WHEREAS, A REPRESENTATIVE OF CENTRAL POWER AND LIGHT COMPANY APPEARED BEFORE THIS CITY GOVERNING BODY AND SUBMITTED SUPPORTING DATA AND A PROPOSED NEW RATE SCHEDULE FOR ELECTRIC SERVICE TO RESIDENTIAL CUSTOMERS, ENTITLED "RESIDENTIAL SERVICE" AND IDENTIFIED AS ITS SCHEDULE No. RS -lA, WHICH NEW SCHEDULE IT PROPOSES TO MAKE APPLICABLE TO SERVICE NOW BEING FURNISHED UNDER ITS SCHEDULE N0. LA -CC7; AND A COPY OF A NEW GENERAL SERVICE RATE SCHEDULE IDENTIFIED AS ITS SCHEDULE No. GS -1, WHICH IT PROPOSES TO MAKE APPLICABLE TO ELECTRIC SERVICE FURNISHED UNDER EXIST- ING RATE SCHEDULE No. GS -CC7; AND ALSO SUBMITTED COPIES OF COMBINED LIGHTING AND POWER SERVICE SCHEDULE No. LP -7, GENERAL POWER SCHEDULE No. GP -7 AND CONTROLLED WATER HEATER SERVICE SCHEDULE No. WH -8, WHICH IT PROPOSES TO MAKE APPLICABLE TO ELECTRIC SERVICE NOW BEING FURNISHED UNDER ITS SCHEDULES No. LP -6, GP -6, AND WH-71 RESPECTIVELY; AND RE- QUESTED THIS CITY GOVERNING BODY TO APPROVE SAID NEW RATE SCHEDULES AND IN SUPPORT THEREOF, FURNISHED THIS CITY GOVERNING BODY INFORMATION PERTAINING TO SAID RATE SCHEDULES•AND THE PROVISIONS THEREOF, INCLUDING THE PROVISION WITH RESPECT TO FUEL COST ADJUSTMENT; AND WHEREAS, THE AVERAGE DELIVERED COST OF FUEL TO THE COMPANY FOR THE CALENDAR YEAR 1958 DID NOT EXCEED TEN CENTS PER MILLION BTUs AND, THEREFORE, THE NET ENERGY CHARGE PER KILOWATT -HOUR WILL NOT BE INCREASED UNDER THE FUEL COST ADJUSTMENT PROVSION OF SAID NEW RATE SCHED- ULES DURING THE CALENDAR YEAR 1959; AND WHEREAS, AFTER PROPER CONSIDERATION THEREOF, IT APPEARS THAT SAID NEW RATE SCHEDULES ARE FAIR AND REASONABLE AND SHOULD BE APPROVED AND ACCEPTED; ` NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: +a 1_ 5388 SECTION 1. ON OR BEFORE .JANUARY 31 OF EACH YEAR, CENTRAL POWER AND LIGHT COMPANY SHALL FURNISH THE CITY A WRITTEN STATEMENT SHOWING THE AVERAGE DELIVERED COST OF FUEL PER MILLION BTLIS TO THE COMPANY DURING THE PRECEDING TWELVE (12) MONTHS PERIOD ENDING DECEMBER 31. SECTION 3. Box 9277 Corpus Christi, Texas Dear Ray: �Of6aL9��4 The City Council passed and approved Ordinance Number 5388 on June 17, 1959, adopting certain Central Power and Light Company rate schedules with fuel adjustment clauses. This Ordinance has not been repealed or modified by subsequent ordinance or resolution of the City. In 1964, a change in the Internal Revenue laws caused a decrease _ in our Company's Federal income taxes and, in order to pass the savings under this decrease on to our customers, the Company filed some new rate schedules in place of some of the 1959 schedules. The rates under the 1964 schedules were lower than the rates under the 1959 schedules. No action was taken by the City of Corpus Christi in connection with the 1964 schedules, but the City allowed the Company to go ahead and apply the 1964 rates as long as such rates were not higher than the 1959 rates. The Company, beginning with the May billings, proposes to apply the fuel adjustment clauses contained in the 1964 rate schedules. The billings under the 1964 schedules with the application of the fuel adjustment clauses will be lower than the billings would be under the 1959 schedules. In view of the policy set back in 1964 to the effect that the Company could compute the bills under the 1964 schedules as long as they are less than the bills would be computed under the 1959 schedules, we will proceed as proposed. We submit the following revised schedules with the maximums authorized under Ordinance 5388 indicated on the attachment to each schedule: RS -11, GS -21, LP -31 and WH -17, with Riders CH -28 and RH. Where two housekeeping units are served through one meter, the minimum bill, and the kilowatt hour steps other than the water heater block, will be doubled for billing purposes. Where more than two housekeeping units or apartments are served through one meter, billing will be on the applicable non - residential rate. TYPE OF SERVICE The electric service furnished hereunder will be single phase, 60 cycle, alternating current at a standard secondary voltage. Three phase service will be furnished as provided in Company's published Terms and Conditions governing Electric Service. NET MONTHLY RATE Section 1 $0.75 which includes 12 kilowatt hours 4.600 each for next 38 kilowatt hours .3.100 each for next 100 kilowatt hours 2.10¢ each for next 350 