Read Mayor Luther Janes called the meeting to order in the Council Chamber of City Mail and stated that the purpose of the meeting was to conduct public hear- ings on five zoning appilcatians. City Secretary Bill G. Read verified that the necessary quorum of the Council and the required Charter Officers were present to conduct a legally con- stituted meeting. City Manager R. Marvin Townsend announced the public hearing on Applica- tion No. 680-4, Hr. John A. Caivan, for a change of zoning from "R-21°Multiple Dwelling District to "AB" Professional Office District an the west side of Kilgore Street, approximately 50 feat north of Alexander Street, being Lot 10, Block 1, Porta!rs Subdivision. City Manager Townsend informed the Council that ar acceptable site plan had not been submitted; therefore, the Planning Commission, which had previously recommended denial of the "AB" zoning but in lieu thereof a special permit for a child care center subject to an appropriate site plan, now recommends denial of the application; and the Planning Staff recccmmends denial on the basis that it would he inconsistent with the neighborhood since this area is totally developed with dupiexes and single-family dwellings. Hr. Townsend also noted that in response to the notices of the public hearing, four in favor had been returned. He than asked Hr. Larry Wenger, Chief Planner, to summarize the case. Chief Planner Wenger located the area on the zoning and Land use map, described the land use in the surrounding area, stating that the subject property is developed with a duplex as are Lots 9 through 16 along this street, and showed slides of the area. Ee60 Page 2 ese Mr. Singer explained that the site plan submitted required sigh; parking spaces but one sp a extended into the front right-of-way and is therefore unacceptable and is not in accordance with the ordinance. Mayor Joune then called on the appiecent to speak. Mr. John A. Galvan, the owner. explained that he proposes ee convert the existing structure into a child care center because of the demand for this service in the immediate area; the structure will accommodate approximately, 34 children; and pointed out that there was no written opposition to his request. Hr. Galvan also stated that a fence would be installed around the facility. e Hagar Janes Enquired of Mr. Galvan if he planned to operate the Facility himself, and Mr. Galvan replied that he did nat. City Manager Tawnsend pointed out that the problem before the Council is that if "AP" zoning is granted, Mr. Galvan will not be able to proceed with his plans, because the parking space requirement would require a waiver from the Board of Adjustment. He noted, however, that a special permit with the waiver could be approved. No one else spoke in regard to this application. Notion by Sample that the hearing he closed, seconded by Diaz and passed unanimously. Council Member Zars1y asked if the staff recommends the special permit. and City Manager Townsend replied that the matter is really a Board of Adjustment decision, since Mr. Galvan has not provided enough parking spaces. He pointed out the.: even though the site pian submitted shows eight parking spaces, ane extends into the right-of-way, and Mr. Galvan Indicated that ha only plans to have five parking spaces. Chief Planner Wenger informed the Council that he is also required to have a certain amount of open space in order to operate a child care facility. City Manager Townsend asked Mr. Galvan if he had presented a plan that meets the requirements of the State agency that licenses day care centers, and Mr. Galvan replied that he had not because he wanted to be sure he could obtain the proper zoning first. Mr. Townsend further informed the Council that a large number of responses had teen received as a result of the mailing of the notices of this public hearing, most of them from individual property owners. He stated that sol of them agree with the changes of zoning and desire the reduction of their paring assessments and others have responded in oppo- sition because they have specific plans for improvements to their property. Chief Planner Menger located the area on the zoning and land use map; described the land use in the area, stating that most of the property is zoned "AB" but is used for residences; and showed slides of the area. Mr. bteeger explained that the Planning Commission had requested the staff to perform a more detailed study of this area, following which the staff had