Barnard, Mrs. Ray Airheert, Joseph B. Dunn, Patrick J. Dunne, Commissioners, R. A. Humble, Gabe Lozano, Sr., T. Ray Kring, City Secretary, with the following absent: — 00VI e constituting a quorum, at which time the following among other business was transacted: Mr- Ellroy King, YAyor, presented for the consideration of the Council an ordinance. The ordinance was read by the City Secretary. The Mayor presented to the Council a communication in writing pertaining to said proposed ordinance, as follows: "Co Christi, Texas, 1959. TO THE CITY COUNCIL, Corpus Christi, Texas. Gentlemen: The public importance and pressing need for the permanent improvements to be constructed by use of the proceeds of the bonds voted at the election held,on August 29, 1959, create an emergency and an imperative public necessity requiring the suspension of rules and Charter provisions requiring ordinances to be considered and voted upon at three regular meetings I, therefore, request that the City Council pass the proposed ordinance can - vaesi.ng the returns and declaring the result of the election for the issuance of said bonds as an emergency measure. The motion was seconded by Commissioner �� The motion was carried by a unanimous vote by the City Council, viz: AYW: Commissioners Barnard, Airheart, Dunn, Dunne, Humble and Lozano. ACES: None. The ordinance is as follows: ORD=U10E N0. -- --L- =� BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TESAS, CANVASSING RETURNS AND DE- CLARING RESULTS OF AN ELECTION ON THE QwSTION OF THE ISSUANCE OF THE FOLLOW= BOOS. $1,100,000.00 SANITARY SEWER neROVJM BONDS; $2,500,000.00 HOSPITAL BONDS; $130,000.00 STREET IMPROVEMM BOMB; $50,000.00 STORM DRAINAGE BONDS; $70,000.00 PARK IDaROVEmw BOND;.S; $100,000-00 SWDOUNG POOL BONDS- $50,000-00 YACHT BASIN IMPROVEMENT BONDS AND $3,500,000.00 WATERWOM IMPROVEMENT REVENUE BONDS, AND DECLARING AN EMERGENCY. , heretofore on the 5th day of August, 1959, the City Council of the City of Corpus Christi, Texas, passed an ordinance calling an election to be held in said City on the 29th day of August, 1959, on the following propositions: PROPOSITION NO. 1 "Shall the City Council of the City of Corpus Christi, Texas, be authorized to issue the bonds of said City in the amount of $2,500,000.00, maturing serially in such installments as the City Council may prescribe, the maximum maturity being not more than Thirty (30)years from their date, bearing inter- est at a rate not to exceed Five (5 %) per cent per annum, and to levy a tax on all taxable property within said City suffi- cient to pay the annual interest and provide a sinking fund to pay the bonds at maturity, for the purpose of providing funds to pay the City's part of the cost of expanding and enlarging the existing Memorial Hospital, as authorized by the Constitution and laws of the State of Texas and the Charter of said City." PROPOSITION NO. 2 "Shall the City Council of the City of Corpus Christi, Texas, be authorized to issue the bonds of said City in the amount of $1,100,000.00, maturing serially in such installments as the City Council may prescribe, the maximmm maturity being not more than Thirty (30) years from their date, bearing Inter- est at a rate not to exceed Five (5 %) per cent per annum, and to levy a tax on all taxable property within said City suffi- cient to pay the annual interest and provide a sinking fund to pay the bonds at maturity, for the purpose of constructing im- provements to the Sanitary Sewerage System of the City, as authorized by the Constitution and laws of the State of Texas, and the Charter of said City." PROPOSITION N0. 3 "Shall the City Council of the City of Corpus Christi, Texas, be authorized to issue the bonds of said City in the amount of $139,000.00, maturing serially in such installments as the City Council may prescribe, the maximum maturity being not more than Thirty (30) years from their date, bearing inter- est at a rate not to exceed Five (5%) per cent per annum, and to levy a tax on all taxable property within said City suffi- cient to pay the annual interest and provide a sinking fund to pay the bonds at maturity, for the purpose of improving the streets of the City, as authorized by the Constitution and laws of the State of Texas and the Charter of said City." PROPOSITION NO. h "Shall the City Council of the City of Corpus Christi, Texas, be authorized to issue the bonds of said City in the amount of $50,000.00, maturing serially in such installments as the City Council may prescribe, the maximum maturity being not more than Thirty (30) years from their date, bearing inter- est at a rate not to exceed Five (5 %) per cent per annum, and to levy a tax on all taxable property within said City suffi- cient to pay the annual interest and provide a sinking fund to pay the bonds at maturity, for the purpose of providing funds for improving the storm drainage system of the City, as authoriz- ed by the Constitution and laws of the State of Texas and the Charter of said City." PROPOSITION No. 5 "Shell the City Council of the City of Corpus Christi, Texas, be authorized