THE STATE OF TEXAS
COUNTY OF NUECES
CITY OF CORPUS CHRISTI
On this 5 day of August, 1959, the City Council of
the City of Corpus Christi, Texas, convened in regular meeting,
with the following members of said Council present, to -wit:
James L. Barnard, Mayor Pro -Tem,
Mrs. Ray Airheart,
Joseph B. Dunn,
Patrick J. Dunne, Commissioners,
R. A. Humble,
Gabe Lozano, Sr.,
T. Ray Kring, City Secretary,
with the following absent: _ Mayor Lroy King constituting
a quorum, at which time the following among other business was transacted:
Mr. Herbert W. Whitney, City Manager, presented for the
consideration of the Council an ordinance. The ordinance was read, by the
City Secretary. The Mayor Pro -Tem presented to the Council a communication
in writing pertaining to said proposed ordinance, as follows:

TO THE CITY COUNCIL,
Corpus Christi, Texas.
Gentlemen:
The public importance and pressing need for the permanent
improvements to be constructed by use of the proceeds of the bonds contem-
plated to be voted pursuant to said ordinance create an emergency and an im-
perative public necessity requiring the suspension of rules and Charter pro-
visions requiring ordinances to be considered and voted upon at three regular
meetings. I, therefore, request that the City Council pass the proposed
ordinance calling an election for the issuance of said bonds as an emergency
measure. You will please consider this request in connection with the
ordinance which has been introduced in the City Council on this subject.'

Commissioner Joseph B. Dunn made a motion that the
Charter provision prohibiting ordinances from being passed finally on the
date introduced be suspended for the reasons stated in the written request
of the Mayor Pro -Tern and stated in the emergency clause of the ordinance.
The motion was seconded by Commissioner Mrs. Ray Airheaat The
motion was carried by the following vote:
AYES: Commissioners Airheart, Dunn, Dinner Humble and
Lozano.
NOES: None.
The Mayor Pro -Tam requested that the records show that
he voted Aye. This was done.
Commissioner Patrick J. Dunne made a motion that the
ordinance be passed finally. The motion was seconded by Commissioner
R. A. Humble The motion was carried by the following vote:
AYES: Commissioners Airheart, Dunn, Dunne, Humble and
Lozano.
NOES: None.
The Mayor Pro -Tem requested that the records show that
he voted Aye. This was done.
The Mayor Pro -Tem announced that the ordinance had been
passed. The ordinance is as follows:
ORDINANCE
BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS,
CALLING AN ELECTION ON THE QUESTION OF -THE ISSUANCE OF THE
FOLLOWING BONDS: $1,100,000.00 SANITARY SEWER IMPROVEMENT
BONDS; $2,500,000.00 HOSPITAL BONDS; $130,000.00 STREET -
IMPROVEMENT'BONDS; $50,000.00 STORM DRAINAGE BONDS; $70,000.00
PARK IMPROVEMENT BONDS; $100,000.00 SWIMMING POOL BONDS;
$50,000.00 YACHT BASIN IMPROVEMENT BONDS AND $3,500,000,00
WATERWORKS IMPROVEMENT REVENUE BONDS; AND DECLARING AN
EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
4 1. THAT AN ELECTION BE HELD IN SAID CITY -OF CORPUS,CHRLSTI,-TEXAS,
ON THE 29TH DAY OF AUGUST, 19591 AT WHICH ELECTION THE FOLLOWING PROPOSITIONS
SHALL BE SUBMITTED TO THE RESIDENT, QUALIFIED,ELECTORS OF THE CITY OF CORPUS
CHRISTI, TEXAS, WHO OWN TAXABLE PROPERTY IN SAID CITY AND WHO HAVE DULY
RENDERED THE SAME FOR TAXATION:
PROPOSITION NO. 1
"SHALL THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, -
TEXAS, BE AUTHORIZED TO -ISSUE THE BONDS OF SAID CITY IN THE
AMOUNT OF $2,500,000.00, MATURING SERIALLY IN SUCH INSTALLMENTS
AS THE CITY COUNCIL MAY PRESCRIBE, THE MAXIMUM MATURITY BEING
NOT MORE THAN THIRTY (30) YEARS FROM THEIR DATE, BEARING INTER-
EST AT A RATE NOT TO EXCEED FIVE (5 %) PER CENT PER ANNUM, AND
TO LEVY A TAX ON ALL TAXABLE PROPERTY WITHIN SAID CITY SUFFI-
CIENT TO PAY THE ANNUAL INTEREST AND PROVIDE A SINKING FUND TO
PAY THE BONDS AT MATURITY, FOR THE PURPOSE OF PROVIDING FUNDS

