Roberts, oened the Mayor Pro AssistantCityAttorney, Bernard W. Schrader, atop then side. Mr. Schrader explained briefly the pre - and then called upon Director of Public Works, Drahn Jones, to explain to those present the type of improvements proposed to be constructed, and the specifications therefor, further explaining that the Plans and Specifications had been prepared by Lockwood, Andrews & Newman, Professional Engineers, that the rate for the assessments to be levied against the individual property owners Is based upon the lowest bid for the proposed work submitted by Brown & Root, Inc. and that no more than eighty -six and a half (862 %) per cent of the cost of the proposed improvements is to be assessed against the individual property owners. Assistant City Attorney Schrader then called upon Mr. Fred Quaile, who stated, in response to Mr. Schrader's questions, that he had been engaged in the real estate business in Corpus Christi for the past thirty -five years; that he was quite familiar with real estate values in said city, and in particular with the properties and the values thereof abutting upon the streets in- volved in this paving program; that he was familiar with the nature and cost of said proposed improvements; that he had made a thorough survey of said properties prior to the hearing'and was of the opinion that in all instances the properties involved will be specially bene- fited in enhanced value as the result of said improvements, said enhancement to be in excess of the cost of said improvements. Mr. Quaile further stated that he inspected the property abutting upon the streets to be improved in the company of Mr. W. M. Cooper, another real estate broker with long experience in the Corpus Christi real estate market, who likewise was of the opinion that the properties involved will be specially, benefited in enhanced value as a result of said improvements, said enhancement to be in excess of the cost of said improvements. Mayor Pro Tem W. J. Roberts then, by reading down the list of property owners involved in the paving program, inquired of such owners as to whether or not any of them wished to protest such pro- posed improvements. Various property owners were heard and raised questions regarding particular details of the proposed improvements, but none of such-owners protested the improvements on the ground that the abutting properties would not be enhanced in value by virtue of the improvements to a degree in excess of the cost thereof. All parties appearing and wishing to be heard having been given full and adequate opportunity to do so, Mayor Pro Tem, W. J. Roberts, declared the hearing closed. - 3a - WHEREAS, at said hearing, all parties desiring or in any manner wishing to be heard concerning any of the matters mentioned in said ordinance ordering and fixing the date of said hearing and proposed improvements, contract and assessments and the amounts thereof, were heard, and all matters as to the accuracy, sufficiency, regularity and validity, and all matters of error, equality and other matters connected with said improvements, contract and assessments having been heard, considered and corrected, and said City Council having heard evidence as to the special benefits to said abutting- property and each parcel thereof and to the respective owners thereof, in the enhanced value of said property by means of such improvements, and said City Council having given a full and fair hearing to all parties making or desiring to make any protest or objections or to offer testimony and having examined and considered all evidence, matters and testimony offered, and having found that said notice is valid and is in full accord with the requirements of law; and WHEREAS, all proceedings with reference to making the improve- ments above mentioned have been regularly had, in compliance with the law, and all prerequisites to the fixing of the assessment lien against the properties hereinafter listed and the personal liability of the respective owners thereof have been performed, and upon completion of said improvements and acceptance thereof by the City of Corpus Christi,.assignable certificates should be issued in evidence of said assessments and liens and the liability of the true owner or owners of said properties, whether correctly named or not, all as provided by law:, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY.OF CORPUS CHRISTI, TEXAS, IN MEETING DULY ASSEMBLED: Section 1.