kilowatt hours 1.80¢ each for next 500 kilowatt hours 1.600 each for next 9,000 kilowatt hours 1.250 each for all additional kilowatt hours Section 2 Water Heater Service — Uncontrolled Upon written application by a Customer having in regular use one or more electric water heater installations which conform to Company's standard specifications for electric water heaters, as stated below, the last 400 kilowatt hours used, or fraction thereof, by which Customer's Kwh use exceeds 200 will be billed at 1.104 per kilo- watt hour, provided at least the first 200 kilowatt hours used in any month must be billed on the rate in Section 1 above. Water Heater Specifications 1. The capacity of any single heating element shall not exceed 4,500 watts. 2. The tank capacity of any water heater shall be not less than 40 gallons. 3. The heating elements of twin element water heaters shall be so controlled that not more than 4,500 watts can operate at any time. (Continued) CENTRAL POWER AND LIGHT COMPANY SCHEDULE RS -11 Page 2 Section 3 Space Heating Service — Winter Months only When all electric service used on the premises is supplied through one meter and upon written application by a Customer having permanently installed electric space heating equipment and when electricity is the sole source of energy for all comfort space heating on the premises, the first 500 Kwh used per month will be billed on the rate in Section 1 (above), and, during the Winter Months only, all kilowatt hours used in excess of 500 will be billed at 1.100 per kilowatt hour. Section 4 Minimum Monthly Sill $0.75 per month. WINTER MONTHS Winter Months as used herein shall be the five months service period beginning when meters are read in the October 19th - November 19th meter reading period and ending when meters are read in the March 19th - April 19th meter reading period. Bill dates are from November 26th to April 25th, inclusive. FUEL COST ADJUSTMENT The monthly bill will be increased or decreased at the rate of .00330 ($0.000033) per kilowatt hour for each full one - fourth cent by which the average delivered cost of fuel to the Company during the preceding month exceeds twenty cents or is less than fifteen cents for that quantity of fuel used containing one million BTU. TERMS OF PAYMENT All bills are due when rendered and are payable within ten days thereafter. TERMS AND CONDITIONS Service will be furnished under Company's Standard Terms and Conditions govern- ing Electric Service. CENTRAL POWER AND LIGHT COMPANY RIDER RH RESIDENTIAL SPACE HEATING SERVICE (No new connects will be made on this Rider after September 1, 1964) APPLICABLE To service furnished for space heating equipment (heat pump or resistance heat- ing) during the winter months only, when used in conjunction with rate schedule for water heating service as modified by Terms and Conditions below. NET MONTHLY RATE 1.10 each for all kilowatt hours used. Minimum Monthly Bill (Winter Months only) $1.00 plus the Minimum for Water Heating Service. Fuel Cost Adjustment Same adjustment per Kwh in effect for Water Heating Service. TERMS AND CONDPl'IONS Service will be furnished under the Company's Terms and Conditions applicable to Water Heater Service and the following additional Terms and Conditions. I. Electric service will be supplied during the winter months to the permanently in- stalled and connected 230 -volt electric space heating equipment through a separate circuit to be installed by the customer to which no other equipment may be connected except air conditioning equipment used in conjunction with the space heating equipment. 2. The Customer will also supply general service house wiring and water heater circuit wiring so that there can be readily installed adjacent to the meters, a switching device, to be furnished by the Company, to connect the electric space heating circuit to the meter serving the water heater during the winter months and to the meter registering the general house service during the summer months. The space heating circuit and all water heating service will be uncontrolled as to time and hours of operation. 3. Winter Months: Winter Months as used herein shall be the five months service period beginning when meters are read in the October 19th - November 19th meter reading period and ending when meters are read in the March 19th -April 19th meter reading period. Bill dates are from November 26th to April 25th, inclusive. 