PRESENT: Mayor Luther Jones Mayor Pro Tem Betty N. Turner Council Members: Jack K. Dumphy Bob Gulley Herbert L. Read Mayor Luther Jones called the meeting to order in the Council Chamber of City Hall and stated that the purpose of the meeting was to conduct public hearings on four zoning applications. City Secretary Bill G. Read verified that a quorum of the Council and the necessary Charter Officers were present to conduct a legally constituted meeting. City Manager Marvin Townsend announced the public hearing on Application 781-1, Mr. Sin Il Choi, for a change of zoning from "AB" Professional Office District to "B-1" Neighborhood Business District on Lot 8, Block 2, Gray Village #2, located on the west side of Everhart Road approximately 125' north of Mt. Vernon Drive. City Manager Townsend stated that the Planning Commission recommends denial and in lieu thereof that a special permit be approved for a health spa subject to a suitable site plan and the planning staff recommends denial, but would have no strong objections to a special permit. He stated that in response to the notices of the public hearing, one in favor and one in opposition had been returned. Mr. Gary Dumas, City Planner, located the area on the zoning and land use map, described the land use in the surrounding area, showed slides of the area and stated that the owner plans to add an addition to his existing building for a health spa. Mr. Dumas informed the Council that the owner concurs with the recommendation for the special permit. Motion by Turner that the hearing be closed; seconded by Kennedy and passed unanimously. Motion by Turner that the Council concur with the recommendation of the Planning Commission and deny the zoning of "B-1" and in lieu thereof approve a special permit subject to an approved site plan; seconded by Dumphy and passed unanimously. * * * * * * * * * * * * * * City Manager Townsend announced the public hearing on Application #781-2, Sitterle & Company, for a change of zoning from "R -1B" One - family Dwelling District and "A-1" Apartment House District to "I-2" Light Industrial District on a 9.12+ acre tract of land out of Lots 8 and 9, Section 5, Range VITT, Gugenheim and Cohn's Farm Lots, located on the south side of Old Brownsville Road, approximately 500' east of South Padre Island Drive. City Manager Townsend stated that both the Planning Commission and planning staff recommend approval. He also stated that there had been no response to the notice of the public hearing. No one appeared in regard to this zoning application. Motion by Dumphy that the hearing be closed; seconded by Turner; and passed unanimously. Motion by Dumphy that the Council concur with the recommendation of the Planning Commision and the planning staff and approve the zoning of "I-2" for Application #781-2; seconded by Turner; and passed unanimously. * * * * * * * * * * * * * * City Manager Townsend announced the public hearing on Application #781-3, Mr. A. Ybarra, for a change of zoning from "R -1B" One -family Dwelling District to "AB" Professional Office District on a 0.902+ acre tract of land out of Lot 1, Block 2, Minutes Special Council Meeting August 12, 1981 Page 3 Southland Estates, located on the east side of Richter Street approximately 562' south of Sokol Drive. City Manager Townsend informed the Council that both the Planning Commission and planning staff recommend denial and that there was no response to the notices of the public hearing. City Planner Dumas located the area on the zoning and land use map, described the land use in the surrounding area, showed slides of the area and stated that the request had been made to conform with the existing zoning of property on the west side of this tract. He stated that the owner plans to construct an office building at this location. Mr. Robert Ramey, representing the applicant, displayed the office building planned for the area for an alarm system for clients. He stated that there will not be any merchandise or parts stored there, but there will be utility vans for maintenance parked at this location. City Manager Townsend pointed out that such use would require "B-1" zoning not "AB" zoning. Mr. Ramey pointed out that this tract of land is located near the City's service center, and even though most of the area is zoned "R -1B", the planned use would benefit the residential property in the area. Mayor Jones questioned the location of this building in the middle of a single family dwelling area. No one else spoke in regard to this zoning application. Motion by Hawkins that the hearing be closed; seconded by Turner and passed unanimously. Motion by Hawkins that Application #781-3 be denied; seconded by