SPECIAL COUNCIL MEETING
MARCH 4, 1981

Mayor Luther Jones called the meeting to order in the Council Chamber of
City Hall and stated that the purpose of the meeting was to conduct public hearings
on three Text Amendments to the Zoning Ordinance and one zoning application.
City Secretary Bill G. Read verified that the necessary quorum of the
Council and the required Charter Officers were present to conduct a legally con-
stituted meeting.
City Manager Marvin Townsend announced the public hearing on Application
No. C281 -1T Area No. 1, Text Amendment to the Zoning Ordinance: Amend Article 31,
Newly Annexed Territory, by amending Section 31-5 by adding thereto one new sub-
section to be numbered 31-5.27 setting forth a zoning classification of "1-3"
Heavy Industrial District on a described tract of land when annexed to the City
of Corpus Christi, Texas, said tract being approximately 15.52 square miles within
Nueces County, Texas, outside the City limits of the City of Corpus Christi, gener-
ally north of IH -37, west of Corpus Christi Beach, south of the Nueces Bay and the
Nueces River, and east of the Allison Treatment Plant.
Mr. Townsend stated that both the Planning Commission and the Planning
Staff recommend approval. He explained that this is to prezone this area to "1-3"
when it is annexed to the City.
Mayor Jones commented that this is to reserve this land for industrial use.
City Manager Townsend further explained that if someone wants water or
sewer service to that land, he must agree to annex and the land will be zoned "1-3."
Mayor Jones called for comments from the audience.
Mr. Sonny Ewing addressed the Council and stated that he is a resident of
Castle River Subdivision and requested that the property from Carbon Plant Road to
the sewer plant be excluded from this request. He pointed out that that this is a

residential subdivision and the residents feel that this land would act as a buffer
between their property and the "1-3" zoned property.
City Manager Townsend informed the Council that the City has about 180 acres
at the sewer plant site, and there are probably no odor problems emanating from the
sewer to the subdivision.
Motion by Best that this tract of land owned by the McKinzie family, located
between Carbon Plant Road and the Allison Wastewater Treatment Plant, be excluded
from the area of request; seconded by Zarsky; and passed unanimously.
Motion by Best that the hearing be closed, seconded by Turner and passed
unanimously.
Motion by Best that the Text Amendment pertaining to Application No. C281 -IT
Area No. 1 be approved, with the exception of the land west of Carbon Plant Road;
seconded by Dumphy; and passed unanimously.

City Manager Townsend announced the public hearing on Application No. C281 -1T
Area No. 2, Text Amendment to the Zoning Ordinance: Amend Article 31, Newly Annexed
Territory, by amending Section 31-5 by adding thereto one new subsection to be
numbered 31-5.28 setting forth a zoning classification of "1-3" Heavy Industrial
District on a described tract of land when annexed to the City of Corpus Christi,
Texas, said tract being approximately 6.65 square miles within Nueces County, Texas,
outside the city limits of the City of Corpus Christi, generally north of Highway 44,
south of Swetlick Road and south of the north boundary of CCPC, west of the present
City limits and east of Callicoatte Road.
Mr. Townsend stated that both the Planning Commission and the Planning
Staff recommend approval.
No one spoke in regard to this application.
Motion by Sample that the hearing be closed, seconded by Luna and passed
unanimously.
Motion by Turner that the Council concur with the recommendation of the
Planning Commission and approve this text amendment to the zoning ordinance,
seconded by Luna and passed unanimously.

C -281-5T, Text Amendment to the Zoning Ordinance: Amend Article 31, Newly Annexed

Territory, by amending Section 31-5 by adding thereto one new subsection to be
numbered 31-5.29 setting forth a zoning classification of "R-2" Multiple Dwelling
District on Tracts A and B for described tracts of land when annexed to the City
of Corpus Christi, Texas, located north of the extension of Cedar Pass Drive
(County Road 26) and west of Everhart Road.
City Manager Townsend explained that both the Planning Commission and
the Planning Staff recommend approval; this is an area in the process of being
developed; and all parties concerned have been notified of this recommended zoninj
change.
Chief Planner Wenger further explained that the area was divided into two
parts -- one to be zoned "R-2" and the other to be zoned "B-4", but at the Plan-
ning Commission meeting, a great deal of opposition was expressed and the recom-
mended Text Amendment was changed to "R-2" for both tracts. Mr. Wenger stated
that virtually all of the tracts are farmland at this time and showed slides of
the area which is adjacent to Club Estates Subdivision.
No one spoke in regard to this application.
Motion by Turner that the hearing be closed, seconded by Best and passed
unanimously.
Motion by Turner that the Text Amendment be approved to prezone both Tracts
A and B "R-2"; seconded by Best; and passed unanimously.

City Manager Townsend announced the public hearing on Application No.
281-4, Mr. A. C. Whitlock, for a change of zoning from "R-1" One -family Dwelling
District to "1-2" Light Industrial District on property consisting of 3.20 acres
of land out of that certain 11.00 acre tract out of the Thos. Gallagher 400 -acre
Survey No. 402, Abstract 988, approximately 850' east of Clarkwood Road and approx-
imately 3,650'± south of U. S. Highway 44 (Agnes Street), being 3.20± acres of
property:
Mr. Townsend stated that both the Planning Commission and the Planning
Staff recommend approval and there was no response to the notices of the public
hearing.

Motion by Best that the hearing be closed, seconded by Turner and passed
unanimously.
Motion by Best that the zoning of "1-2" be granted for Application No.
281-4; seconded by Luna; and passed unanimously.

City Secretary Read informed the Council that the ordinances effecting the
zoning changes were not in the Council Chamber and suggested that they be voted on

during the Regular Council Meeting.
Motion by Turner that the meeting be adJourned, seconded by Best, and
passed unanimously.
