HomeMy WebLinkAbout05324 ORD - 04/22/1959f X IMS:JKH:3 -4 -59 AN ORDINANCE AMENDING THE FOOD HANDLERS ORDINANCE AND PARTICULARLY SECTION 1 - 7, CORPUS CHRISTI CITY CODE, 195 SO AS TO PROVIDE SPECIFIC REGULATIONS PERTAINING TO ITINERANT RESTAU- RANTS; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. SECTION 16 -47 OF THE CORPUS CHRISTI CITY CODE, 1958, IS HEREBY AMENDED TO HEREAFTER READ AS FOLLOWS: IISECTION 16 -47. ITINERANT RESTAURANTS, REGULATIONS PERTAINING To. "ITINERANT RESTAURANTS SHALL BE EXEMPT FROM THE PROVISIONS OF SECTION 16 -18 OF THIS CODE BUT SHALL" BE SUBJECT TO THE FOLLOWING REGULATIONS: ' "SUB- SECTION I. ITINERANT RESTAURANTS SELLING ONLY PRE- PACKAGED-FOOD, BOTTLED DRINKS, BOTTLED BEVERAGES, BEVERAGES FROM APPROVED DISPENSERS, THE PACKAGING, BOTTLING AND PREPARATION OF THE BEVERAGE • DISPENSED WHICH IS PREPARED AND /OR PACKAGED ELSEWHERE, SHALL USE ONLY ONE -TIME SERVICE ('THROW AWAY') EATING AND /OR'DRINKING UTENSILS, AND SHALL COMPLY WITH THE FOLLOWING REQUIREMENTS: "(A) FOOD AND DRINK SOURCES. t ALL FOOD AND DRINK MUST BE PREPARED, BOTTLED AND PACKAGED IN AN APPROVED LICENSED FOOD ESTABLISHMENT. t „(B) FOOD TRANSPORTATION. ALL FOOD AND DRINK MUST BE TRANSPORTED IN A VEHICLE APPROVED BY THE HEALTH DEPARTMENT, IN CLOSED, RUST- PROOF CONTAINERS AND REFRIGERATED, IF PERISHABLE. °(C) FOOD SERVICE. (1) ONLY SINGLE SERVICE CAN BE USED. (2) DRINKING STRAWS, FACTORY WRAPPED. J SUPPLY OF CLEAN WIPING - CLOTHS ON HAND. SINGLE SERVICE HANDLED ON OUTSIDE ONLY.' (5) SINGLE SERVICE STORED IN CLEAN, DRY PLACE AND THOROUGHLY PROTECTED. (6) NO SOFT DRINK BOTTLES LEAVE THE STAND. (7) SANITARY DISPENSERS FOR PAPER CUPS. ( ) THROW AWAY SPOONS AND FORKS STORED SO ONLY HANDLES GRASPED. (9) ALL SUGAR WRAPPED CREAM IN ORIGINAL CARTONS OR EVAPORATED MILK CANS. (10) MUSTARD AND CATSUP IN PLASTIC SQUEEZE BOTTLES OR APPROVED MECHANICAL DISPENSERS. "(D) BOTTLE COOLER. THE WATER FROM MELTED ICE USED FOR CHILLING BOTTLES MUST CONTAIN FIVE (5) PARTS PER MILLION OF AVAILABLE " CHLORINE (2 OUNCES OF 5% BLEACH) OR WATER TO BE CON- TINUOUSLY DRAINED FROM THE TANK. "(E) FOOD STORAGE AND DISPLAY. (1) ALL FOODS STORED 12" OR MORE ABOVE THE FLOOR. (2) 'PROTECTED FROM DUSTS DIRT AND MOP SPLASH. (3) PROTECTED FROM BACTERIAL GROWTH BY KEEPING PERISHABLES UNDER PROPER REFRIGERATION. (4) PROTECTED FROM INSECTS AND RODENTS. (5) OLDER FOODS USED FIRST. (6) PROTECTED FROM OVERHEAD LEAKAGE. "(F) REFRIGERATION. (1) ENOUGH SPACE TO STORE ALL PERISHABLE FOOD. (2) TEMPERATURE BELOW 50 °F. (3) MILK AND CREAM FILLED FOODS REFRIGERATED UNTIL SOLD TO CONSUMER. (4) REFRIGERATORS, IF USED, KEPT