Read called the roll of required Charter Officers and sated -that the necessary quorum was present to conduct a legally constituted meeting. - Ilayor Jones announced that a proclamation had been issued designating October 26-27, 1979 as "COItMDMITY HEALTH FAIR DAYS." The first is for $24.500 for resolutlan of 70 charges and Ole second is for :'5i8,250 for resolution of 3D backlog cases now pending and to purchase audio visual equipment for training. These funds are for November 1, 1979 through October 31, 1980 for the continuation of the Human Relations Activity's equal employment opportunity activities, consisting of 2 professional and 1 clerical position. s. An ordinance be passed establishing a self-insurance fund to provide coverage for liability risks such as automobile liability, general liability, excess liability, liability of public officials, liability for money and securities and unemployment compensation. The City Manager would have authority to pay claims up to $5,000 with any claim over $5,040 having to be approved by the City Council. Council Member Diaz questioned the procedure followed by the City In settling claims. Mr. Diaz noted that even though the City is now self-insured, Mr. Lindsey Newsome prepares an appraisal of damages; the staff the makes another appraisal; the City Attorney reviews the appraisal; it then goes to the Fire Chief, • .Poltce £hlef or other Department Head involved; and then the matter must have the approval of the City Manager. Mr. Diaz suggested that this is a duplication of services, and if the staff plans to make an appraisal, there is no need to have to outside appraisal. He pointed out that this requires a great deal of time and generates unnecessary -delays in settling the claim. .Asslatant -City- Manager Walker explained that the City Attorney reviews the appraisal made by the independent appraiser; If it is less than.$500. ho can recon mend payment of the ciaim but if it is over this amount, the Biala is sent to i;e_ depeatmeat head affected primarily so. that he will be aware of the circumstances involved,- He stated that the claim then goes to the City.Mariager for Ma approva1a Mr, Walker -further informed Mr. Max that the staff does not make another appraisal, but they doe review the outside appraisal. City Attorney Aycock further explained that the staff needs .tohave an. attorney involved in the claims at the beginning because of the possibility of litigation, but he assured Mr. Diaz that the City staff does not make reappraisais-:" Assistent City Manager Walker concluded the discussion on thio matter by stating that the City has not been self-insured very long, and the process will be streamlined as soon as possible. t. Mayor Pro Tem Sample stated that he felt that possibly not enough discus- sion has been held or: this and mentioned the fact that when Commissioner J. P. ruby first presented this natter to the Nueces County Commissioners Court, not all" of the Cossss+iissioners had been in favor of it. Mr. Sample mentioned the fact that he just _id not feel that he had enough information about this to vote affirmatively 'on this resolution. Council Member iarsky informed Mr. Sample that he made the motion that this resolution be passed today and explained that all the Council is doing is express- ing approval of the pass in order to encourage development of this area. Mr. iarsky pointed out that there is a great need for additional marinas in the arca which, would be possible If this second pass is approved by the legislature.