ascertained the pre- dominant use in the entire area. He stated that as a result of this study, the staff had made the recommendation as set forth above for certain areas to be zoned according to the predominant use. City Manager Townsend stated that although the staff recommends the areas for the various zoning, they also recommend that any property owner who petitioned to have their property zoned "R -1B" in order to reduce the amount of their street assessments should be granted that zoning. Noting the large number of citizens in attendance for this public hearing, Mayor Jones asked for a show of hands as to the number in favor of the change of zaning and those opposed to the change of zoning, and approximately 12 indicated that they were in favor and an equal number indicated that they were opposed. * * f * e * a a * s * * * f r s * . _ y * * lc** e * z x * s - - Mayor Janes stated that he would like to digress from this public hearing in order to allow Mr. Hareli Z. Browning, attorney of the firm of Harris, Cook and Browning, to speak at this time on behalf of Mr. Jim Harris in rebuttal to accusa- tions made by representatives of the Corpus Christi Taxpayers Association. Mr. Browning informed the Council that Mr: Jim Harris is out of the City and not expected back until late that afternoon or the following day. I was prevented frau disclosing any information by virtue Of the fact that I was, at oen time. the attorney for the Taxpayers Asso- ciation and any information I possessed was held in strict confidence. A lawyer is only released from his duty to protect his client's confidences In certain Situations and ane of these situations is the need to defend himself ween he has been accused of wrongful conduct. 'Channel 3 and Mr. Toga Runt, Sr., In a newscast of October 7, 1980, are examples of poor reporting and poor memory. Obviously, Mr. Tax Runt, Sr. has failed to semereber that the Taxpayers Association, Hr. Hunt himself. and fourteen other Officers and Directors of the Taxpayers Association were sued for $17,000,9OO by Dr. Jack Best in ane suit (ironically for libel and Slander) and had the additional responsibility of defending a lawsuit brought by the City of Corpus Christi against its taxpayers to void the Taxpayers Assoclation's proposition 14, They were confronted with the prospect of Paying thousands of dollars in attorneys' fees in both cases, win or lose, and the assets of each of the individuals involved would have been subject to whatever judgment Or. Best might have obtained, not to mention the public embarrassment of having their Proposition 14 declared unconstitutional. ''As attorney for the Taxpayers Association. I was requested to obtain the dismissal of both lawsuits and to achieve several other agreements with the City Council. The dismissal of the lawsuits and all but one agreement were achieved. The one agreement that was not achieved was the firing of Marvin Townsend. "I was advised that the City Council would not make the firing of Marvin Townsend a part of any settlement agreement. Several hours were spent with the Executive Committee of the Taxpayers Association, including Mr, Tom Hunt, Sr., and individual discussion was had concerning all matters as well as the Marvin Townsend issue. It was agreed by the Executive Committee, and later by the Taxpayers Association's general membership, that the firing of Marvin Townsend was eat the purpose of the organization, but the purpose of the organization was to obtain tax relief. It was this rationale that led the members of the Executive Committee to influence the membership of the Taxpayers Association to agree to the written settlement agreement. Everything in the "deal" with the City Council was in the written settle- ment agreement. Hit is true that we all speculated about Marvin Townsend's future and based on information I had obtained from other sources, as well as my opinion, at that time I felt that If the Taxpayers Association would not make a big issue of the Mervin Townsend matter, that Marvin Townsend probably would not be City Manager much longer, and even if ha were, they always had their remedy at the polls through the election of a new City Council, "fifes, I know the true :tory and the whole story, es do other responsible meebeis of the community and the Executive Committee of the Taxpayers Association. That true story is that en agreement was rade with beneficial results to the Taxpayers Assoc ation, Its Officers, Directors and members, as