4. Summer Months: Summer Months as used herein shall be that portion of the year which is not included in the Winter Months (Section 3 above). MAXIMUM RATE AUTHORIZED BY ORDINANCE #5388 DATED 6 -3 -59 RESIDENTIAL SPACE HEATING SERVICE - RIDER RH NET MONTHLY RATE 1.12 each for all kilowatt hours used. Minimum Monthly Bill (Winter Months only) $2.50 plus the Minimum for Water Heating Service. CENTRAL POWER AND LIGHT COMPANY SCHEDULE WH -17 WATER HEATER SERVICE AVAILABILITY Residential Water Heaters This schedule is available for service to approved type residential water heaters installed prior to September 1, 1964. No new connections for service under this schedule will be made after September 1, 1964. Commercial Water Heaters This schedule is available for service to Commercial water heater installations under the terms and conditions stated herein. NET MONTHLY RATE 1.10 each for all kilowatt hours used. MINIMUM MONTHLY BILL $0.50 per water heater. FUEL COST ADJUSTMENT The monthly bill will be increased or decreased at the rate of .00330 ($0.000033) per kilowatt hour for each full one - fourth cent by which the average delivered cost of fuel to the Company during the preceding month exceeds twenty cents or is less than fifteen cents for that quantity of fuel used containing one million BTU. TERMS OF PAYMENT All bills are due when rendered and are payable within ten days thereafter. TERMS AND CONDITIONS Service will be furnished under the Company's Standard Terms and Conditions and the following additional terms and conditions pertaining to this rate. 1. Service will be supplied through a separate circuit, which will be installed by Customer, to which no equipment except the heating elements of the water heater, and space heating equipment when served under the provisions of Rider No. RH, may be connected. This service will be measured through a separate meter owned and maintained by the Company and located at the point of delivery for Customer's regular service. 2. The heating elements will be uncontrolled as to hours of operation. 3. Residential Water Heaters (a) The capacity of any single heating element shall not exceed 4,500 watts. (c) The heating elements of twin element heaters shall be so controlled that not more than 4,500 watts can operate at any time. 4. Commercial Water Heaters (a) The capacity of any single heating element shall not exceed 125 watts per gallon of tank capacity nor 15 kilowatts. (b) The tank capacity of any water heater shall be not less than 40 gallons. (c) The heating elements of water heaters having two or more elements shall be so controlled that not more than 125 watts per gallon of tank capacity nor more than 15 kilowatts can operate at any time. MAXIMUM RATE AUTHORIZED BY ORDINANCE #5388 DATED 6 -3-59 WATER HEATER SERVICE - RATE WH -8 NET MONTHLY RATE 1.12 each for all kilowatt hours used. Minimum Monthly Bill $0.50 per month per water heater. CENTRAL POWER AND LIGHT COMPANY SCHEDULE GS -21 GENERAL SERVICE AVAILABILITY This schedule is available for electric service supplied at one point of delivery and measured by one meter. Not available for standby, breakdown, supplementary, or resale service. TYPE OF SERVICE Single or three phase, 60 cycle, service will be supplied at Company's standard secondary voltage and through one standard transformation. NET MONTHLY RATE $1.00 which includes 16 kilowatt hours 5.10 each for the next 34 kilowatt hours 4.10 each for the next 100 kilowatt hours 3.10 each for the next 250 kilowatt hours 2.60 each for the next 200 kilowatt hours per kilowatt of Customer's maximum demand, but for not less than 1,000 kilowatt hours 1.60 each for all additional kilowatt hours used Minimum Monthly Bill $1.00 each per kilowatt of maximum demand established by Customer during the month, but not less than $1.00 per horsepower of the largest motor or other in- ductive -type electric device connected. FUEL COST ADJUSTMENT The monthly bill will be increased or decreased at the rate of .00330 ($0.000033) per kilowatt hour for each full one- fourth cent by which the average delivered cost of fuel to the Company during the preceding month exceeds twenty cents or is less than fifteen cents for that quantity of fuel used containing one