City of Corpus Christi, Texas, and
as set out in the Acts of the First Called Session of the
40th Legislature of the State of Texas (1927), Chapter 106,
said Act being commonly known as Article 1105 -b Revised
Civil Statutes of Texas (1925), as amended.
(f) That in providing for and making such improvements, the
City Council has elected to assess against abutting proper-
ties and their owners and against any railroads occupying
any of the area to be improved, a portion of the cost
thereof.
(g) That the City Secretary has been directed to cause to be
prepared a Notice of the determination and necessity to
improve the above streets within the limits defined, and
the Mayor empowered to execute such notice on behalf of
the City of Corpus Christi, Texas, after which the Secre-
tary was directed to file such Notice with the County Clerk
of Nueces County for record in the Mortgage or Deed of
Trust Records of said County in Article 12209a of the
Revised Civil Statutes of Texas.
That such action of the Citizens of the City of Corpus Christi,
.Texas, and of its City Council, are in all things hereby ratified,
confirmed and re- enacted.
SECTION 2: That a true and correct copy of the assessment
rolls containing names of the owners of properties abutting those
portions of Agnes, Laredo, Sixteenth, Twenty- First, and Alameda
Streets to be improved and further containing descriptions of such
properties, the estimated amounts per front foot proposed to be
assessed against such properties and their owners, the estimated
total cost of the improvements and other data is as follows, to wit:

SECTION 3: That there is hereby MAIPRO�ai '-aTrD (I from the
City of Corpus Christi, Texas, Street Improvement Fund and General
Fund the sum of $212,000.00.: , , to pay the City's portion of the
cost of said improvements on said streets, or so much thereof as
may be necessary to pay and discharge the obligation of the City
of Corpus Christi under its contract with Brown and Root, Inc.
SECTION 4: A public hearing shall be held and given to
the real and true owners and to all owning or claiming any interest
in-any property abutting upon said streets, as hereinabove referred
to, and to all others owning, claiming or interested in,said prop-
erty or any of said matters as to the assessments and as to the amount
to be assessed against each parcel of abutting property and the real
and true owners thereof, and as to the special benefits to said prop-
erty to be received from said improvements, or concering any error,
invalidity, irregularity or deficiency in any proceeding or any
contract wiht reference thereto, or concerning any matter or thing,
connected therewith, which hearing shall be held by the City Council
of the City of Corpus Christi, Texas, in the Council Chamber of
the City Hall of said City, at 3:00 o'clock P.M., on the 25th day
of March, 1959, at which time and place all persons, firms, corpor-
ations or estates owning or claiming any such abutting property
or any interest therein, and their agents or attorneys, or persons
interested in said proceedings, shall be notified to appear and to
be heard in person or by counsel, and to offer evidence if they
so desire; and said hearing may be adjourned from day to day and
from time to time, and held open until all evidence and protests
have been duly offered and heard.
SECTION 5: The City Secretary is directed to give notice
of such hearing, which notice shall be directed to all owning
any property abutting upon said portions of said streets, and to
all claiming any such property or any interest therein, such
notice to be given as follows, to wit: (a) By advertisement

thereof inserted and published at least three times, to wit,
on at least three different days, in a newspaper of general
circulation in the City of Corpus Christi, Texas, the first
of such publications to be made at least ten days prior to
the date of the hearing, as hereinabove prescribed; and (b)
by mailing (by first class mail, postage prepaid) a copy or
a substantial copy of the'notice so published or to be pub-
lished, addressed to the respective owners of the various and
sundry parcels of property abutting upon the streets, at their
respective usual or best mailing addresses, obtained from
sources reasonably available to the said City Secretary. 'The
City Secretary shall cause such notices to be mailed as soon
as practicable after the passage hereof, and shall, in such
manner and form as he deems appropriate and sufficient, make
and preserve a written record sufficient to evidence the fact
and date of the mailing of said notices to said respective
property owners, the names and mailing addresses to which such
notices were so mailed, and what, if any, such notices are
returned to him for want of proper addresses, etc., and any
other information pertinent to the effort made to give to each
of said abutting property owners actual notice of the benefit
hearing to be held as aforesaid.
SECTION 6: That any ordinance or proceedings hereto -.
fore enacted by the City Council of the City of Corpus Christi,
Texas, in conflict herewith are hereby expressly rescinded and
appealed.
SECTION 7: The fact that there is badly needed at this
time permanent street improvements on'Agnes and Laredo Streets,
within the limits hereinabove defined, and the further fact that
the present condition of said portions of said streets is danger-
ous to the health and public welfare of the inhabitants of the
City of Corpus Christi, due to the conditions and increase of
traffic's along said portions of said streets creates a public

emergency and public imperative necessity requiring the sus-
pension of the Charter rule that no ordinance or resolution
shall be passed finally on the date it,is introduced and
that such ordinance or resolution shall be read at three
several meetings of the City Council, and the Mayor having
declared that such public emergency and imperative necessity
exist, and having requested that such Charter rule be sus-
pended, and that this ordinance be passed finally on the date
of its introduction and take effect and be in full force and
effect from and after its passage, IT IS ACCORDINGLY SO
ORDAINED.
