SPECIAL COUNCIL MEETING
MARCH 11, 1981

Mayor Luther Jones called the meeting to order in the Council Chamber of
City Hall and stated that the purpose of the meeting was to conduct public hearings
on four zoning cases.
City Secretary Bill G. Read verified that the necessary quorum of the
Council and the required Charter Officers were present to conduct a legally con-
stituted meeting.
City Manager Marvin Townsend announced the public hearing on Application
No. 281-8, Padre Staples Mall, for a change of zoning from "R -1B" One -family Dwell-
ing District to "B-4" General Business District, located on both sides of Lenora
Drive, between Mount Vernon Drive and McArdle Road, Lots 1, 2, 6 and 9, Block 9,
and Lots 5, 7 and 8, Block 10, Mount Vernon No. 3.
Mr. Townsend informed the Council that both the Planning Commission and
the Planning Staff recommend approval and that in response to the notices of the
public hearing, one in favor and none in opposition had been returned.
Chief Planner Larry Wenger located the area on the zoning and land use
map, described the land use in the surrounding area, showed slides of the area and
stated that this change of zoning is for the ultimate expansion of Padre Staples
Mall.
City Manager Townsend pointed out that the staff recommendation for appro-
val is that this requested zoning should be contingent upon the closing of Janet
Street and replatting of the property, matters which were tabled some time ago for
six months.
Mayor Jones ascertained that no one desired to speak in regard to this
request.

Motion by Sample that the hearing be closed, seconded by Luna and passed
unanimously.
Motion by Sample that the Council concur with the recommendation'of the
Planning Commission and approve the zoning of "B-4" for Application No. 281-8;
seconded by Luna; and passed by the following vote: Jones, Sample, Best, Dumphy,
Luna and Zarsky voting "Aye"; Turner absent at the time the vote was taken.
City Manager Townsend asked for clarification and inquired if the Council
preferred to have the ordinances closing Janet Street and granting the requested
zoning considered at the same time after the property along Janet Street has been
replatted and the street has been closed. The Council indicated their concurrence
with this suggestion.
Mr. Roy Smith, one of the owners of Padre Staples Mall, addressed the
Council and explained that they had requested the closing of Janet Street and
other zoning was approved subject to replatting, which they planned to do. He
stated that they did not include the back lots on Lenora Street in their original
zoning application because they did not own the lots at that time. He reminded
the Council that the residents on that street had their property rezoned to "8-4"
in anticipation of the Mall owners purchasing the lots.
Council Member Turner inquired of Mr. Smith if he intended to expand the
Mall right up to Lenora, and Mr. Smith replied that those were their plans.
Mr. Ernan Valderama, 5138 Mt. Vernon Drive, stated that he lives on the
west side of Lenora Drive and questioned what their situation would be if Mr.
Smith does not intend to do anything with the west side of Lenora.
City Manager Townsend explained that since these properties have been
zoned for business, there will be no protection for the houses on the other side
of Lenora. He reminded Mr. Valderama that the Staff had attempted to point out to
the property owners at the time they requested the "B-4" zoning for their property
the possible consequences if the owners of Padre Staples Mall did not purchase that
property.
Council Member Best also pointed out to the property owners present that
they had been warned by the Council and the Staff that those residents would have
the mall expanded to the east side of Lenora Drive and the residents on the west
side will be exposed to the detrimental effect of having a large shopping mall

directly across the street from their homes.
Mr. Hans, representative of the Mall owners, stated that it was their
intention to install a fence on the east of Lenora Drive.
City Manager Townsend stated that the Mall owners must prepare a plan for
the treatment of Lenora Drive, and the staff will not approve a concrete fence.
He also pointed out that the applicant needs to show the traffic circulation plan,
how access to the Mall will be handled, and the other problems must be worked out,
before these ordinances granting zoning and closing Janet Street are approved.
Mayor Jones agreed with the City Manager that the Council should not pass
the ordinance changing the zoning as requested during this hearing until the
replat of the property has been submitted and all of the problems worked out.
Mr. Hans stated that Mr. Urban of Urban Engineering informed him that he
could review the plans the following day but assured the Council that they would
not use Lenora Drive for the movement of traffic.
Mr. Smith spoke again and stated that he did not think the City would
allow him to expand the Mall right up to Lenora Drive but expressed the opinion
that the concrete wall would be beneficial in keeping children out of the Mall
and preventing trash from blowing into the residents' yards.
Mayor Jones explained to Mr. Smith that final action on the ordinance
approving the change of zoning will occur when the problems have been resolved
and a replat has been submitted.