well es the City of Corpus Christi and its Council Members. "Taking a statement out of context without reauiring r'eliyery of all tapes is reporting without facts. Channel 3 would be better advised to report the news -- not make the news. Hr. ,fgf Rodriguez, 2305 Marguerite Street, indicated that he is in favor of the change of zoning to Kr- Herein Ericson, speaking on behalf of the owners of Lots 23, 24, 25, and 26, Block 7, Steele Addition, stated that three of the lets are being utilized for multi -family use; the other twu lots are vacant but have residential zoning of "A-2"; and if the zoning is reduced to "A-1", the vacant lots cannot be used for multi- family omits. He requested that these lots not be changed from "A-2" to "A-!". Mrs. Dolores H. Torres, 1006 23rd Street, the owner of Let 22, Bieck 4, Tierra Alta Subdivision, spoke in favor of "R-18" zoning for her property. Mr. Jack Solka, representing Dr. and Mrs. James E. Albright who own pro- perty at the intersection of Buford and 23rd Street, informed the Council that they wish to retain the "A-2" zoning on their property. Mr. Luis P. Soto, 2725 Marguerite Street, the owner of Lots 11, 12, 13 and 14, Stock 8, Steele Addition, stated that he is in favor of the requested change of zoning. Mr. Steve C. Fischer, 713 South lith Street, who m+ns lots 2 thru 9, Block 6, Summit Addit€a*,, stated that he prefers to retain the existing zoning because businesses are already located there. Mrs. Gilbert Garcia, the owner of property at 2602 Ruth Street, indicated her preference for the recommended residential zoning on her property. Mr. Herman R. Thorn, et ux, 1453 Daytona, sumer-of property at the inter- section of Norris and Blurtzer Streets, described as Lots 12 and 13, Block 2, Summit Addition, stated that the six units located there are net single-family dwelling units and he prefers that the existing zoning be retained. Mr. Thorn also stated that he owns Lots 54, 60, 61 and 62, Block 8, Steele Addition, and would like for that property to retain the "A-2" zoning. Adolfo Gal#epos, 1007 25th Street, the owner of Lot i2, Block 2. lbntroet Marion, stated Haat he would like to retain the "A-2" zoning on his property. Speaking in favor of the 1°R-iB" zoning was Mrs. Virginia Gomez, 906 23rd Street. lir. Clarence Hodge, 2312 Nary. owner of Lots 6, 7, and 8, Block 9, Patrick Webb Addition, stated that he is opposed to the change of zoning for his property, noting that it Is presently zoned "A-2" and the recommended change is to "R-2". !tr. Sam Wilmot, Jr., 802 Bluntzer, stated that he would like to have Lots 9, 10 end 11 of Block 10 at the intersection of Mentzer and Ruth Streets to be rezoned "!1 -it" but that he would like for Lot 12 to remain zoned "A-2". Mr. Bert Beynon, 1026 23rd Street, informed the Council that he had recently purchased this property at the corner of 23rd and Buford Streets as an investment and he would like to retain the "A-2" zoning rather than have it rezoned "A -I". Mary Helen Haas, 1014 23rd Street, stated that she purchased the duplex property at this address and would like to retain the zoning of "A-2". Mr. 5. R. Liman, 2029 Horne Road. who owns property in the Summit Addition, stated that ler prefers that the zoning of "A-2" be retained rather than the recom- mended zoning of "R -lis". 1 Mrs. Thomas R. Savale, 2618 Morris Street, stated that she i5 in favor of "R-111" zoning_ Alio speaking in favor of the residential zoning was Mrs. Maria Yanez, 2316 Morris Street. Mrs. Ianuela Maze, 2606 Morris Street, described as Lot 20, Block 2, Summit Addition, spoke in favor of "R -1B" zoning for her property. City Manager Townsend summarized the situation and recommended that the decisien on the zonteag case he tabled in order to allow the staff time to review the written responses to the notices of the public hearing, as well as the property owners who have appeared, so that a recommendation in regard to the proper zoning can be made. Motion by Durmphy that the hearing be closed, seconded by Sample and passed unanimously. Motion by Dunphy that the zoning application No. 0880-1. City of Corpus Christi, be tabled for two weeks; seconded by Sample; and passed unanimously. Council Member Turner inquired if all of the property owners could be notified of the ultimate staff recommendation. City Manager Tewnsend pointed out that this zoning case involves several hundred property owners and suggested that instead, the property owners could call the Planning Department