million BTU. DETERMINATION OF CUSTOMER'S MAXIMUM DEMAND The Customer's maximum demand will be the kilowatt load used by Customer dur- ing the 15- minute period of maximum use during the month. In case the Customer has a highly fluctuating load, provision may be made for measuring the demand over a shorter interval or for use of Customer's connected load instead of measured demand, in determining the Customer's "Maximum Demand" for billing purposes. The demand will be measured when Customer's energy consumption exceeds 1400 kilowatt hours, and /or, when Customer's total connected load exceeds 25 horse- power in motors or other inductive -type equipment. (Continued) CENTRAL POWER AND LIGHT COMPANY SCHEDULE GS -21 Page 2 GENERAL SERVICE CONTRACT SERVICE Contract arrangements will be required of Customer when any of the following conditions exist: (1) When connected load exceeds 50 kilowatts (2) When any billing is to be rendered on a Rider to regular rate (3) When a special monthly or annual minimum bill is applicable (4) When service is used for production, transportation, or processing of oil or gas. TERMS OF PAYMENT All bills are due when rendered and are payable within ten days thereafter. TERMS AND CONDITIONS Service will be furnished under Company Standard Terms and Conditions. MAXIMUM RATE AUTHORIZED BY ORDINANCE #5388 DATED 6 -3 -59 GENERAL SERVICE - RATE GS -1 NET MONTHLY RATE $1.00 for first 16 kilowatt hours, or less 5.12 each for next 34 kilowatt hours 4.12�,each for next 150 kilowatt hours 3.12fi each for next 150 kilowatt hours per kilowatt of customer's maximum demand, but not less than 750 kilowatt hours 1.87p each for all additional kilowatt hours used. CENTRAL POWER AND LIGHT COMPANY SCHEDULE LP -3i COMBINED LIGHTING AND POWER SERVICE AVAILABILITY This schedule is available for electric service furnished through one meter at a standard secondary voltage on execution by the Customer of the Company's Standard Electric Service Contract. This schedule is not available for temporary, resale, or standby service, except in conjunction with applicable rider. Service furnished hereunder shall be used solely on the premises identified in the Electric Service Contract as the premises to be served. NET MONTHLY RATE Kilowatt Charge $2.00 each for the first 50 kilowatts of maximum use but not less than $10.00 $1.50 each for all additional kilowatts of maximum use. Plus a Kilowatt -hour Charge 2.350 each for the first 1,000 kilowatt hours 1.850 each for the next 4,000 kilowatt hours 1.350 each for the next 5,000 kilowatt hours 1.100 each for the next 30,000 kilowatt hours 1.000 each for the next 60,000 kilowatt hours 0.900 each for the next 200,000 kilowatt hours 0.800 each for all additional kilowatt hours used. Minimum Monthly Bill The minimum monthly bill will be the kilowatt charge. FUEL COST ADJUSTMENT The monthly bill will be increased or decreased at the rate of .00330 ($0.000033) per kilowatt hour for each full one - fourth cent by which the average delivered cost of fuel to the Company during the preceding month exceeds twenty cents or is less than twelve cents for that quantity of fuel used containing one million BTU. DETERMINATION OF KILOWATTS The kilowatts will be measured and will be the average kilowatts used by the Customer during the 15- minute period of maximum use during the month. In case the Customer has a highly fluctuating load, provision may be made for measuring the kilowatts over a shorter interval or for use of Customer's connected load instead of measured kilowatts, in determining the Customer's maximum kilowatts for billing purposes. TERMS AND CONDITIONS Service will be furnished under the Company's Standard Terms and Conditions. (Continued) CENTRAL Page 2 TERMS OF PAYMENT All bills are due when rendered and are payable within ten days thereafter. PRIMARY SERVICE DISCOUNT At the option of the Customer there will be a discount of 5% of the kilo- watt hour charge only on all monthly bills, provided service is rendered and metered at the primary voltage of the distribution system and the ' Customer furnishes and maintains all necessary transformation beyond the point of metering. At the option of the Customer there will be an additional discount of 5% of the net kilowatt hour charge remaining after the above 5% discount, provided service is