to issue the bonds of said City in the amount of $70,000.00, maturing serially in such installments as the City Council may prescribe, the maximum maturity being not more than Thirty (30) years from their date, bearing inter- est at a rate not to exceed Five (5 %) per cent per annum, and to levy a tax on all taxable property within said City suffi- cient to pay the annual interest and provide a sinking fund to pay the bonds at maturity, for the purpose of improving lands for park purposes, as authorized bythe Constitution and laws of the State of Texas, and the Charter of said City." PROPOSITION No. 6 "Shall the City Council of the City of Corpus Christi, Texas, be authorized to issue the bonds of said City in the amount of $100,000.00, maturing serially in such installments as the City Council may prescribe, the maximum maturity being not more than Thirty (30) years from their date, bearing inter- est at a rate not to exceed Five (5 %) per cent per annum, and to levy a tax on all taxable property within said City suffi- cient to pay the annual interest and provide a sinking fund to pay the bonds at maturity, for the purpose of providing funds for permanent public improvements to -wit: the construction of swimming pools for the City, as authorized by the Constitution and laws of the State of Texas, and the Charter of said City." PROPOSITION NO. 7 "Shall the City Council of the City of Corpus Christi, Texas, be authorized to issue the bonds of said City in the amount of $50,000.00, maturing serially in such instal.lmente as the City Council may prescribe, the maximum maturity being not more than Thirty (30) years from their date, bearing inter- est at a rate not to exceed Five (5 %) per cent per annum, and to levy a tax on all taxable property within said City suffi- cient to pay the annual interest and provide a sinking fund to pay the bonds at maturity, for the purpose of constructing per- manent improvements to the City's yacht basin, as authorized by the Constitution and laws of the State of Texas, and the Charter of said City." PROPOSITION N0. 8 "Shall the City Council of the City of Corpus Christi, Texas, be authorized to issue the bonds of said City in the amount of $3,500,000.00, maturing serially in such installments as the City Council may prescribe, the maximum maturity being not more than Thirty (30) years from their date, bearing inter- est at a rate not to exceed Five (5 %) per cent per annum, for the purpose of improving and extending the City's Waterworks System, to be issued in accordance with and secured in the manner provided in Article 1220a and Articles 11]1 -1118, both inclusive, of the Revised Civil Statutes of Texas, 1925: as amended, Chapter 249, Acts of the Regular Session of the 51st Legislature and Chapter 256, Acts of the 51st Legislature, as amended by Chapter 23, Acts of the 52nd Legislature, and as per- mitted by the ordinance and Indenture authorizing and securing the presently outstanding waterworks revenue bonds, each bond to be conditioned that the holder thereof shall never have the right to demand payment of said obligations out of funds raised or to be raised by taxation, secured by a pledge of the net revenues from the operation of said system, a deed of trust lien on said system and the pledge of a franchise to operate said system for a term of not exceeding twenty years in event of sale after default as provided in the power of sale contain- ed in said mortgage." and WHEREAS said election was duly held at the tim and places specified after due notice as 'required by law had been given by post- ing and publication; and WHEREAS, there were cast at said election the following votes: PROPOSITION NO. 1 "FOR THE ISSUANCE OF HOSPITAL BONDS" `Jy/.&votes; "AGAINST THE ISSUANCE OF HSPPPAL BONDS" Votes. That said election was duly celled; that notice was given in accordance with law andin accordance with the ordinance calling the election; that the election was held in accordance with law; that the returns of said election have been made by the proper officers; that a majority of the qualified voters who own taxable property in said City and who have duly rendered the same for taxation voting at said election have voted in favor Of the issuance of said bondsnN PROPOSITIONS No. 1, 21 3, 4 AND 8. 2. That the City Council be and it is hereby in all things authorized to issue said bonds and to do any and all things necessary or convenient in connection therewith. 3. That the public importance and the pressing need for Ctha permanent improvements to be constructed by use of the proceeds of the f sale of said bonds create an emergency and an imperative public necessity requiring the suspension of rules and Charter provisions requiring same to be considered and voted upon at three regular meetings, and such facts re- quire that this ordinance be passed and take effect immediately as an F emergency measure, and such rules and provisions are hereby suspended and this ordinance is passed and shall take effect as an emergency measure, and sha11 be in full force and effect immediately upon its passage.
