AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR
-AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO
+ EXECUTE A CHANGE ORDER AUTHORIZING AND DIRECTING L ,�
z THE CONTRACTOR TO STABILIZE THE SOILS AT THE NEW
MUNICIPAL AIRPORT BY THE USE OF LIME; APPROPRIATING V
THE SUM OF $26, I3.32 FROM AIRPORT BOND FUND N0.
245 TO COVER THE COST OF SAID CHANGE ORDER; AND

DECLARING AN EMERGENCY.
WHEREAS, excessive and prolonged rains in the vicinity of Corpus i
Christi have materially weakened the condition of the subgrade at the
new municipal airport site to such an extent that the soils have been
reclassified by the Federal Aviation Agency which has rendered it im-
possible for the City to require Heldenfels Brothers, the grading and
paving contractor, to proceed with work on the runways and taxiways at
the new municipal airport; and
WHEREAS, said subgrade condition has necessitated revisions in
the subbase and base design section of the runways and taxiways; and
WHEREAS, in order to meet the F.A.A. design criteria and in
order to offset the weakened subgrade condition it is necessary to make
certain changes in the design sections of the runways, taxiways and ramps

and to stabilize the subgrade by the use of lime stabilization according
to the hereinafter mentioned Change Order.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY "
OF CORPUS CHRISTI, TEXAS:
SECTION 1. That the City Manager is hereby authorized and directed
to execute, for and on behalf of the City of Corpus Christi, a Change Order
which will authorize and direct Heldenfels Brothers, the contractor for the
runways, taxiways and ramps at the new municipal airport, to stabilize
the subgrade underneath the runways, taxiways and ramps by the use of lime
stabilization, according to the plans and specifications prepared by
Reagan & McCaughan, airport engineers. Said Change Order will further
authorize and direct Heldenfels Brothers to make the necessary changes in
the shell sand base course and in the subbase course according to the plans
and specifications prepared by Reagan & McCaughan. A copy of said Change
Order containing the authorized quantities for each of the construction and
material jtmms necessary to affect said changes is attached hereto and made
a part hereof.
SECTION 2. That the aforementioned Change Order may be executed
by the City Manager immediately upon the passage of this ordinance, but
that said Change Order is specifically subject to and will have no force
nor effect until final approval is obtained from the Federal Aviation Agency
as to the use of the aforementioned lime stabilization and as to the
changes in the base and subbase of the runway, taxiway and ramp design
sections. The City Manager is further directed to withhold the issuance
of a Work Order until the aforementioned final approval is obtained from
the F.A.A. In the event that the F.A.A. requires a supplemental or amended
contract with Heldenfels Brothers instead of the above mentioned Change
Order then the City Manager is authorized and directed to execute the
necessary supplemental or amended contract in order to procure participation
in the cost by the F.A.A. Said supplemental or amended contract however,
will also be subject to final approval by the F.A.A. as to the use of lime,
the aforementioned changes in the design sections and the form of the
supplemental or amended contract.
SECTION 3. The aforementioned Change Order, supplemental contract
or amended contract shall not authorize the expenditure of a sum in excess
of $109,950.00, but said sum is hereby authorized as the maximum amount to
be authorized by the aforementioned Change Order, supplemental contract or
amended contract. The sum of $26,113.32 is hereby appropriated out of
Airport Bond Fund No. 245, for City Project No. 10- 56 -5.2, Contingencies,
to cover the aforementioned cost. An amount not to exceed theaforementioned
$109,950.00 is hereby authorized to be transferred from City Project No.
10- 56 -5.2, Contingencies, to City Project No. 10- 56 -5.1, Runways, Taxiways
and Drainage, to cover said cost.
SECTION 4. Public importance of this ordinance and the necessity
of making the necessary changes in the runway;. taxiway and ramp design
sections to meet F.A.A. design criteria due to the weakened subgrade con-
dition, and the necessity of stabilizing said soils by the use of lime
stabilization so that construction may proceed on the new Corpus Christi
municipal airport creates a public emergency and an imperative public
necessity requiring the suspension of the Charter rule that no ordinance

or resolution shall be passed finally on the date of its introduction
and that such ordinance or resolution shall be read at three several
meetings of the City Council, and the Mayor, having declared such emergency
and necessity to exist, having requested the suspension of said Charter
rule and that this ordinance be passed finally on the date of its intro-
duction and that this ordinance take effect and be in full force and effect
from and after its passage, IT IS ACCORDINGLY PASSED AND APPROVED, This