rendered and metered at Transmission Line voltage (69,000 volts or higher) and Customer furnishes and maintains all neces- sary transformation beyond the point of delivery. POWER FACTOR CLAUSE The Company reserves the right to make tests from time to time to determine the power factor of the Customer's installation served hereunder. Should the average lagging power factor during the month be determined to be below 80%, the Customer's kilowatt for billing purposes will be adjusted by multiplying the maximum measured kilowatts by 80% and dividing by the average lagging power factor. MAXIMUM RATE AUTHORIZED BY ORDINANCE #5388 DATED 6 -3 -59 COMBINED LIGHTING AND POWER SERVICE - RATE LP -7 NET MONTHLY RATE Kilowatt Charge $2.00 each for the first 50 kilowatts of maximum use but not less than $10.00 $1.50 each for all additional kilowatts of maximum use. Plus a Kilowatt -Hour Charge 2.371 each for the first 1,000 kilowatt hours 1.87 each for the next 4,000 kilowatt hours 1.371 each for the next 5,000 kilowatt hours 1.12 each for the next 30,000 kilowatt hours 1.02 each for the next 60,000 kilowatt hours. 0.921 each for the next 200,000 kilowatt hours 0.82E each for all additional kilowatt hours used. CENTRAL POWER AND LIGHT COMPANY RIDER CH -28 COMMERCIAL SPACE HEATING RIDER AVAILABILITY This Rider is available under contract, for electric service during the Winter Months, to Customer receiving electric service on Company's Combined Lighting and Power Rate Schedule, Industrial Power Schedule, or General Service Rate Schedules who have in regular use, permanently installed for space heating pur- poses, not less than 5 kilowatts of electric space heating equipment, consisting of a reverse cycle heat pump and /or resistance -type space heating equipment; pro- vided, that electricity is used as heat source for all comfort space heating in the air conditioned areas on Customer's premises. During the Winter Months any space heating equipment served hereunder shall be connected to a separate space heating electric circuit. Said separate circuit shall be installed by Customer, and will be terminated at metering point for Customer's regular service, and shall be used only to supply service to equipment used for com- fort space heating, or to an integral all- electric heating and cooling system. Electric service furnished to the space heating circuit will be metered separately from Customer's other service requirements. Application of Section (A) under Monthly Rate will be suspended and all service furnished will be billed under Section (B) in case Customer fails to comply with the provisions of this Rider. MONTHLY RATE (A) During Winter Months 1.35 cents each for the first 5,000 kilowatt hours supplied to the space heating circuit. 1.10 cents each for all additional kilowatt hours supplied to the space heating circuit. FUEL COST ADJUSTMENT The monthly bill will be increased or decreased at the rate of .00330 ($0.000033) per kilowatt hour for each full one - fourth cent by which the average delivered cost of fuel to the Company during the preceding month exceeds twenty cents or is less than fifteen cents for that quantity of fuel used containing one million BTU. When the load on the heating circuit exceeds 20 kilowatts single phase or 35 kilowatts three phase, the load on the heating circuit will be totalized with Customer's other load by means of a totalizing relay, and the kilowatt hours registered by the meter on the heating circuit will be added to the registration of the kilowatt hour meter on Customer's regular service for billing on rate schedule applicable to Customer's total load. WINTER MONTHS Winter Months, as used herein, shall be the five months service period beginning when Customer's meter is read in the October 19th- November 19th meter reading period and ending when meter is read in the March 19th -April 19th meter reading period. The operation of the controlled unit shall be controlled by a time regulating device. furnished and owned by the Company, to disconnect the unit during certain periods of the day, such periods to be designated by the Company and subject to change from time to time as the Company's peak load conditions vary. Service will be available to the controlled unit eighteen hours a day. 3. The controlled heating unit or units of the electric water heater shall be of a total capacity not in excess of 4500 watts, and the minimum tank capacity shall be 40 gallons. 