The invocation was given by The Reverend Rudy Sanchez of the Primera Iglesia Bautista. Acting Assistant City Secretary Dorothy Zahn called the roll of required Charter Officers and verified that the necessary quorum was present to conduct a legally constituted meeting. Mayor Pro Tena Sample announced the following proclamation to be issued: "CATHOLIC SCHOOLS WEEK 1980" - January 27 to February 2, 1980. Dr. Rudolph T. Barrer*, applicant, thanked the Council for allowing him a postponement of his presentation which was scheduled the week before and introduced his attorney, Mr. 31. J. Motto. Mr. Nutto gave -.r+e background information regarding Or. {aarrera's request for a permit to allow hiss to build on his property, stating that on several occasions, Dr, 8arrera had contacted the City to inquire of its plans for future development of this area and that he bad been told that no expansion was anticipated; therefore, Mr. Barrer/ could use histract of land as he wished. Mr, Nutto-commented that at this tine. Dr. barrera is ready to develop but is being stymied by the City as he has been told that the City is ready to condemn the subject property. He asked for the City's confirmation on this, City Manager Townsend explained that when this tract was secured. it was used as a golf driving range; had always been zoned "R-15"; and that the City had hoped to acquire the tan to protect the sewer plant. City intends to acquire this propertyR. and contended that there have been no negotiations for acquisition. .Citi,Martaxr Townsend remarked that the City usually tries to negotiate with the property owner, but if negotiations prove to be unsuccessful as in this case, would be pleased to place it on the agenda for next weak recroortending condemnation proceedings on the subject property_ Council Member Diaz agreed that this matter should be pieced on the agenda for next week either for plans to moot etc or recommending condemnation. Dr. Marrero spoke at this time, stating that.ali of the conditions are-angY— veering problems which could be resolved if he could obtain a permit to proceed. He questioned the Councll's action in granting him a zoning change and allowing him -to spend a large soma money for development when it was the City's intention all along to afire the land - Council Member Zrsky expressed his opinion. stating that he sympathizes with Dr. Barrerats case but feels that the City has to make the final decision for the protection of the citizens. Mr. summarized by saying that he would like for the City to allow Nr. Morrison to buy the property but not require the owner to Incur the extensive expense for the water line. Council Mlember Zarsky inquired of Ni-. Prichard what the City's reason was for not allowing them to tie onto the existing water line. Mr. Prichard replied that the reason given for not allowing then to tie in was because of the possibility of leakage. City Manager R. MarvinTownsendcalled on Mr, Doug Matthews, Director of Public Utilities. to el uc idate further. Nr. Matthews explained that the Platting Ordinance requires that every piece of property, must have its ova, access to utility system; that the Water Distribution System Standard is part of the Platting 0•dinance which require that all lines be - looped and Wit in accordance with said ordinance for protection from fire; and that in this ease, the City has suggested that the line be placed on the other side of holly Road across from the property because of a stub -out provided off of South Staples so that the water line will be less expensive to.the pra_gperty owners,_and the City has no Objection to the present water line being extended across to the outer side of the stet. 'Council Member Turner Inquired if Nr. Anthony were to retain possession of the land, would the additional water connections be required. Mayor Pro Tem Sample called for the vote on the notion to -recess the: hearing for one week. notion carried unanimously. t * * * * * * a * Mayor Pro Tem Sample next announced the scheduled recessed public hearing on the following ratter: Request of Corpus Christi Transportation Company, Inc. for a taxicab' rate increase. The last increase was granted on April 18, 1975. Current rates are $.85 for the first 1/4 mile, $.20 for each additional 1/4 m le.and wafting time based on $8_00 per hour. The requested rates are $1.20 for the first,1/5 mile and $.20 for each additional 1/5 mile with a waiting time charge based on $12.00 per hc'sr. On the average 4 -mite trip, the requested increase is 54.55%. The company is also requesting a night-time (10 p.m. - 4 a.m.) surcharge of $1.00 per trlp. The public hearing.on this request was recessed last week until today so that copies of the rate increase could be distributed to the -other taxicab-companles and-as..urvey.cauld he mads to determine if there are any cities which do not require permits for taxicabs ar-dfor do not establish rates for them. Mr. King stated it sounded very agreeable providing the drivers complied with the condition. Council Member Best reiterated -that the company could submit to the City coeancii an established fee, a competitive one; it would have to be posted; and the fee could not- - be increased without notifying the City Council. Council Member Zarsky asked if the requested rates were approved+ could the other companies be under the rate_ City Manager Townsend replied that they could but explained that each company has to charge the same rate for all customers -- that it is unfair to charge different: rates for different customers.. Council Member Best expressed his opinion by Stating that he strongly believes -that the individual cab company should be allowed to charge what he believed is fair as long as the tariff is established and posted. Mr King commented that this would present a tot of problems and that he prefers that the rates he set by the City. He also stated that he is in favor of the staff's recomeeatdation of S.95 for the first 1/5 mile, !fir.
