AN ORDINANCE
AUTHORIZING THE ACQUISITION OF CERTIFICATES OF
SPECIAL ASSESSMENT FOR STREET IMPROVEMENTS ON
ALAMEDA STREET, HERETOFORE AUTHORIZED BY THE CITY
COUNCIL FOR ACQUISITION BY THE CITY IN THE TOTAL
AMOUNT OF ASSESSMENT OF $51,259.70; APPROPRIATING
AND REAPPROPRIATING THE SUM OF $36,259.70
OUT OF NO. 220 STREET BOND FUND AND THE USE OF THE
SUM OF $15,000.00 HERETOFORE APPROPRIATED BY
ORDINANCE NO. 5196 FOR PAYMENT OF SAID CERTIFICATES;
DECLARING ORDINANCE NO. 5196 AMENDED BY THETERMS OF
THIS ORDINANCE; AND DECLARING AN EMERGENCY.
WHEREAS, CERTAIN SUMS WERE APPROPRIATED BY ORDINANCE N0. 5196
OUT OF BOND FUND No. 220 STREET BOND FUND FOR THE PAYMENT OF STREET
IMPROVEMENTS ON ALAMEDA STREET DESIGNATED AS PROJECT NO. 220 - 53-3.2,
INCLUDING THE SUM OF $15,000.00 FOR ACQUISITION OF SPECIAL ASSESSMENT
CERTIFICATES IN THOSE CASES WHERE IMPROVEMENTS WERE AUTHORIZED BY THE
CITY COUNCIL AFTER NOTICE BY THE CONTRACTOR OF HIS REFUSAL TO ACCEPT
PAVING CERTIFICATES FOR SUCH IMPROVEMENTS; AND
WHEREAS, THERE 1S AN UNEXPENDED BALANCE FROM THE FUNDS FROM
THE SAID ORDINANCE N0. 5196 FOR CONSTRUCTION OF $62,373.86 AND AN UN-
EXPENDED BALANCE FOR CONTINGENCIES IN THE AMOUNT OF $13,570.82 AND IT
IS THE DESIRE OF THE CITY COUNCIL THOSE SAID BALANCES INSOFAR AS TO
SUPPLEMENT THE APPROPRIATION OF $15,000.00 PROVIDED IN SAID ORDINANCE
No. 5196 FOR ACQUISITION OF PAVING ASSESSMENT CERTIFICATES:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CORPUS CHRISTI, TEXAS:
SECTION 1. THAT THERE IS HEREBY APPROPRIATED THE SUM OF
$36,259.70 OUT OF N0. 220 STREET BONO FUND BEING THE UNEXPENDED BALANCE
REMAINING AFTER THE PAYMENT OF CONSTRUCTION AND CONTINGENCIES FROM THE
FUNDS APPROPRIATED BY ORDINANCE NO. 5196, AND SAID FUNDS ARE HERE AND
NOW REAPPROPRIATED FOR THE ACQUISITION OF SPECIAL PAVING ASSESSMENT
CERTIFICATES. THE FURTHER SUM OF $15,000.00 APPROPRIATED BY SAID
ORDINANCE NO. 5196 SHALL ALSO BE USED, MAKING A TOTAL AMOUNT AVAILABLE
FOR ACQUISITION OF SAID PAVING CERTIFICATES OF $51,259.70.
SECTION 2. THAT INSOFAR AS THE SUMS HEREIN REAPPROPRIATED
CONFLICT WITH SAID ORDINANCE No. 5196, DATED NOVEMBER 19, 1958, SAID
ORDINANCE N0. 5196 1S HEREBY AMENDED.

BROTHERS 1S HEREBY AUTHORIZED UPON DELIVERY TO THE CITY OF AN ASSIGN-
MENT OF SAID CERTIFICATES, SAID ASSIGNMENT BEING SUBSTANTIALLY IN THE
FORM AS ATTACHED HERETO AND MADE A PART HEREOF.
SECTION 4. THE NECESSITY FOR IMMEDIATE PAYMENT AND ACQUISITION
OF PAVING CERTIFICATES IN ACCORDANCE WITH THE CONTRACT OF THE CITY AND
THE AUTHORIZATION HERETOFORE MADE BY THE CITY COUNCIL CREATES A PUBLIC
EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION
OF THE CHARTER RULE PROVIDING THAT NO ORDINANCE OR RESOLUTION SHALL BE
PASSED FINALLY ON THE DATE IT IS INTRODUCED AND THAT SUCH ORDINANCE OR
RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL,
AND THE MAYOR, HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST,
HAVING REQUESTED THAT SUCH CHARTER RULE BE SUSPENDED AND THAT THIS
ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE
EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE,