4. In the case of twin unit heaters, the two units shall be so controlled that both units cannot operate at the same time. . CENTRAL POWER AND LIGHT COMPANY SCHEDULE GS -1 GENERAL SERVICE AVAILABILITY This schedule is available for electric service furnished through one meter at a nominal secondary voltage, where any additional voltage transformation is provided by the Cus- tomer. The rating of individual motors or other inductive -type equipment served under this schedule shall not exceed ten horsepower. It is optional with the Customer whether service will be billed under this schedule or under other available schedules. NET MONTHLY RATE $1.00 for the first 16 kilowatt hours, or less 5¢ each for the next 34 kilowatt hours 4¢ each for the next 150 kilowatt hours 3¢ each for the next 150 kilowatt hours per kilowatt of Customer's maximum demand, but not less than 750 kilowatt hours 13/ ¢ each for all additional kilowatt hours used. Minimum Monthly Bill $1.00 each per kilowatt of maximum demand established by Customer during the month, but not less than $1.00 per horsepower of the largest inductive -type electric de- vice connected which is greater than five horsepower. DETERMINATION OF CUSTOMER'S MAXIMUM DEMAND The Customer's maximum demand will be the kilowatt load used by Customer during the 15 minute period of maximum use during the month. In case the Customer has a highly. fluctuating load, provision may be made for measuring the demand over a shorter interval or for use of Customer's connected load instead of measured demand, in determining the Customer's "Maximum Demand" for billing purposes. The demand will be measured when Customer's energy consumption exceeds 1000 kilowatthours for three consecutive months. TERMS OF PAYMENT All bills are due when rendered and are payable within ten days thereafter. TERMS AND CONDITIONS Service will be furnished under Company Standard Terms and Conditions. CENTRAL POWER AND LIGHT COMPANY COMBINED LIGHTING AND POWER SERVICE AVAILABILITY This schedule is available for electric service furnished through one meter at a standard second- ary voltage on execution by the Customer of the Company's Standard Electric Service Contract. This schedule is not available for resale service, for standby service, or for service to fluctuating loads served by indivdual transformer installations. Service furnished hereunder shall be used solely on the premises identified in the Electric Service Contract as the premises to be served. It is optional with the Customer whether service will be furnished under this schedule or under other available schedules. NET MONTHLY RATE Kilowatt Charge $2.00 each for the first 50 kilowatts of maximum use but not less than $10.00. $1.50 each for all additional kilowatts of maximum use. PRIMARY SERVICE DISCOUNT At the option of the Customer there will be a discount of 5% of the kilowatt hour charge only on all monthly bills, provided service is rendered and metered at the primary voltage of the dis- tribution system and the Customer furnishes and maintains all necessary transformation beyond the point of metering. At the option of the Customer there will be an additional discount of 5% of the net kilowatt hour charge remaining after the above 5% discount, provided service is rendered and metered at Tranmission Line voltage (33,000 volts or higher) and Customer furnishes and maintains all nec- essary transformation beyond the point of delivery. POWER FACTOR CLAUSE The Company reserves the right to make tests from time to time to determine the power factor of the Customer's installation served hereunder. Should the average lagging power factor during the month be determined to be below 80 %, the Customer's kilowatt for billing purposes will be adjusted by multiplying the maximum measured kilowatts by 80% and dividing by the average lagging power factor. CENTRAL POWER AND LIGHT COMPANY SCHEDULE -7 GENERAL POWER AVAILABILITY This schedule is available for electric service for single and three phase lighting and power loads, when all service is taken through one meter at a standard secondary voltage. It is optional with the Customer whether service will be billed under this schedule or under other available schedules.