PROPOSITION NO. 2
"SHALL THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS, BE AUTHORIZED TO ISSUE THE BONDS OF SAID CITY IN THE
AMOUNT OF $1,1001000.00, MATURING SERIALLY IN SUCH INSTALLMENTS
AS THE CITY COUNCIL MAY PRESCRIBE, THE MAXIMUM MATURITY BEING
NOT MORE THAN THIRTY (30) YEARS FROM THEIR DATE, BEARING INTER-
EST AT A RATE NOT TO EXCEED FIVE (5 %) PER CENT PER ANNUM, AND
TO LEVY A TAX ON ALL TAXABLE PROPERTY WITHIN SAID CITY SUFFI-
CIENT TO PAY THE ANNUAL INTEREST AND PROVIDE A SINKING FUND TO
PAY THE BONDS AT MATURITY, FOR THE PURPOSE OF CONSTRUCTING IM-
PROVEMENTS TO THE SANITARY SEWERAGE SYSTEM OF THE CITY, AS

PROPOSITION NO. 3
"SHALL THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS, BE AUTHORIZED TO ISSUE THE BONDS OF SAID CITY IN THE
AMOUNT OF $130,000.00, MATURING SERIALLY IN SUCH INSTALLMENTS
AS THE CITY COUNCIL MAY PRESCRIBE, THE MAXIMUM MATURITY BEING
NOT MORE THAN THIRTY (30) YEARS FROM THEIR DATE, BEARING INTER-
EST AT A RATE NOT TO EXCEED FIVE (5%) PER CENT PER ANNUM, AND

cient to pay the annual interest and provide a sinking fund to

"Shall the City Council of the City of Corpus Christi,
Texas, be authorized to issue the bonds of said City in the
amount of $50,000.00, maturing serially in such installments
ae the City Council may prescribe, the maximum maturity being
not more than Thirty (30) years from their date, bearing inter-
est at a rate not to exceed Five (5 %) per cent per annum, and
to levy a tax on all taxable property within said City suffi-
cient to pay the annual interest and provide a sinking fund to
pay the bonds at maturity, for the purpose of providing funds
for improving the storm drainage system of the City, as authoriz-
ed by the Constitution and laws of the State of Texas and the
Charter of said City."
PROPOSITION N0. 5
"Shall the City Council of the City of Corpus Christi,
Texas, be authorized to issue the bonds of said City in the
amount of $70,000.00, maturing serially in such installments
as the City Council may prescribe, the maximum maturity being
not more than Thirty (30) years from their date, bearing inter-
est at a rate not to exceed Five (5 %) per cent per annum, and
to levy a tax on all taxable property within said City suffi-
cient to pay the annual interest and provide a sinking fund to
Pay the bonds at maturity, for the purpose of improving lands
for park purposes, as authorized by the Constitution and laws
Of the State of Texas, and the Charter of said City."
PROPOSITION NO. 6
"Shall the City Council of the City of Corpus Christi,
Texas, be authorized to issue the bonds of said City in the
amount of $100,000.00, maturing serially in such installments
as the City Council may prescribe, the maximum maturity being
not more than Thirty (30) years from their date, bearing inter-
est at a rate not to exceed Five (5 %) per cent per annum, and
to levy 6 tax on all taxable property within said City suffi-
cient to pay the annual interest and provide a sinking fund to
pay the bonds at Emturity, for the purpose of providing funds
for permanent public improvements to -wit: the construction of
swimming pools for the City, as authorized by the Constitution
and laws of the State of Texas, and the Charter of said City."