Gulley and passed unanimously. * * * * * * * * * * * * * * Ire/ Minutes Special Ceuncil Meeting August 12, 1981 Page 4 City Manager Townsend announced the public hearing on Application #781-6, Messrs. John and Jack Tucker, for a change of zoning from "F -R" Farm -Rural District on Tract A and Tract B to "B-4" General Business District on Tract A and "A-2" Apartment House District on Tract B, Tract A being an 8.06+ acre tract of land and Tract B being a 28.43+ acre tract of land, both tracts out of Lot 15 and 16, Section 27, Flour Bluff and Encinal Farm and Garden Tracts, located at the northeast corner of Wooldridge Road and Rodd Field Road. City Manager Townsend informed the Council that the Planning Commission recommends denial and the planning staff recommends denial but in lieu thereof that "R -1B" be approved with the exception of a small portion of the southwest corner of Tract A which is recommended to be changed to "A-1". He stated that in response the notices of the public hearing, four in favor and none in opposition had been returned. Mr. Dumas located the area on the zoning and land use map, described the land use in the surrounding area, showed slides of the area and stated that the owners plan general business on Tract A and "A-2" on Tract B. Speaking in favor of the application was Mr. Jack Tucker, one of the applicants. He stated that they feel they need higher density for the best land use of this area. He pointed out that there is a need for business and apartments in this area. City Manager Townsend explained the types of uses that are allowed in "B-4" zoning and pointed out that "A-2" allows for the highest density of apartments. Mayor Jones asked for the applicant's opinion of the staff's recommendation. Mr. Gene Urban, Urban Engineers, stated that there is one basic problem. He pointed out that Rodd Field Road will be a major Minutes Special Council Meeting August 12, 1981 Page 5 street and carry a great deal of traffic. He pointed out that every property owner around this tract is in favor of this zoning and he feels that it is appropriate to have this type of zoning before the area is developed for single family units. Mr. John Tucker stated that they would compromise on their request and accept "B--1" zoning on Tract A and "A-1" zoning on Tract B. Motion by Turner that the hearing be closed; seconded by Zarsky; and passed unanimously. Motion by Turner that on Application #781-6 that "B-1" zoning be approved on Tract A and "A-1" zoning be approved for the balance of the tract; seconded by Zarsky; and passed unanimously. * * * * * * * * * * * * * * City Manager Townsend presented for the Council's consideration ordinances on three of the foregoing zoning applications. City Secretary Read polled the Council for their vote and the following ordinances were passed: ORDINANCE #16469: AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF MR. SIN IL CHOI BY GRANTING A SPECIAL COUNCIL PERMIT FOR EXPANSION OF AN EXISTING HEALTH -SPA ON LOT 8, BLOCK 2, GREY VILLAGE NO. 2 SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS AS MORE PARTICULARLY DESCRIBED ON THE SITE PLAN, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A", AND SUBJECT TO THE CONDITIONS SET FORTH HEREIN- AFTER; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. The Charter Rule was suspended and the foregoing ordinance passed by the following vote: Jones, Turner, Dumphy, Gulley, Hawkins, Kennedy and Zarsky voting "Aye". Minutes Special Council Meeting August 12, 1981 Page 6 ORDINANCE #16470: AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27th DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, UPON APPLICATION SITTERLE AND COMPANY BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON A PORTION OF LOTS 8 AND 9, SECTION 5, RANGE VIII, GUGENHEIM AND COHN'S FARM LOTS, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "R -1B" ONE FAMILY DWELLING AND "A-1" APARTMENT HOUSE DISTRICT TO "I-2" LIGHT INDUSTRIAL DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. The Charter Rule was suspended and the foregoing ordinance was passed by the following vote: Jones, Turner, Dumphy, Gulley, Hawkins, Kennedy and Zarsky voting "Aye". ORDINANCE #16471: AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF JOHN & JACK TUCKER BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON PORTIONS OF TRACT A AND TRACT B OF LOTS 15 AND 16, SECTION 27, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS, SITUATED IN THE CITY OF COPRUS CHRISTI, NUECES COUNTY, TEXAS, FROM "R -R" FARM -RURAL DISTRICT TO "B-1" NEIGH- BORHOOD BUSINESS DISTRICT ON TRACT A AND"A-1" APARTMENT HOUSE DISTRICT ON TRACT B; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY.