office to see If there is any change in the staffs recom- mendation. * ,! * * * * * * * * n * ,i * * * * * * * * * * * * * * 5 * is * * * City Manager Townsend announced the public hearing on Application No. 980-1, Greenwood Forest, Ltd., for a change of zoning from "I-2" Light industrial District to "R -1B" One -family Dwelling District on the east side of Greenwood Drive and the south side of Molly Road, being out of Lot 8, Section 7, Bohemian Colony Land. Me stated that both the Planning Commission and the Planning Staff recom- mend approval and noted that there was no response to the notices of the public hearing. Mayor Jones ascertained that no one in the audience desired to speak in regard to this application. Motion by Turner that the hearing be closed, seconded by Sample and passed unanimously. Mr, Townsend informed the Council that the Planning Commission recommended denied of "8-1" and in lieu thereof that a special permit for a parking tot, so long as the adjacent property is used as a drive-in grocery, with a 6' screening fence, and no c -precise consumption of liquor beverages. He also stated that the Planning Staff recommends denial on the basis that this area was included in the Neighborhood improvement and Lode Enforcement Programs started several years ago to reprove residential structures and streets in this area. City Manager Townsend further stated that in response to the notices of the public hearing, five in favor had been returned. He then requested that Mr. Wenger suwaarixe the case. Chief Planner Wenger located the area on the zoning and land use map, des- cribed the land use in the surrounding area, shvted slides of the -area, and stated that the water plans to establish a parking lot for adjacent business zoned property. Mr. Geronimo Serna, 4438 Angela, confirmed the fact that he planned only to establish a parking lot for the business adjacent to thls property. Speaking !n opposition to the zoning request was Mrs. Lola Nelson, 818 Villareal, whose house is located next to the subject property. Mrs. Nelson objected to the proximity of the proposed parking lot to her house. Council Mneber Dutrphy noted that if a special permit is granted, a S' screening fence would be required. City !tanager Townsend questioned the need for additional parking to serve the adjacent business, and Mr. Serna replied that sometimes he asks customers to park in the rear of his grocery store and gasoline pump business. Mrs. Nelson stated that she is concerned because she understood that Mr, Serna plans to repair flat tires and park abandoned vehicles in the parking lot. Motion by Turner that the hearing be closed, seconded by Sample and passed unanimously. Jesus Alan£z. for a change of zoning from "R -AB" One -family Dwelling District to '!AB" Professional Office District at the southeast corner of Villareal Drive and Yolanda Drive, being Lot 25, Block 12, Le Pascua #2. He informed the Council that both the Planning Commission and the Planning Staff recommend denial and that in response to the notices of the public hearing. four in favor had been returned. Chief Planner Wenger located the area an the zoning and land use map, des- cribed the land use In the surrounding area, semeed slides of the area, and stated that the ,prospective purchaser/applicant plans to establish a day care center at this site. Mr. Wenger stated that this area was downzoned less than a year ego because most of the property zoned 'B-!" was being utilized for single-family purposes. Mr. Manuel Vela, representing the applicant, stated that Hr. Alaele was not informed about the dewnzondng of the property before he considered purchasing. Council Member 2ersky suggested that a special permit subject to the appro- val of a site plana be considered since Mr. Mlaniz understood that the zoning on the property would allow for the establishment of a child care center. City Manager Townsend noted that the applicant pians to use three Sots for the establishment of the center and that the application was only for Lot Z5, Block 12, rather than for lets 23, 24 and 25. He then inquired if the Council would like for the staff to initiate the proceedings to prepare the zoning case so that the proper site is included in the application. Motion by Best that the hearing be closed, seconded by Diaz and passed unanimously. City Manager Townsend explained that the entire zoning cast will have to be started all over aoain but that it would be at no cost to the applicant.
