Read Mayor Luther Jones called the meeting to order in the Council Chambers of City Nail and stated that the purpose of the meeting was to conduct public hearings an four zoning applications. City Secretary Bill G. Read verified that the necessary quorum of required Charter Officers was present to conduct a legally constituted meeting. City Manager R. Marvin Townsend announced the public hearing on Application Ho. 780-7, Mr. Terry L. Wanda, for a change of zonino from "R -1B" One -family Dwelling District to "B-4" General Business District on tot 16, Block 10, Gardendale Addition, located on the north side of llofly Road, approximately 234 feet east of Burton Lane. City Manager Townsend informed the Council that the Planning Commission recommends denial, but in lieu thereof a special permit be approved for a landscape nursery and gift fruit basket operation subject to an approved site 1316n. Mr. Townsend noted that in response to the notices of the public hearing; one in opposition and two in favor had been returned. He further informed the Council that opposition was sufficient to invoke the 20% rule. Councflmember Best Informed the Council that this application was a resubmission that had previously been denied. Chief Planner Larry Wenger located the area on the zoning and land use map, described the land use in the surrounding area and showed slides of the Brea. Mayor Jones then invited the applicant to address the Countil. Mr. Charles Cartwright, representative of the applicant, staled that the property is aired by Drs. Lowell Keep, A. K. Fernandez and R. Melia. He further emphasized that tee type of business proposed would not generate any noise since Et is a service type business that would not operate during late hours. Lew Hewitt, Chairman of the Deacons of the Gardendate Baptist Church, explained that Gerdendale Baptist Church has plans for building apartments for retired persons and did net think the proposed use wauid be compatible with their Ione -range plans. He further stated that unless the streets are widened and the eel -tread tracks removed, Holly Road will not be able handle the increased traffic volume. Or. Lowell Keep. co-owner, stated that they have had numerous conversations with the church but have been unahie to reach any agreement on the purchase of the 3QC, and since they are so far apart an agreeing, that they should go before the Council to make a decision. Cnuncitmenber Edward Semple referred to previous zoning approved on Everhart and McArdle and the subsequent result of additional business zoning. He was of the 107. opinion that this case is similar since the residences front on Holly. He stated that since this area will eventually be zoned for business or industrial use, he Ftr$ felt that the requested zoning should he approved. "`'�'�'�+'•'` Cauncilmelmber fJl.'asphy was of the opinion that business zoning is inevitable in this area and retaining the residential zoning would probably create problems in rxafx r,� the future for the City, and he would have to agree with the Planning Commission's SY's` recommendation. e' Mayor Jones referred to the fact that the Council had made a ruling only a few months ago and that nothing about this application has changed. He stated he would be opposed to granting this request. Counclimember Zarsky stated that if the Council did agree to business zoning, there would be no reason not to grant other business zoning on Holly Road and that this street does not have the capacity for the large traffic flow. James Wells of MO Graham Road in Flour Bluff stated that he has been a nurseryman for 30 years and Informed the Cou"cii that hs was of t:te opinion that the landscape nursery business is not very stable. He further stated that the retail end is :fat very large and that this has been the trend for the last 20 years. Motion by Mayor Pro Ter= Sample that the hearing be closed, seconded by Counclimemher Toreer and passed unanimously. Mayor Jones stated that he was of the opinion that any change from "R-16" to business zoning would increase the traffic along Holly Road. Councilme ber Farsky made a motion to deny the application of either °'8-4" or the special permit. Riaz, Dumpily and Turner voting "Aye"; Jones end Zarsky voting "Nay„ City Manager Townsend Informed the Council that the ordinance will require 6 affirmative votes to pass. City Manager Townsend announced the public hearing on Application No. 860-2, dr. John T. Tucker, for a change of zoning from "A -i" Apartment House District and "B-4" General Business District to "R-15" One -Family Dwelling District on an 18.74+ acre tract of land out of Lot 9 and 10, Section 19, Fluor Bluff and Encina' Farm and Garden Tracts, laested at the northwest corner of Rodd Field Road and Wooldridge Read. Hr. Townsend informed the Council that the Planning Commission recommends approval. Notion by Dunphy that the }fearing be closed, seconded by Turner and passed unanimously. City Manager Townsend informed the Council that the Planning Commission has recommended approval. Mr. Cine Peeples of the Planning Commission informed the Council that this was the third time this :.ase has come before the Counci) and that there should be a way to provide this type of zoning. Councileeaber Turner inquired if the applicant had addressed the parking problem. Counoilneeber Zarsky inquired if there was any consensus of the Planning Commission of spacing between driveways. elr. Peeples stated that there was not and that they were looking at 180 feet as possibly being the desirable lot width_ Counei1member Zarsky stated that he agreed with Mr. Peeples that "AB" would be proper zoning for Everhart, bat that spacing should also be proper. Mayor Pro Tem Sample stated that a recommendation should be made to the staff that they work harder to resolve this problem_ Mr. W. A. City Manager Townsend informed the Council that the Planning Commission recommended approval. Hr. Sidney Bishop stated his brother had came before the Council for "8-4" zoning which was denied and at that time the City staff recommended "B-1". Re stated he would like to do something other than just pay taxes on this land. Motion by David Dia: to close the hearing, seconded by Turner and passed unanimously.
