AUTHORIZING AND DIREC ING THE CITY MANAGER TO
EXECUTE AND DELIVER FOR THE CITY OF CORPUS CHRISTI
A RELEASE TO CORPUS CHRISTI INDUSTRIAL PROPERTIES.,

WHEREAS., AT THE TIME OF THE FILING OF THE PLAT BY CORPUS t.
CHRISTI INDUSTRIAL PROPERTIES., INC. BEFORE THE CITY PLANNING AND ZONING
COMMISSION IN 1956., THERE WAS RESERVED FROM SALE THE NORTH 180 FEET OF
SAID ADDITION FOR THE PURPOSE OF MAKING SAID AREA AVAILABLE FOR THE WIDEN-
ING AND DEVELOPING STATE HIGHWAY 44 AS AN EXPRESSWAY; AND
WHEREAS., THERE ARE NOW NO PLANS TO DEVELOP SAID HIGHWAY AS AN
EXPRESSWAY AND THE STATE HIGHWAY DEPARTMENT HAS EVIDENCED NO INTEREST
IN ACQUIRING SAID AREA FOR THE WIDENING OF SAID STATE HIGHWAY 440 AND THE
SAID AGREEMENT OF THE DEVELOPERS OF SAID ADDITION SHOULD BE RELEASED FROM
THEIR AGREEMENT TO MAKE SAID AREA AVAILABLE FOR HIGHWAY PURPOSES:
NOd., THEREFORE., BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI., TEXAS:
SECTION 1. THE CITY MANAGER OF THE CITY OF CORPUS CHRISTI
BE AND HE IS HEREBY AUTHORIZED TO EXECUTE AND DELIVER., FOR AND ON
BEHALF OF THE CITY OF CORPUS CHRISTI., A RELEASE TO THE CORPUS CHRISTI
INDUSTRIAL PROPERTIES., INC. FROM THE AGREEMENT TO WITHHOLD FROM SALE THE
NORTH 180 FEET OF SAID ADDITION AND WAIVING ANY RIGHT WHICH MIGHT HAVE
EXISTED BY REASON OF SAID AGREEMENT IN THE CITY TO ACQUIRE SUCH PROPERTY
FOR HIGHWAY PURPOSES., A COPY OF WHICH RELEASE 13 ATTACHED HERETO AND
MADE A PART HEREOF.
SECTION 2. THE NECESSITY FOR IMMEDIATE RELEASE OF SAID PROPERTY
FROM THE RESTRICTION PLACED THEREON BY THE DEVELOPERS AS A RESTRICTION
THEREON AND MAKING SAID PROPERTY IMMEDIATELY AVAILABLE FOR SALE CREATES
A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE
SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE
PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE
OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL,
AND THE MAYOR, HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXISTS HAVING
REQUESTED THE SUSPENSION OF SAID CHARTER RULE AND THAT THIS ORDINANCE
BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT THIS ORDI-
NANCE TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AF ER ITS
PASSAGE, IT IS ACCORDINGLY PASSED AND APPROVEDs THIS THE AY OF

FOREGOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST
FOR THE SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE
SHALL BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH

Dear Mr. Whitney:
Supplementing our letter to you of March 5, requesting that the
City Council release Corpus Christi Industrial Properties, Inc. from
its agreement to hold off the market certain platted lots facing High-
way 44, we, at your request, furnish the following additional factual
data.
As is indicated by a copy of the plat of the Corpus Christi
Industrial District herewith enclosed, Lots 1, 2 and 3 in Block 1,
Lots 1, 2, 3, 48, 49, and 50 in Block 2, and Lots 1, 2 and 3 in
Block 3 are shaded and indicated as included in the "Proposed Express-
way." You will notice along the south line of these lots across the
whole subdivision a 10 -foot utility easement is provided.
In the above - mentioned utility easement Corpus Christi Industrial
Properties, Inc. constructed at its expense a 10 -inch water line which
is connected to the east to a City water line on Baldwin Boulevard.
The City of Corpus Christi installed gas lines in this subdivision
and the owner installed sewer and water connections. By reason of a
10 -foot utility easement along the south line of the group of lots
hereinabove mentioned, these lots in each block must of necessity be
sold and improved as single units, leaving that easement clear, because
in the recorded restrictions it is provided that no building shall be
erected or placed anywhere in the subdivision on a site of less than
100 feet in width. This would prevent the cutting of the 185 feet
included in these lots in depth from Highway 44 from being improved as
more than one building site. You will note that the 10 -foot utility
easement is included in the 1$5 -foot depth from the south line of
Highway 44. The restrictions also provide for a minimum of 10 -foot
setback from the inside lot line of a building site, which leaves a
net width perpendicular to Highway 44 of 165 feet for construction of
improvements after deduction of a 10 -foot setback from Highway 44 and
a 10 -foot setback for the utility easement.
Corpus Christi Industrial Properties, Inc. assumes responsi-
bility of making necessary connections to a sewer line and water line
as needed for providing those services to these lots.

We respectfully call your attention to the fact that these
lots are being carried on all tax rolls as improved subdivision
lots, and it is very urgently needed that they be released by the
City Council so that they may be sold and improved as revenue -
producing properties.
Corpus Christi Industrial Properties, Inc. will complete con-
struction of curb and gutter and paving of 44th and 45th Streets
to the south line of Highway 44.
