HomeMy WebLinkAbout05370 ORD - 05/27/1959• IMS ;mw 5 -26 -59 AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, THE "ORDER APPROVING THE GUARANTY OF COST AND SPECIFYING THE PROPOR- TIONATE SHARES OF THE TOTAL COST OF THE PROJECT TO BE BORNE BY THE UNITED STATES AND BY THE BRIDGE OWNER (FIRST REVISION) APPROVED BY THE SECRETARY OF THE ARMY ON 12 JANUARY, 1959 ". AND DECLARING AN EMERGENCY. ;AREAS, by Ordinance No. 5281, passed and approved by the City Council on February 18, 1959, the City Council of the City of Corpus Christi authorized the execution by the City Manager of an "Order approving the guaranty of cost and specifying the proportionate shares of the total cost of the project to be borne by the United States and by the bridge owner (First Revision) ", a copy of which instrument was attached to and made a part of said ordinance; and WHEREAS, said instrument was referred to in said ordinance as "A guaranty of coat agreement" and after the passage of said ordinance said instrument was executed and attested by the City Manager of the City of Corpus Christi and was, in fact, the instrument intended by the City Council in said ordinance to be executed and delivered by said city Manager; and WHEREAS, the United States Army, Corps of Engineers, has re- quested "that the City Council pass an ordinance authorizing the City Manager specifically to execute, on behalf of the City of Corpus Christi, the order approving the guaranty of cost and specifying the proportionate shares of the total cost of the project to be borne by the United States and by the bridge owner (First Revision) approved by the Secretary of the Army on 12 January 1959 ", and the City Council desires to comply with said request: NOV, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. The City Manager of the City of Corpus Christi is hereby authorized and directed to execute on behalf of the City of Corpus Christi, the "order approving the guaranty of coat and specifying the �� ) 0 • • proportionate shares of the total cost of the project to be borne by the United States and by the bridge owner (First Revision) approved by the Secretary of the Army on 12 January 1959 ", photostatic copy of which is attached hereto and made a part hereof. SECTION 2. The execution of a duplicate of said instrument by the City Manager is hereby ratified and confirmed. SECTION 3. The necessity for execution and acceptance of the instrument described in Section 1 hereof by the City in carrying out its obligation under its contract with the Corps of Engineers, United States Army, in the project of Bascule Bridge Relocation under the Truman -Hobbe Act, authorized by Ordinance No. 3990, dated December 15, 1954, creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared such emergency and necessity to exist, having requested the suspension of said Charter rule and that this ordinance be passed finally on the date of its introduction and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY PASSED AND APPROVED, This the ilday of May, 1959. TO THE MEMBERS OF THE CITY COUNCIL CORPUS CHRISTI, TEXAS GENTLEMEN: FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FOREGOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPENSION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE SHALL BE PASSED FINALLY ON THE DATE IT I3 INTRODUCED, AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; 1, THEREFORE, HEREBY REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDINANCE FINALLY ON THE DATE IT 13 INTRODUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL.