City Manager Townsend announced the public hearing on Application No.
281-9, Mr. Jesus A. Lelia, for a change of zoning from "A-1" Apartment House
District to "AB" Professional Office District, located on the southwest corner
of Coleman Street and South Tancahua Street, Lot 2, Block 3, Hampton Addition.
City Manager Townsend noted that both the Planning Commission and the
Planning Staff recommend approval and that in response to the notices of the
public hearing, three in favor and one in opposition had been returned.
Chief Planner Wenger briefly summarized the case and pointed out the
location on the zoning and land use map. He stated that the purpose of the
application was to have the land conform to its current use for offices.

No one spoke in regard to this application.
Motion by Luna that the hearing be closed, seconded by Best and passed
unanimously.
Motion by Luna that the Council concur with the recommendation of the
Planning Commission and grant the zoning of "AB" for Application No. 281-9;
seconded by Best; and passed unanimously.

City Manager Townsend announced the public hearing on Application No.
281-10, Corpus Christi Tortilla Factory, Inc., for a change of zoning from "B-4"
General Business District and "R -1B" One -family Dwelling District with a Special
Permit on three of the lots to "I-2" Light Industrial District, located on the
southwest corner of San Jacinto Drive and South Port Avenue, Lots 1, 2, 3 and 4,
Block 6, High Terrace Subdivision.
Mr. Townsend stated that both the Planning Commission and the Planning
Staff recommend denial but in lieu thereof that a special permit be approved and
that the site plan presented be approved subject to changes being made to indicate
the 10' setback lines and screening fence along the two property lines adjacent to
the single-family residences. He informed the Council that in response to the
notices of the public hearing, two in opposition and none in favor had been returned.
City Manager Townsend informed the Council that the site plan has been
provided with the stipulations required and it is recommended that it be approved.
*Mayor Jones departed the meeting at 4:55 p.m. and requested that Mayor Pro
Tem Sample preside.
Chief Planner Wenger located the area on the zoning and land use map, des-
cribed the land use in the surrounding area, showed slides of the area and stated
that the owner plans to construct a storage building garage with a one -family
dwelling on the second floor. He then presented to the Council the approved site
plan.
City Manager Townsend noted that there is no permit required to put
asphalt on the ground, but the existing parking lot is not in compliance with the
zoning ordinance.
No one addressed the Council in regard to this zoning application.

Motion by Best that the hearing be closed, seconded by Luna and passed
unanimously.
Motion by Luna that the requested zoning be denied on Application No. 281-10
but in lieu thereof that a special permit in accordance with the approved site plan
be granted; seconded by Zarsky; and passed by the following vote: Sample, Best,
Dumphy, Luna, Turner and Zarsky voting "Aye"; Jones, absent at the time the vote
was taken.

City Manager Townsend announced the public hearing on Application No.
281-12, Weber Land Company, for a change of zoning from "B-3"Business District to
"B-4" General Business District located on the southeast corner of Weber Road and
Oak Bay Drive, Lot 43, Block 1, Country Club Estates Unit 31.
City Manager Townsend pointed out that the Planning Commission recommends
approval and the Planning Staff recommends dental because "B-4" zoning would
establish a business strip along Weber Road. He informed the Council that in
response to the notices of the public hearing, three in opposition and two in
favor had been returned.
Council Member Turner inquired about the possible change in density if
this zoning is approved, and Chief Planner Wenger replied that the requested
zoning would allow 36 units per acre.
No one spoke in regard to this application.

unanimously.
Council Member Best commented that this land was associated with the
AICUZ Study and asked about the effect of that study on this land.
Mr. Wenger explained that the AICUZ Study has changed the noise factor;
"B-4" zoning allows residential development which is not recommended in this area;
and "B-3" zoning can accommodate any type of business allowed in "B-4" but excludes
residential use.
Council Member Turner noted that the staff recommended denial because they
did not feel that a business strip should be located along Weber Road.

Motion by Turner that the Council concur with the recommendation of the
Planning Commission and grant the zoning of "B-4" for Application No. 281-12;
seconded by Best; and passed unanimously.

Clty Secretary Read Informed the Council that the ordinances effecting
the changes of zoning approved during the public hearings were not available at
this time and suggested that they be considered during the Regular Meeting at the
time the other ordinances are voted on.
There being no further business to come before the Council, on motion by
Best, seconded by Turner and passed unanimously, the Special Council Meeting was
adjourned at 5:08 p.m., March 11, 1981.
