SPECIAL COUNCIL MEETING
MAY 27, 1981
4:40 P.M.

Mayor Luther Jones called the meeting to order in the Council Chamber of
City Hall and stated that the purpose of the meeting was to conduct public hear-
ings on three zoning applications.
City Secretary Bill G. Read verified that the necessary quorum of the
Council and the required Charter Officers were present to conduct a legally con-
stituted meeting.
City Manager Marvin Townsend announced the public hearing on Application
No. 481-8, Scott Electric Company, for a change of zoning from "R -1B" One -family
Dwelling District to "1-2" Light Industrial District on Lot 9, Block 7, and Lot 4,
Block 8, Shoreline Park Addition, located on both sides of John Street approximately
100' west of N: Port Avenue.
Mr. Townsend noted that the Planning Commission recommends approval and the
Planning Staff recommends denial of "I-2" and in lieu thereof that a special permit
with a standard screening fence to the north, south and west property lines be con-
structed. He also stated that in response to the notices of the public hearing,
three in favor and one in opposition had been returned. The City Manager then
asked Mr. Larry Wenger, Chief Planner, to summarize the case.
Chief Planner Wenger located the area on the zoning and land use map, des-
cribed the land use in the surrounding area, showed slides of the area and stated
that the applicant plans to build a metal storage building.
Mayor Jones called on the applicant to speak at this time.
Mr. Benny Diegel, second Vice President of Scott Electric Company, stated
that theyneed the additional enclosed storage space to prevent vandalism which is
prevalent in the area. He urged approval of the "1-2" zoning.
Mayor Jones inquired of Mr. Diegel if his company would accept a special
permit allowing such use as recommended by the Planning Staff, and Mr. Diegel

indicated that this would be acceptable.
Also urging approval of either the requested zoning or a special permit was
Mr. Raymond Rabalais, Treasurer of the company.
No one spoke in opposition to this zoning request.
Motion by Turner that the hearing be closed, seconded by Zarsky and passed
unanimously.
Motion by Turner that the zoning of "1-2" be denied but in lieu thereof that
a special permit be granted in accordance with the recommendation of the Planning
Staff for Application No. 481-8; seconded by Gulley; and passed unanimously.

City Manager Townsend announced the public hearing on Application No. 481-10,
Maria de la Luz Izquierdo, M.D., for a change of zoning from "AB" Professional
Office District to "B-1" Neighborhood Business District on Lot 10, Block 1, Koolside
Addition, located on the west side of Airline Road approximately 650' north of
McArdle Road.
City Manager Townsend informed the Council that the Planning Commission
recommends denial and the Planning Staff recommends denial of the "B-1" zoning but
in lieu thereof that a special permit be granted. He stated that in response to
the notices of the public hearing, two in opposition and none in favor had been
returned.
Chief Planner Wenger located the area on the zoning and land use map, des-
cribed the land use in the surrounding area, showed slides of the area, and stated
that the applicant plans to establish a retail outlet of imported clothing and foods.
Mr. Wenger also pointed out that there are a number of special permits for similar
uses in this area already.
Mayor Pro Tem Turner, presiding in the temporary absence of Mayor Jones,
invited those who wished to speak in regard to this application.
Mr. Allen Carson, 5034 Bromley, expressed opposition to the "B-1" zoning
and concern about the special permit because he was not sure what the owner plans
to use the property for, indicating that he felt that there might not be enough
parking space available at this location.
Mr. Wenger assured him that the special permit would not be issued until
an appropriate site plan showing the required parking spaces had been submitted.

No one else spoke in regard to this application.
Motion by Gulley that the hearing be closed, seconded by Zarsky and passed
unanimously.
Motion by Gulley that the Council concur with the recommendation of the
Planning Staff and deny the zoning of "6-1" but in lieu thereof grant a special
permit subject to the submission of an appropriate site plan; seconded by Zarsky;
and passed unanimously.

City Manager Townsend announced the public hearing on Application No. 481-12,
Mr. Joe Adame, for a change of zoning from "FR" Farm -Rural District to "R -1B" One -
family Dwelling District on Lots 9 and 10, Section 41, Flour Bluff and Encinal Farm
and Garden Tracts, located on the north side of Graham Road in the vicinity of
Wittner Place.
Mr. Townsend stated that the Planning Commission recommends denial but in
lieu thereof that "R -E" Residential Estate District be approved and the Planning
Staff recommends approval of the "R -1B" but agrees that "R -E" zoning would be appro-
priate.
Chief Planner Wenger briefly summarized the case and showed slides of the
area, stating that the applicant plans to build a new home on the property.
City Manager Townsend explained a substantial water line problem that had
existed on this property but stated that he hoped that this problem had been
resolved.
No one spoke in regard to this application.
Motion by Zarsky that the hearing be closed, seconded by Hawkins and passed
unanimously.
Motion by Zarsky that the Council concur with the recommendation of the
Planning Commission and deny the requested zoning of "R -1B" but in lieu thereof
approve the zoning of "R -E"; seconded by Turner; and passed unanimously.
City Manager Townsend presented for the Council's consideration the
ordinance granting the "R -E" zoning on the Adame application; City Secretary Read
polled the Council for their votes; and the following ordinance was passed:

AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY
OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE
AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY
ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF JOE ADAME BY AMENDING THE ZONING
MAP BY CHANGING THE ZONING ON A 4.81± ACRE TRACT OF LAND OUT OF LOTS 9 AND 10, SEC-
TION 41, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS, SITUATED IN THE CITY OF
CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "FR" FARM -RURAL DISTRICT TO "R -E" RESI-
DENTIAL ESTATE DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING
ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING
AN EMERGENCY.
The Charter Rule was suspended and the foregoing ordinance was approved by the fol-
lowing vote: Jones, Turner, Dumphy, Gulley, Hawkins, Kennedy and Zarsky voting "Aye."

There being no further business to come before the Council, on motion by
Turner, seconded by Kennedy and passed unanimously, the Special Council Meeting was
adjourned at 5:01 p.m., May 27, 1981.