CLEANS PROVIDED WITH THERMOMETER AND FOOD STORED IN FLAT CONTAINERS. "(G) FOOD HANDLERS. (1) MUST WEAR CLEANS WASHABLE OUTER GARMENTS AND CAPS. (2) ANY SLEEPING QUARTERS OR COTS OR BEDS MUST BE SEPARATE FROM FOOD PREPARATION AND STORAGE AREAS. (3) FOOD HANDLERS MUST BE FREE FROM COLDS OPEN SORES AND COMMUNICABLE DISEASE. (4) FEMALES MUST WEAR HAIRNETS WHICH CONFINE THE HAIR. (5) NO SMOKING IN CONCESSION AND PERSONS UNDER THE INFLUENCE OF ALCOHOL MAY NOT HANDLE FOOD. (6) MUST OBTAIN FOOD HANDLER PERMITS (HEALTH CARDS). "(H) HANDWASHING. �1) HANDWASHING BASINS IN OR NEAR THE STAND. 2) HANDSOAP IN DISPENSER. PAPER TOWELS. (4) CONVENIENT TO WASH HANDS BEFORE RETURNING TO WORK FROM TOILET. HANDS MUST BE THOROUGHLY WASHED AFTER USING RESTROOM. (5) RECEPTACLE FOR USED TOWELS. II(I ) TOILETS. (1) LOCATED NEAR THE CONCESSION AND AVAILABLE TO THE FOOD HANDLERS. (2) CLEAN AND IN GOOD REPAIR. -2- SELF- CLOSING DOORS FLY -PROOF AND WELL VENTILATED. () ATTENDANT AVAILABLE WHEN EXTENSIVE USE OF TOILETS ANTICIPATED. "(J) GARBAGE AND TRASH. €�) COVERED METAL CONTAINERS. 2) REMOVED AT LEAST ONCE A DAY. 3) ENOUGH CONTAINERS TO HOLD ALL TRASH BETWEEN PICKUPS. (4) PREMISES MAINTAINED CLEAN AND CLEANED UP THOROUGHLY AFTER CONCESSION IS CLOSED. "SUB- SECTION II. ALL ITINERANT RESTAURANTS OFFERING FOR SALE OR SELLING FOOD OR DRINK PREPARED AT THE STAND FOR IMMEDIATE DELIVERY TO THE CUSTOMER SHALL BE SERVED ONLY IN ONE -TIME ('THROW - AWAY') EATING AND/ OR DRINKING UTENSILS SHALL MEET ALL THE REQUIREMENTS PROVIDED IN•SUB- SECTION I, ABOVE AND IN ADDITIONS SHALL COMPLY WITH THE FOLLOWING REQUIREMENTS: "(A) ROOF. THE ENTIRE CONCESSION MUST BE COVERED BY A SUBSTANTIAL LEAK -PROOF ROOF. "(B) FLOORS. THE ENTIRE CONCESSION MUST BE PROVIDED WITH SMOOTH HARDY WASHABLE FLOORS MAINTAINED SAFE AND IN GOOD REPAIR AND KEPT CLEAN. "(C) WALLS AND CEILINGS. THE ENTIRE CONCESSION MUST BE COMPLETELY ENCLOSED EXCEPT FOR PASS -OUT WINDOWS; DOORS TO BE TIGHT FITTING AND WALLS AND CEILINGS TO BE MAINTAINED IN GOOD REPAIR AND KEPT CLEAN. - "(D) LIGHTING. THE ENTIRE CONCESSION MUST BE ADEQUATELY ILLUMINATED WHEREVER FOOD IS PREPARED OR UTENSILS WASHED. "(E) FOOD PREPARATION AREAS (1) PROTECTED ON TOP AND THREE SIDES BY SOLID MATERIAL (MAY BE TRANSPARENT) AND THE FOURTH SIDE SCREENED. (2) FOOD PREPARATION AREAS MUST BE KEPT CLEAN AND - PROTECTED FROM FLIES, AT ALL TIMES. "(F) WATER SUPPLY. THERE SHALL BE PROVIDED, IN EACH CONCESSION STAND AN ADEQUATE SUPPLY OF WATER AND OF A SAFE SANITARY QUALITY APPROVED BY THE HEALTH OFFICER. "(G) WASTE DISPOSAL. SEPARATE AND ADEQUATE CONTAINERS SHALL BE PROVIDED FOR COLLECTION