PRESENT: Mayor Luther Jones Mayor Pro Tem Edward L. Sample Council Members: Dr. Jack Best Jack K. Dumphy Leopoldo Luna Betty N. Turner Cliff Zarsky Deputy City Manager Ernest Briones Asst. City Attorney Jay Doegey City Secretary Bill G. Read Mayor Luther Jones called the meeting to order in the Council Chamber of City Hall and stated that the purpose of the Special Council Meeting was to conduct public hearings on two zoning applications. City Secretary Bill G. Read verified that a necessary quorum of the Council and the required Charter Officers were present to conduct a legally constituted meeting. Deputy City Manager Ernest Briones announced the public hearing on Applica- tion No. 181-1, Mmes. Helen Bluntzer and Nancy B. Gandy, for a change of zoning from "A-2" Apartment House District to "B-6" Primary Business Core District on Lots 7, 8 and 9, Block 16, Bluff Portion, located on the southeast corner of Carrizo and Lipan Streets. Mr. Briones stated that both the Planning Commission and the Planning Staff recommend denial of the .'B-6" zoning but in lieu thereof that "B-5" zoning be approved. He informed the Council that in response to the notices of the public hearing, one in favor and none in opposition were returned. Council Member Best inquired if the applicant would be willing to accept "B-5" zoning. Mr. Francis Gandy, representative of the applicants, explained that they had requested "B-6" zoning because of the parking regulations but they would be willing to accept "B-5" zoning. No one spoke in opposition to this application. Motion by Turner that the hearing be closed, seconded by Luna and passed unanimously. Deputy City Manager Briones announced the public hearing on Application No. 281-6, Maverick Market, Inc., for a change of zoning from "R -l6" One -family Dwelling District to "B-1" Neighborhood Business District on Lot 16, Block D. Austin Addition No. 2, and a 0.456 acre area out of Vineyard or Stockdale Tract, also shown as a reserved area on the Austin Addition No. 2, platted and filed for record March 14, 1945, Nueces County Records, located between Airport Road and Vera Cruz Street, at the intersection of Airport Road and Morgan Avenue. Mr. Briones informed the Council that the Planning Commission recommends denial of "B -l" zoning but in lieu thereof that a special permit be approved accord- ing to the site plan submitted. He stated that in response to the notices of the public hearing, two in favor and none in opposition had been returned. Chief Planner Larry Wenger reminded the Council that the special permit was approved for this tract of land some time ago; the time limit on the special permit has expired; and they have reapplied for the same zoning. No one spoke in regard to this zoning application. Motion by Sample that the hearing be closed, seconded by Luna and passed unanimously. Motion by Turner that the requested zoning of "B-1" be denied but in lieu thereof that a special permit in accordance with the approved site plan be granted on Application No. 281-6; seconded by Dumphy; and passed unanimously. .. * * * is * * * * t. * * * * * * ,t t, * t. * is * * h * * * * * * * * Deputy City Manager Briones presented the ordinances effecting the foregoing zoning changes. City Secretary Read polled the Council for their votes, and the following ordinances were passed: ORDINANCE NO. 16022: AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF HELEN BLUNTZER AND NANCY B. GANDY BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON LOTS 7, 8, 9, BLOCK 16, BLUFF PORTION, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "A-2" APARTMENT HOUSE DISTRICT TO "B-5" PRIMARY BUSINESS DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. s Minutes Special Council Meeting Febtuary 4, 1981 Page 3 The Charter Rule was suspended and the foregoing ordinance was passed by the follow- ing vote: Jones, Sample, Best, Dumphy, Luna, Turner and Zarsky voting "Aye." ORDINANCE NO. 16023: AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED, UPON APPLICATION OF MAVERICK MARKET, INC., BY GRANTING A SPECIAL COUNCIL PERMIT FOR A CONVENIENCE STORE ON LOT 16, BLOCK D, AUSTIN ADDITION NO. 2, AND 0.456 -ACRE AREA OUT OF VINEYARD OR STOCKDALE TRACT, AS SHOWN AS A RESERVED AREA ON THE AUSTIN,ADDITION NO. 2, PLATTED AND FILED FOR RECORD MARCH 14, 1945, NUECES COUNTY MAP RECORDS, SITUATED IN THE CITY OF CORPUS, NUECES COUNTY MAP'RECORDS; SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, ,TEXAS, AS MORE PARTICULARLY DESCRIBED' ON THE SITE PLAN, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A", AND SUBJECT TO THE CONDITIONS SET FORTH HEREINAFTER; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY.
