SPECIAL COUNCIL MEETING
JANUARY 28, 198f

Mayor Pro Tem Edward L. Sample called the meeting to order in the Council
Chamber and stated that the purpose of the meeting was to conduct public hearings
on three zoning applications. -
*City Secretary Bill G. Read verified that there is a quorum of the Council
and the necessary Charter Officers present to conduct a legally constituted meeting.
City Manager Townsend announced the public hearing on Application No. 1280-3,
Bennett & Associates/Seafarer, Inc., for a change of zoning from "AT" Apartment -
Tourist District with a Special Permit to "B-5" Primary Business District on Lot
1-A, Block 4, Seaside Subdivision, located on the northeast side of Ocean Drive
approximately 875't northwest of the intersection of Ocean Drive and Airline Road.
City Manager Townsend informed the Council that both the Planning Commission
and the Planning Staff recommended denial of the requested "B-5" zoning but in lieu
thereof that the revision of the special permit site plan be approved. He stated
that in response to the notices of the public hearing, 7 in opposition and none in
favor had,been returned. He then requested that Mr. Larry Wenger, Chief Planner,
summarize the case.
Chief Planner Wenger displayed,a plan showing the'revisions the applicant
wanted to make including the installation of a canopy and asquare lobby instead
of the round one included in their original site plan. Mr. Wenger stated that the
revision also included two less parking spaces than the original `site plan.
Mayor Pro Tem Sample ascertained that no one in.the audience wished to speak
in regard to this application.
Motion by Best that the hearing be closed, seconded by Dumphy and passed
unanimously.
Motion by Best that the Council concur with the recommendation of the
Planning Commission and deny the request for "B-5" zoning but in lieu thereof,

approve the revision of the special permit site plan; seconded by Luna; and passed
by the following vote: Sample, Best, Dumphy, Luna and Zarsky voting "Aye"; Jones,
absent; Turner disqualifying herself.

City Manager Townsend announced the public hearing on Application No. 1280-11,
Mr. Jim Teague, for a change of zoning from "6-1" Neighborhood Business District to
"AT" Apartment -Tourist District on Lots 1 and 3, Block 81, Brooklyn Addition, located
on the northwest corner of Seagull Boulevard and Churchdale Avenue.
Mr. Townsend noted that both the Planning Commission and the Planning Staff
recommend approval and that in response to the notices of the public hearing, one
in favor and none in opposition had been returned.
Mayor Pro Tem Sample ascertained that no one in the audience desired to
speak in regard to this case.
Motion by Zarsky that the hearing be closed, seconded by Dumphy and passed
Unanimously.
Motion by Best that the Council concur with the recommendation of the Plan-
ning Commission and approve the zoning of "AT" for Application No. 1280-11; seconded
by Zarsky; and passed unanimously.

City Manager Townsend announced the public hearing on Application No. 1280-12,
Mr. Jack Kelso, for a change of zoning from "A-2" Apartment House District to "B-5"
Primary Business District on Lot 8, Block 47, Bluff Portion, located on the southwest
corner of Artesian and Comanche Streets.
City Manager Townsend stated that the Planning Commission recommends approval
and the Planning Staff recommends denial and in lieu thereof approval of "B-4" zoning.
He stated that in response to the notices of the public hearing, one in favor and
none in opposition had been returned.
No one spoke in regard to this application.
Motion by Best that the hearing be closed, seconded by Zarsky and passed
unanimously.
Motion by Zarsky that the Council concur with the Planning Commission's
recommendation and approve the zoning of "B-5" on Application No. 1280-12; seconded

by Dumphy; and passed unanimously.
Motion by Best that Mayor Luther Jones be excused from the meeting due to
just cause, seconded by Zarsky and passed unanimously.

City Secretary Read informed the Council that the ordinances effecting the
zoning changes approved during the foregoing public hearings were not before him and
suggested that they be adopted during the Regular Council Meeting at the time the
other ordinances are presented. The Council indicated their concurrence.
There being no further business to come before the Council, on motion by
Best, seconded by Luna and passed unanimously, the Special Council Meeting was
adjourned at 3:46 p.m., January 28, 1981.
