AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER,
FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI,
TEXAS, TO EXECUTE A CONTRACT WITH THE UNITED
STATES OF AMERICA, ACTING BY AND THROUGH HE
DEPARTMENT OF THE NAVY TO ACCEPT FOR THE CITY
AN EIGHT INCH CAST IRON PIPE WATER LINE FROM
ITS CONNECTION WITH THE SIXTEEN INCH CITY OF
CORPUS CHRISTI MAIN EXTENDING APPROXIMATELY
2,231 FEET IN A SOUTHWESTERLY DIRECTION ACROSS
LANDS OWNED BY JOE BLACKNALL, JR., ET AL, FINALLY
CROSSING LEXINGTON BOULEVARD TO ITS CONNECTION
WITH THE NAVY - OWNED SIX INCH WATER LINE AT
BRECKENRIDGE STREET IN THE PEARY PLACE HOUSING
PROJECT, MORE FULLY DESCRIBED IN THE DONATION
ATTACHED HERETO AND MADE A PART HEREOF; AND
J; DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1. THAT THE CITY MANAGER, FOR AND ON BEHALF OF THE
CITY OF CORPUS CHRISTI, BE AND HE IS HEREBY AUTHORIZED TO EXECUTE A
CONTRACT WITH THE UNITED STATES OF AMERICA, ACTING BY AND THROUGH THE
DEPARTMENT OF THE NAVY, TO ACCEPT FOR THE CITY AN EIGHT INCH CAST IRON
PIPE WATER LINE FROM ITS CONNECTION WITH THE SIXTEEN INCH CITY OF CORPUS
CHRISTI MAIN EXTENDING APPROXIMATELY 2,231 FEET IN A SOUTHWESTERLY DIREC-
TION ACROSS LANDS OWNED BY JOE BLACKNALL, JR., ET AL, FINALLY CROSSING
LEXINGTON BOULEVARD TO ITS CONNECTION WITH THE NAVY -OWNED SIX INCH WATER
LINE AT BRECKENRIDGE STREET IN THE PEARY PLACE HOUSING PROJECT, MORE
FULLY DESCRIBED IN THE DONATION,ATTACHED HERETO AND MADE A PART HEREOF.

SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS I

NECESSITY TO EXIST, HAVING REQUESTED THE SUSPENSION OF SAID CHARTER

RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRO-
DUCTION AND THAT THIS ORDINANCE TAKE EFFECT AND BE IN FULL FORCE AND
EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY PASSED AND
APPROVED, THIS DAY OF APRIL, 1959.

KNOW ALL bw BY TEESE PRESENTS: That the United States of America, acting
by and through the Department of the Navy (hereinafter referred to as the Donor),
erein represented by F. L. Endebrock, Captain, CEO, USN, Acting District Public
Works Officer, Eighth Naval District, pursuant to the authority contained in
the provisions of the Federal Property and Administrative Services Act of 1949
(63 Stat. 377) as amended, and rules, orders and regulations issued pursuant
thereto, in consideration of the covenants contained herein, does hereby donate,
give, convey, assign and deliver without warranty, liability or recourse whatso-
ever, unto the City of Corpus Christi, Texas, (hereinafter referred to as the
Donee) its successors and assigns, all rights, title and interest in and to the
following described property, to wit:
An eight (8 ") inch cast iron pipe water line which from
its connection with the sixteen (16 ") inch City of Corpus
Christi water main extends in a southwesterly direction
approximately 2,231 feet, traversing lands owned by Joe
Blacknall, Jr., W. A. Magee and R. D. Grantham and finally
crosses Lexington Boulevard to its connection with the
Navy -owned six (611) inch water line at Breckenridge Street
in the Peary place Housing Project.
TO HAVE AND TO HOLD the above- described property, together with all and
singular the rights and appurtenances thereto belonging, or in any wise appertain-
ing unto the said Donee, its successors and assigns forever; subject however to

the condition that the Donee shall indemnify and hold the Donor harmless of and
from any and all claims now existing or which may hereafter arise out of, or be
attributable to the construction, maintenance, operation, or removal of aforesaid
water line.

FOR THE SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE
SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH
ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY
COUNCIL; [,-THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER
