Sample MINUTES CITY OF CORPUS CHRISTI, TEXAS SPECIAL COUNCIL MEETING JANUARY 10, 1979 3:45 P. M. City Manager R. Marvin Townsend City Attorney J. Bruce Aycock City Secretary Bill G. Read Mayor Gabe Lozano, Sr. called the meeting to order in the Council Chambers of City Hall and stated that the purpose of the Special Council Meeting was to conduct public hearings on five zoning applications. City Secretary Bill G. Read verified that the necessary quorum of required Charter Officers was present to conduct a legally constituted meeting. City Manager R. Marvin Townsend announced the public hearing on Applica- tion No. 1178-11, Homer Perkins, et ux, for a change of zoning from "R -1B" One - family Dwelling District to "AB" Professional Office District on Lot 6, Block 14, Gardendale #3, located on the north side of Williams Drive, approximately 250 feet east of Everhart Road. City Manager Townsend noted that the Planning Commission recommends denial of "AB" zoning, but in lieu thereof, that a special permit for a parking lot with a chain link fence in lieu of the standard screening fence be approved with the additional stipulation that no additional driveway access be permitted on this lot. He also stated that the Planning Staff recommends denial on the basis that it would be an intrusion into this residential area. Mr. Townsend informed the Council that in response to the notices of the public hearing, three in favor and none in opposition had been returned. Chief Planner Larry Wenger located the tract of land on the zoning and land use map, described the land use in the surrounding area, showed slides of the area, and explained that the Corpus Christi Board of Realtors plans the expansion of the parking lot and the future expansion of their existing building. Mr. Wenger stated that the applicant prefers the requested "AB" zoning rather than the special permit as recommended by the Planning Commission. \�1. IICROFIIW, eA§ fl minutes Special Council Meeting January 10, 1979 Page 2 Mr. Frank Tompkins, Realtor, stated that he has a contract to purchase this property for the Corpus Christi Board of Realtors in order to expand their facility. Mr. Tompkins explained that the Board does not have an immediate need for this property; therefore, they prefer the "AB" zoning because a special permit is granted for only one year. He stated that the Board feels that they will eventually need to expand their building, and they are aware that property values are increasing in this area. ,Mr. Tompkins also pointed out that the subject property is directly in front of "B-4" zoned property. He also pointed out that property owners in the area have indicated their concurrence with this change of zoning request. City Manager Townsend inquired of Mr. Tompkins if he would have any objec- tion to replatting the property with the prohibition of the driveway access, noting that this was a condition of the recommendation of the Planning Commission. Mr. Tompkins replied that his organization might object to this prohibition and reiterated that their request is for unrestricted "AB" zoning. He explained that they just did not want any restrictions placed on their zoning. Mr. Gene Peeples, representative of the Planning Commission, suggested that the applicant be limited to two curb cuts on Williams Drive, and City Manager Townsend agreed that this could be done. Also speaking on behalf of this applicant was Mr. Sam Main, who informed the Council that the Board objects to the special permit because such a permit requires submission of an exact plan of the proposed building, and they do not have such plans available at this time. Mr. Peeples explained that since he is a member of the Board of Realtors, as well as Mrs. Sarah Cook, they had both abstained when this application was discussed, but the Commission had felt that the special permit was the only way to accomplish the kind of regulations that are needed on this property. No one spoke in opposition to this application. Motion by Gulley, seconded by Juarez and passed unanimously, that the hearing be closed. Motion by Gulley that the Council approve the request for "AB" zoning on Application No. 1178-11, with the stipulation that a chain link fence be allowed in lieu of the usual standard screening fence along the east property line; seconded by Juarez; and passed by the following vote: Gulley, Diaz, Gill, Juarez and Sample Minutes Special Council Meeting January 10, 1979 Page 3 voting "Aye"; Lozano, abstaining; and Holt, absent. . . City Manager Townsend announced the public hearing on Application No. 1278-7, Lois Renfro Hall, for a change of zoning from "A -l" Apartment House Dis- trict to "B-4" General Business District on Lot 9, Block 4, Flour Bluff Center, located on the east side of Central Drive, approximately 350 feet south of South Padre Island Drive. City Manager Townsend stated that the Planning Commission recommends approval, and the Planning Staff recommer.1s denial on the basis that approval would have an adverse effect on the area and lead to similar requests for rezoning on the lot directly across the street, as well as other lots in the immediate area Mr. Townsend informed the Council that in response to the notices of the public hearing, two in favor and one in opposition had been returned. Chief Planner Wenger located the area on the zoning and land use map, described the land use in the surrounding area, showed slides of the area, and explained that the owner plans to develop a shopping center using all of Lots 1 thru 9 and 38 thru 40, Block 4, Flour Bluff Center. City Manager Townsend noted that there is a dedicated private neighborhood park in the area on which several "For Sale" signs have been placed and assured the Council that this will be investigated by the staff to see if such sale of this property is legal. No one spoke in regard to this application. Motion by Sample that the hearing be closed, seconded by Juarez and passed unanimously. Motion by Sample that the Council concur with the recommendation of the Planning Commission and approve the change of zoning on Application No. 1278-7 to "B-4"; seconded by Juarez; and passed unanimously. * * * * * * * * * * * * City Manager Townsend announced the public hearing on Application No. 1278-8, Anna Stepp Tucker, for a change of zoning from "R -1B" One -family Dwelling District to "B-4" General Business District on Lot 8, Phillips 66 Subdivision, located on the north side of Baldwin Boulevard, immediately east of Whataburger on Port Avenue. flutes Special Council Meeting January 10, 1979 Page 4 Mr. Townsend informed the Council that both the Planning Commission and the Planning Staff recommend denial and in lieu thereof grant "B-1" on the basis that similar requests will be made on other "R -1B" properties adjacent and across the street and that "B-1" is already in the area and is a less intense use than "B-4." City Manager Townsend noted that in response to the notices of the public hearing, one in favor and none in opposition had been returned. Chief Planner Wenger located the subject property on the zoning and land use map, described the land use in the surrounding area, showed slides of the area, and stated that this property is currently vacant and the Whataburger, Inc., plans to purchase the lot for additional parking. Mr. Wenger also stated that the appli- cant will accept the "B-1" zoning in lieu of "B-4." No one spoke in regard to this application. Motion by Gulley that the hearing be closed, seconded by Juarez, and passed unanimously. Motion by Gulley that the Council concur with the recommendation of the Planning Commission and deny the requested zoning of "B-4", but in lieu thereof,' grant "B-1" zoning on Application No. 1278-8; seconded by Juarez; and passed unanimously. * * * * * * * * * * * * City Manager Townsend announced the public hearing on Application No. 1278-9, Mr. H. R. Mazzare, for a change of zoning from "B-1" Neighborhood Business District to "B-4" General Business District on Lots 24, 25 and 26A, Bayder Subdi- vision, located at the southwest corner of South Padre Island Drive and Hanley r Drive. Mr. Townsend stated that both the Planning Commission and the Planning Staff recommend approval, and that in response to the notices of this public hearing, two in favor and none in opposition had been returned. Chief Planner Wenger located the tract on the zoning and land use map, described the land use in the surrounding area, showed slides of the area, and stated that the planned use is for motor home sales or Avis Rent-A-Car. No one spoke in regard to this application. City Manager Townsend announced the public hearing on Application No. 1278-10, Gulf Compress, for a change of zoning from "F -R" Farm -Rural District to "1-2" Light Industrial District on Lot 2, Block 1, J. C. Russell Farm Blocks, located at the northwest corner of Heinsohn Road and Bear Lane. City Manager Townsend informed the Council that both the Planning Commis- sion and the Planning Staff recommend approval, and in addition, the Planning Staff recommends that the screening fence requirement be waived along the north property line. Mr. Townsend stated that in response to the notices of the public hearing, two in favor and none in opposition had been returned. Chief Planner Wenger located the tract of land on the zoning and land use map, described the land use in the surrounding area, noting that It is primarily farm land, and showed slides of the area. Mr. Wenger stated that the prospective purchaser of the property plans to construct cotton storage warehouses. No one spoke in regard to this application. Motion by Diaz that the hearing be closed, seconded by Gulley, and passed unanimously. Motion by Diaz that the Council concur with the recommendation of the Planning Commission and the Planning Staff and approve the requested zoning of "1-2" on Application No. 1278-10 and that the standard screening fence requirement be waived along the north property line; seconded by Juarez; and passed unanimously. City Manager Townsend presented the ordinances effectuating the changes approved in the foregoing zoning applications. City Secretary Read polled the Council for their votes, and the following ordinances were approved: Minutes Special Council Meeting January 10, 1979 Page 6 ORDINANCE NO. 14704: AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF LOIS RENFRO HALL BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON LOT 9, BLOCK 4, FLOUR BLUFF CENTER, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM A-1 APARTMENT HOUSE DISTRICT TO B-4 GENERAL BUSINESS DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND' DECLARING AN EMERGENCY. ORDINANCE NO. 14706: AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF H. R. MAZZARE BY AMENDING THE.ZONING MAP BY CHANGING THE ZONING ON LOTS 24, 25 AND 26A, BAYDER SUBDIVISION, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "B-1" NEIGHBORHOOD BUSINESS DISTRICT TO "B-4" GENERAL BUSINESS DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. NOTE: The ordinance pertaining to the zoning Application No. 1278-10, Gulf Compress, was approved during the Regular Council Meeting of this date.