"Shall the City Council of the City of Corpus Christi,
Texas, be authorized to Jesus the bonds of said City in the
aMOunt of $50,000.00, maturing serially in such installments
as the City Council may prescribe, the maximum maturity being
not more than Thirty (30) years from their date, bearing inter-
est at a rate not to exceed Five (5 %) per cent per annum, and
to levy a tax on all taxable property within said City suffi-
cient to pay the annual interest and provide a sinking fund to
pay the bonds at maturity, for the purpose of constructing per-
manent improvements to the City's yacht basin, as authorized
by the Constitution and laws of the State of Texas, and the
Charter of said City."
PROPOSITION N0. 8
"Shall the City Council of the City of Corpus Christi,
Texas, be authorized to issue the bonds of said City in the
amount of $3,500,000.00, maturing serially in such installments
as the City Council may prescribe, the maximum maturity being
not more than Thirty (30) years from their date, bearing Inter-
est at a rate not to exceed Five (5%) per cent per annum, for
the purpose of improving and extending the City's Waterworks
System, to be issued in accordance with and secured in the
manner provided In Article 11106 and Articles 1111 -1118, both
Inclusive, of the Revised Civil Statutes of Texas, 1925, as
amended, Chapter 249, Acts of the Regular Session of the 51st
Legislature and Chapter 250, Acts of the 51st Legislature, as
amended by Chapter 23, Acts of the 52nd Legislature, and as per-
mitted by the ordinance and Indenture authorizing and securing
the presently outstanding waterworks revenue bonds, each bond
to be conditioned that the holder thereof shall never have the
right to demand payment of said obligations out of funds raised
or to be raised by taxation, secured by a pledge of the net
revenues from the operation of said system, a deed of trust
lien on said system and the pledge of a franchise to operate
said system for a term of not exceeding twenty years in event
of sale after default as provided in the power of sale contain-
ed in said mortgage."
2. That voting machines shall be employed at the election
herein ordered in accordance with the provisions of V. A. T. S. Election Code,
Article 7.14, and said election shall be held at the polling places in the
regularly prescribed voting precincts of the City of Corpus Christi, such
voting precincts, polling places, and the officers hereby appointed to con-

Such other officials as required or authorized by law shall be appointed by the Council, or,
in the absence of such appointment, by the election officials herein named.
3. THAT SAID ELECTION SHALL BE HELD IN ACCORDANCE WITH THE
PROVISIONS OF CHAPTER 1, TITLE 22 OF THE REVISED CIVIL STATUTES OF TEXAS, 1925,
AS AMENDED, INCLUDING THE PROVISIONS OF ARTICLE 7011, AS AMENDED BY CHAPTER 382,
PASSED AT THE FIRST CALLED SESSION OF THE 44TH LEGISLATURE, AND THE CITY CHARTER
OF THE CITY OF CORPUS CHRISTI, TEXAS, AND ONLY LEGALLY QUALIFIED ELECTORS WHO
OWN TAXABLE PROPERTY IN THE CITY AND WHO HAVE DULY RENDERED THE SAME FOR TAX-
ATION SHALL BE QUALIFIED TO VOTE.

5. A substantial copy of this ordinance signed by the
Mayor of said City and attested by the City Secretary shall serve as proper
notice of said election. Notice shall be given in accordance with Article 704,
Revised Civil Statutes of 1925, as amended. The Mayor is authorized and direct-
ed to have a copy of said notice posted at the City Hall in said City and at
each of the voting places in said City, not less than fifteen days prior to
the date fixed for holding said election. He shall also cause said notice to
be published on the same day in each of two successive weeks in a newspaper of
general circulation published within said City, the date of the first publi-
cation to be not less than fourteen days prior to the date set for said
election. Except as otherwise provided in said Article 704, as amended, the
manner of holding said election shall be governed by the laws governing general
elections.
6. That the public importance and the pressing need for
the permanent improvements to be constructed by use of the proceeds of the sale
of said bonds create an emergency and an imperative public necessity requiring
the suspension of rules and Charter provisions requiring same to be considered
and voted upon at three regular meetings, and such facts require that this
ordinance be passed and take effect immediately as an emergency measure, and
such rules and provisions are hereby suspended and this ordinance is passed
and shall take effect as an emergency measure, and shall be in full force and
effect immediately upon its passage.