OF (1) WASTEWATER AND (2) OTHER MATERIAL. -3- I. SATISFACTORY ARRANGEMENTS FOR FINAL DISPOSAL FROM EACH CONCESSION STAND MUST BE MADE I,N ORDER TO INSURE THAT THE ABOVE- MENTIONED WATER AND OTHER MATERI- AL 15 DISPOSED OF IN A SANITARY MANNER. "(H) EQUIPMENT AND UTENSILS. (1) ALL FOOD PREPARATION EQUIPMENT AND UTENSILS ARE TO BE MAINTAINED CLEAN AND IN GOOD REPAIR FREE OF CHIPS BREAKS OPEN SEAMS OR CRACKS. (2) ALL UTENSILS ARE TO BE STORED IN A PROTECTED PLACE NOT SUBJECTED TO DUSTS DIRTY MOP SPLASH INSECTS AND RODENTS. 110) ICE. ALL ICE MUST COME FROM AN APPROVED ICE PLANT AND BE HANDLED IN A SANITARY MANNER WHICH WILL INSURE PROTECTION FROM ALL CONTAMINATION. "SUB- SECTION III. IT SHALL BE UNLAWFUL FOR ANY PERSON TO ANY WAY OR MANNER ENGAGE INS CONDUCTS OR OPERATE ANY ITINERANT RESTAURANT WITHOUT A PERMIT IN WRITING SO TO DO FROM THE HEALTH OFFICER AND WITHOUT COMPLYING WITH ALL OF THE REQUIREMENTS OF THIS SECTION AS WELL AS THE APPLICABLE REQUIREMENTS OF ALL OF THE PROVISIONS OF THE CITY ORDINANCES AND CODE OR TO USE OR ATTEMPT TO USE ANY EATING OR DRINKING UTENSIL FOR SERVICE TO A CUSTOMER OTHER THAN 'ONE -TIME SERVICE THROW -AWAY) FOOD OR DRINK UTENSIL OR ANY FOOD OR DRINK UTENSIL WHICH HAS EVER' BEEN USED OR WHICH HAS IN ANY WAY BECOME CONTAMINATED. SUCH PERMIT SHALL STATE THE PERIOD OF TIME FOR WHICH IT IS ISSUED AND SHALL NEVER BE VALID FOR ANY PERIOD LONGER THAN FOURTEEN (14) CONSECUTIVE DAYS." SECTION 2. THE NECESSITY FOR IMMEDIATE AMENDMENT OF THE FOOD HANDLERS ORDINANCE SO AS TO PROVIDE SPECIFIC PROVISIONS FOR ITINERANT RESTAURANTS CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDI- NANCE OR RESOLUTION SHALL EE PASSED FINALLY ON THE DATE OF ITS INTRODUC- TION, AND THAT SAID ORDINANCE OR RESOLUTION SHALL BE READ AT THREE , SEVERAL MEETINGS OF THE CITY COUNCILS AND THE MAYORS HAVING DECLARED THAT SUCH EMERGENCY AND PUBLIC IMPERATIVE NECESSITY EXIST, AND HAVING REQUESTED THAT SAID CHARTER RULE BE SUSPENDED AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL 0 FORCE AND EFFECT FROM AND AFTER ITS j AGE, IT IS ACCORDINGLY PASSED AND APPROVED THIS THEhDAY OF f- 1959• MAYOR ATTEST: THE,CITY OF CORPUS CHRISTI, TEXAS CITY SECRETARY APPROVED AS TO LEGAL FORM THIS THE 16TH DAY OF MARCH, 1959: AIT2.3R 4Y� CORPUS CHRISTI, TEXAS z,19JY, TO THE MEMBERS OF THE CITY COUNCIL CORPUS CHRISTI, TEXAS GENTLEMEN: FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FOREGOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; 1,- THEREFORS, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT IS INTRODUCED OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
