PRESENT: Mayor Luther Jones Mayor Pro Tem Edward L. Sample Council Members: Dr. Jack Best Jack K. Dumphy Betty N. Turner. Cliff Zarsky City Manager R. Marvin Townsend Asst. City Attorney Bob Coffin City Secretary Bill G. .Read Mayor Luther Jones called the meeting to order in the Council Chambers of City Hall. City Secretary Bill G. Read verified that the necessary quorum of required Charter Officers was present to conducta legally constituted meeting. City Manager R. Marvin Townsend announced the public hearing on Application No. 679-10, Messrs. Roy B. Taylor and Oscar H. Taylor, for a change of zoning from "R -1B" One -family Dwelling District to "R-2" Multiple Dwelling District on Lots 10, 11, 12 and 13, Block A, Highway Park, located at the northwest cornerof Rhodes Court and Mobile Drive. Mr. Townsend informed the Council that both the Planning Commission and the Planning Staff recommend approval and that in response to the notices of the public hearing, one in favor and none in opposition had been returned. He then asked Mr. Larry Wenger, Chief Planner, to summarize the case. Chief Planner Wenger located the area on the zoning and land use map, des- cribed the land use in the surrounding area, showed slides of the area and stated that the owners plan the construction of duplex units at this location. No one spoke in regard to this application. Motion by Sample that the hearing be closed, seconded by Best and passed unanimously. Motion by Sample that the Council concur with the recommendation of .the Planning Commission and the Staff and approve the zoning of "R-2" for Application No. 679-10; seconded by Dumphy; and passed unanimously. * * * * r: * * * * * * * * Mayor Jones announced the public hearing on Application No. 679-11 , Island lce, Inc., for a change of zoning from "R -1B" One -family Dwelling District to "B -b" hinutes Special Council Meeting August 1, 1979 Page 2 General :',,iness District on the east 40 feet of Lot 26B, Block 8, Flour Bluff Estates ?i`, located on the north side of Claride Drive, approximately 150 feet east of M.A.S. Drive. :'ity Manager Townsend stated that both the Planning Commisst,n and the Plan- ning Staff recommend approval and that in response to the notices of the public hearing, one in favor and "one in opposition were returned. Chief Planner Wenger loc.:ed the area on the zoning and land use map, des- cribed the land use in the surrounding area, showed slides of the area and informed the Council that this request is made just to allow an additional 40 feet so that the applicant will be able to construct the standard screening fence along the east property line. No one spoke in regard to this application. Motion by Zarsky that the hearing be closed, seconded by Sample and pa:,>d unanimously. Motion by Zarsky that the Council concur with the recommendation of the Planning Commission and approve the requested zoning of "B-4" on Application No. 679-11; seconded by Best; and passed unanimously. * * * ., * * * .. ,. .. * * * * t City Manager Townsend announced the public hearing on Application No. 679-12, Highway Pipeline Trucking, for a change of zoning from "1-2" Light Indus- trial District to "1-3" Heavy Industrial District on a 10.092± acre tract of land out of Lot 1, Block 7, J. C. Russell Farm Blocks, located on the east side of Flato Road, between Highway #44 and Bear Lane. Mr. Townsend stated that both the Planning Commission and the Planning Staff recommend approval and that in response to the notices of the public hearing, one in favor and one in opposition had been returned. Chief Planner Wenger located the area on the zoning and land use map, des- cribed the land use in the surrounding area, showed slides of the area, and stated nearly all of the property in this vicinity is vacant land and the applicant plans to utilize the property for a trucking yard and a free-standing propane fuel tank for use of the company only. Special Council Meeting August I, 1979 Page 3 No one spoke in regard to this application. Motion by Sample that the hearing be closed, seconded by Zarsky and passed unanimously. Motion by Turner that the Council concur with the recommenc. of the Planning Commission and approve the zoning of "1-3" on Application No. 679-12; seconded by Dumphy; and passed unanimously. City Manager Townsend presented the ordinances effecting the zoning changes approved during the foregoing public hearings. City Secretary Read polled the Council for their votes, and the following ordinances were approved: ORDINANCE NO. 15038: AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE 'ORDINANCE PND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICUL4RLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF MESSRS. ROY B. AND OSCAR H. TAYLOR BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON LOTS 10, 11, 12 AND 13, BLOCK A, HIGHWAY PARK, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "R -IB" ONE -FAMILY DWELLING DISTRICT TO "R-2" MULTIPLE DWELLING DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH: AND DECLARING AN EMERGENCY. The Charter Rule was suspended and the foregoing ordinance passed by the following vote: Jones, Sample, Best, Dumphy, Turner and Zarsky voting "Aye"; Diaz, "absent". ORDINANCE NO. 15039: AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE !'ND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF ISLAND ICE, INC. BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON LOT 26B, BLOCK 8, FLOUR BLUFF ESTATES #2, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "R-lB" ONE -FAMILY DWELLING DISTRICT TO "B-4" GENERAL BUSINESS DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. Tne Charter Rule was suspended and the foregoing ordinance passed by the following cote: Jones, Sample, Best, Dumphy, Turner and Zarsky voting "Aye"; Diaz, "absent".
