Turner Council Members: Jack K. Dumphy Bob Gulley Herbert Hawkins, Jr. Dr. Charles W. Kennedy, Jr. Cliff Zarsky City Manager Marvin Townsend City Attorney J. Bruce. Aycock City Secretary Bill G. Read Mayor Luther Jones called the meeting to order in the Council Chamber of City Hall and stated that the purpose of the meeting was to conduct public hear- ings on zoning applications. City Secretary Bill G. Read verified that the necessary quorum of Charter Officers was present to conduct a legally constituted meeting. City Manager Marvin Townsend announced the consideration of a Text Amendment to the Zoning Ordinance: Amend Article 30, Changes and Amendments, by adding a new subsection 30-7 to provide that an application for any rezoning on all or any part of a previous application that has received final City Council action shall not be accepted within a six-month period from the date of such Council action'. However, an application for rezoning may be initiated by the City Council, Planning Commission, City Manager or Director of Planning without regard to this amendment. City Manager Townsend noted that the City Council had made this recommenda- tion during a recent public hearing on a zoning application. Chief Planner Larry Wenger informed the Council that the Planning Commis- sion had some concerns about this because of the possibility that the ownership of the property could change and the new owner might be penalized in that he could not request some other change of zoning; therefore, the Commission has recommended' against this change. Council Member Gulley inquired about the length of the planning process, and Mr. Wenger replied that it requires about 45 days. Mr. Wenger pointed out that applicants can continually violate the zoning ordinance by constantly sub- mitting applications for change of zoning, because as long as a property owner J4 QEILMED ? Discussion followed among the Council Members. No one from the audience spoke in regard to this proposed text amendment. Motion by Gulley that the hearing be closed, seconded by Turner and passed unanimously. City Manager Townsend announced the public hearing on Application No. 681-4, Lantana Corporation, for a change of zoning from "I-2" Light Industrial District and "B-4" General Business District on Tract A, to "1-3" Heavy Indus- trial District and "B-4" General Business District and "A-2" Apartment House District on Tract B, to "1-2" Light Industrial District, Tract A being 15± acres out of Lot 1, and Tract B being 16.47± acres out of Lots 1 and 2, both tracts out of Block 4, J. C. Russell Farm Blocks, located approximately 750' north of Bear Lane between N. Padre Island Drive and Flato Road. City Manager Townsend informed the Council that the Planning Commission and the Planning Staff recommend approval of zoning in accordance with the plan submitted by the applicant, as follows: "1-2" zoning on the first 150' to the east of N. Padre Island Drive, "1-3" zoning on the adjoining 900'; "1-2" zoning on the following 1050'; and "A-2" zoning on the 300' west of Flato Road. He stated that there was no response to the notices of the public hearing. Chief Planner Wenger located the area on the zoning and land use map, described the land use in the surrounding area, showed slides of the area, and stated that the applicant plans to install engine testing and manufacturing facilities on this land, and the site plan was revised after the initial hearing before the Planning Commission. No one spoke in regard to this zoning application. Motion by Turner that the hearing be closed, seconded by Dumphy and passed unanimously. Motion by Dumphy that the zoning in accordance with the site plan, as recommended by the Planning Commission, be approved on Application No. 681-4; Minutes Special Council Meeting July 29, 1981 Page 3 seconded by Turner; and passed unanimously. City Secretary Read presented the ordinance effecting the zoning change for the Lantana Corporation application, and it passed as follows: ORDINANCE NO. 16437: AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE 6106, AS AMENDED, UPON APPLICATION OF LANTANA CORPORATION, BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON TRACT A AND TRACT B OF BLOCK 4, J. C. RUSSELL FARM BLOCKS, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "I-2" LIGHT INDUSTRIAL DISTRICT AND "B-4" GENERAL BUSINESS DISTRICT ON TRACT A; AND "B-4" GENERAL BUSINESS DISTRICT AND "A-2" APARTMENT HOUSE DISTRICT ON TRACT B TO "1-3" HEAVY INDUSTRIAL DISTRICT ON TRACT A AND "1-2" LIGHT INDUSTRIAL DISTRICT ON TRACT B; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. The Charter Rule was suspended and the foregoing ordinance was passed by the following vote: Jones, Turner, Dumphy, Gulley, Hawkins, Kennedy and Zarsky voting "Aye".
