Bruce Aycock City Secretary Bi11 G. Read Mayor Luther Jones called, the meeting to order in the Council Chamber of City Hail. City Secretary Bill G. Read verified that the necessary quorum of required Charter Officers was present to conduct a legally constituted meeting. Litt' Manager R. Marvin Townsend announced the public hearing on Application No. 379-10, Tucker Properties, for a change of zoning from "F -R" Farm -Rural District to '::x._16:4 One -family Dwelling District on Tract A, and from "F -R" Farm --Rural District 4" General Business District on Tract B, both tracts being described as follows. -act A =, : l ng i . i OTt acres and Tract B being 1.30'1 acres out of Lot 24, Section 12, 17, a.n;;s a portion of Lot 18, Section 19, Flour Bluff and Encinal Farm and Garden Tracts (Wooldridg Creek Unit 2) located at the southwest corner of Wooldridge Road and AAS i ie - ?. Mr. Townsend noted that both the Planning Commission and the Planing Sisf' recommend denial on the basis that the .tr e pl ex is a nonconforming use and stats•1 that in response to the notices of the public hearing, five in opposition and .,,. in favor had been returned. He also pointed out that the 20% rule is in e€feet.. City Tanager Townsend then requested that Mr. Larry Wenger, Chief Planner, suclmeH e the zoning case. Mr. Wenger located the area on the zoning and land use map, described the land use in the surrounding area, showed slides of the area, and stated that the applicants plan to convert a four-bedroom house into a triplex on Lot 4 and to h .va ='a^ proper zoning for usage on Lot 5 One of the applicants, Mr. James D. Preis, stated that he would like to thdr l, ha i s request for change of zoning on Lot 5 but that they would like to have t e z0P h 7 u on Lot 4 changed to "R-2" so that the .property can be improved by the remodeling of the existing structure for multiple dwelling units. o-- else spoke in regard to this application. Voticn b;ample that the hearing be closed, seconded by Diaz and passed un _lim€ousl Motion by Semple that the Council concur with the recommendation of the Planning Commission n deny therequest for change of zoning on Application No. 879 -fl; ser.: «.: gay Diaz; and passed unanimously. * * * * * * I. * `di d4 asp * JG iG City Manager Townsend announced the public hearing on Application No. 87 -12, 1 -Highway Pipeline Trucking, for a change of zoning from "1-2" Light Indus- trial District to "1-3" .Heavy industrial District on a 5.046- acre tract of land out of Lot 1, Block 7, Partition of the J. C. Russell Farm Blocks, located, on the east side of Flato Road between Highway 44 and Bear Lane. Minutes Special Council Meeting September 26, 1979 Page 3 City Manager Townsend stated that both the Planning Commission and the Planning Staff recommend approval on the basis that it would be a logical extension of the existing "1-3" zoning in the area. Mr. Townsend informed the Council that in response to the notices of the public hearing, one in favor and one in opposition. had been returned. Mayor Jones ascertained that no one in the audience desired to speak on this matter. Motion by Sample that the hearing be closed, seconded by Turner and passed unanimously. Motion by Best that the Council concur with the recommendation of the Planning Commission and the Planning Staff and grant the change of zoning for Application No. 879-12 to "I---3" seconded by Turner; and passed unanimously. City Manager Townsend presented the ordinances effecting the changes in zon- ing approved in the foregoing applications.. City Secretary Read polled the Council for their votes, and the following ordinances were approved: ORDINANCE NO. 15151: AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED; UPON APPLICATIONOF TUCKER'PROPERT1ES BY AMENDING THE .ZONING MAP BY CHANGING. THE. ZONING. ON TRACT ''A" 'FROM '"F-�R'' FARM=RURAL I D I STR 1 CT TO .!,:_RIB" ONE FAMILY DWELLING DISTRICT, AND CHANGING'THE ZONING OF TR CT -"T3" FROM "F -R FARM -RURAL DISTRICT TO "B-1" NEIGHBORHOOD:BUSINESS DTSTRICT,'SAID. TRACTS BEING MORE PARTICULARLY DESCRIBED HEREINAFTER; BEING WOOLDRIDGE'CREEK UNIT"2 SUBDIVISION; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH.; AND DECLARING AN EMERGENCY: The Charter Rule was suspended and the foregoing ordinance passed by the following vote: Jones, Sample,. Best, Diaz, Dumphy,.Turner and Zarsky voting, "Aye". ORDINANCE.No:. 15152: AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI:ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION .RECORDS, AS AMENDED FROM TIME TO TIME AND,PARTICULARLY AS.AMENDED.BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF HIGHWAY PIPELINE TRUCKING BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON A 5.0+6+..ACRE TRACT OF LAND OUT LOT .1, BLOCK 7;' PARTITION.
