Read verified that the necessary quorum of required Charter Officers was present to conduct a legally constituted meeting. City Manager R. Marvin Townsend announced the public hearing on Application. 11o. 680-6, Weber Road Baptist Church, for a change of sowing from "R -IB" One -family Dwelling District to "AB" Professional Office District on €.0ts 9 and 10, Block 5, Sherwood Park Subdivision, located between Weber Road and Chester Drive, approrl- a Lely 140 feet north of Redwood Street. City Manager Townsend informed the Council that the Planning Commission recommends denial, but in lieu thereof, that a special permit be approved accord- ing to an approved site pian and several special conditions; and the Planning Staff, recommends denial on the basis that it would be an Intrusion Into this residential area and create additional traffic on Ciiester Drive. He further stated [hat the staff is of the opinion that if the special permit is granted, the rear portion of the property included in the application should be deleted from the request and developed with single-family homes feting on Chester Drive. Mr. Townsend noted that in response to the notices of the public hearing, one in opposition and one in favor had been returned. Mayor Jones then invited the applicant to address the Council. e Hr- Tom Wilson, Pastor of the Church, explained that the church is r.qu--t- ing the_chaege of zoning for the potential purchaser of the property. He stated that the Physicians and Surgeons Hospital plans to install s facility for the rehabilitation of alcoholics, and the church is forced to sell the property for financial reasons because of excessive expenses incurred by the church. He assured the Council that the residents of the proposed facility will have previously received -treatment at the hospital and this will he a type of halfway house for the comple- tion of their rehabilitation_ Council Member Turner expressed concern about the fact that the subject pro- perty backs onto Chester Drive, which is a residential neighborhood, and questioned whether or not the planned use is appropriate for residential areas. Mr. Wilson explained that it teas his understanding that such a residential area would be beneficial to the patients, and he felt that the proposed use would be an improvement over the vacant lot that is now located there. Council Member Best expressed concern that the residents within the area were net aware of the type_ of facility that was planned for this tract and sug- gested that they be notified again of the change of zoning application and the type of use contemplated. Council Member Turner agreed, noting that most residents of the area wauld have automatically assumed that a conventional type of professional office building would be constructed there. Mr. Leo Frederick, Office Manager of the Physicians and Surgeons Hospital. assured the Council that this is not a halfway house but is considered are extended care facility. She expressed the epeninn !hat all property peters i"volved should be notified of the intended use before the spe- cial permit for this particular facility is approved. Motion by Zarsky that Application No. 680-6, Weber Road Baptist Church, be tabled for one week and that all property owners within the 45C -Foot radius be noti- fied of the intended use; seconded by Sample; and passed unanimously. City Manager Townsend announced the public hearing on Application No. 780-1, Mr. Barry G. Andrews. for a change of zoning From "l-2" Light Industrial District to "8-4" General Business District on Lot K. Block 2A, Byron Willi, Subdivision, lo.at,•d at the southwest corner of South Padre Island Drive and Flynn Parkway. City Manager Townsend pointed out that both the Planning Commission and the PIanning Staff recommend approval, and that in response to the notices of the public . hearing, one in favor and none in opposition were returned. - Chief Planner Wenner located the area on the zoning and land use map, dee- cribed the land use in the surrounding area, showed slides of the area, and stated that the applicant plans the construction of a motel or hotel at this location. Mayor .tones ascertained that no one wished to speak in regard to this application. Motion by Sample that the hearing be closed, .seconded by Zarsky and pnsu-:I unanimously. Townsend noted that both the Planning Commission and the Planning Staff recommend approval and that there was no response to the notices of the public hearing. Mayor Jcnes ascertained that no one in the audience desired to address the Council in regard to this epplIestioo, Motion by Best that the hearing be closed, seconded by Sample and pasta unanimously. City Secretary Read polled the Council for their votes and the following ordinances were passed: ORDINANCE NO. 15655: AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937. APPEARING OF RECORD IN VOLUME 9, ?AGES 565, ET SEQ. OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY A5 AMENDED BY ORDINANCE NO. 8106, A5 AMENDED, UPON APPLICATIOR OF BARRY G. ANDREWS 8Y AMENDING 311E ZONING MAP BY CHANGING THE ZONING ON LOT K, BLOCK 2A, BYRON WILLIS SUBDIVISION SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "1-2" LIGHT INDUSTRIAL TO "B-4" GENERAL BUSINESS DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMER- GENCY.
