SPECIAL COUNCIL MEETING :
SEPTEMBER 9, 1981

Mayor Luther Jones called the meeting to order in the Council Chamber of
City Hall and stated that the purpose of the meeting was to conduct public
hearings on three zoning applications.
City Secretary Bill G. Read verified that the necessary quorum of the

Council and the required Charter Officers were present to' conduct a legally
constituted meeting.
City Manager Marvin Townsend announced the public hearing on
Applications No. 881-1, Mr. James H. Pusley, for a change of zoning from
"R -1B" One -family Dwelling District to "I-2" Light Industrial District on Tract
A, and "B-4" General Business District on Tract B and C on a portion of Lot 5
and all of Lot 6, Hutchins Tract, located on the east side of Rand Morgan
Road, approximately 600' south of Leopard Street.
City Manager Townsend informed the Council that both the Planning
Commission and Planning Staff recommend that "B-4" zoning be approved on
Tract B and C, but that "I-2" zoning on Tract A be denied, but in lieu thereof

a special permit be granted for the specified uses subject to a suitable site
plan. He stated that in response to the notices of the public hearing, three in

favor and one in opposition had been returned.
Chief Planner Larry Wenger located the area on the zoning and land use
map, described the land use in the surrounding area, showed slides of the area
and stated that the owner plans to develop light industrial uses and business
rental property on this land. He presented the approved site plan for the
special permit as recommended.

Mayor Jones ascertained that no one in the audience wished to speak on
this zoning application.
Motion by Turner that the hearing be closed, seconded by Hawkins, and
passed unanimously.
Motion by Turner that the Council concur with the recommendation of the
Planning Commission and grant the zoning of "B-4" on Tract B and C and deny
the zoning of "I-2" on tract A, but in lieu thereof approve a special permit in
accordance with the submitted site plan; seconded by Zarsky; and passed
unanimously.

City Manager Townsend announced the public hearing on Application No.
881-6, Messrs. Victor W. Vale and Homer J. Sanchez, for a change of zoning
from "R -1B" One -family Dwelling District to "B-4" General Business District on
Lot 25, Block 1, Washington Addition, located at the corner of Columbia Street
and Linda Vista Street.
City Manager Townsend stated that both the Planning Commission and
Planning Staff recommend denial and that in response to the notices of the
public hearing, one in opposition and none in favor had been returned.
Chief Planner Wenger located the area on the zoning and land use map,
described the land use in the surrounding area, showed slides of the area, and
stated that the owners plan to construct an auto part sales business at this
location.
Mayor Jones determined that no one in the audience, including the
applicant, desired to speak on this zoning case.
Motion by Turner that the hearing be closed, seconded by Zarsky and
passed unanimously.
Motion by Hawkins that this application be denied, seconded by Turner
and passed unanimously.

City Manager Townsend announced the public hearing on Application No.
C881-7, City of Corpus Christi, for a change of zoning from "A-2" Apartment
House District and "R-2" Multiple Dwelling District to "R -1B" One -family
Dwelling District on Lots 34 thru 66, Block 3, San Pedro Additon; all of Blocks
4 and 5, Lots 1 thru 31, Block 6, Seikel Addition; Lots 5 thru 8, Block 1, Lots

13 thru 24, Block 2, all of Blocks 3, 4, 5, 7, 8, 9 and 6 except Lots 31 and 32
(Zavala School Tract), Kosar Addition; and the east one-half of Block A
(Meadow Park Recreation Center) Meadow Park Addition, ,located south of Mary
Street, north of Highland Boulevard between Osage Street and Duncan, Dolores

City Manager Townsend informed the Council that the Planning Commission
recommends approval except for Lots 64,` 65 and 66,W,Block'5; : Seikel. Addition,

and the Planning Staff recommends approval: He "stated 'that in response to the
notices of the public hearing, a large number of notices had been returned
expressing opposition.
City Manager Townsend explained that this zoning application was initiated
by the City as a result of an assessment hearing that was conducted on May
21, 1981 at which time seventeen property owners indicated they wanted a
change of zoning in order to have their assessments reduced. He pointed out
that although there were a number of negative responses, it is not clear
whether the property owners are sure just how their property would be
affected by a change of zoning.
Chief Planner Wenger located the area on the zoning and land use map,
described the land use in the surrounding area and showed slides of the area.
City Manager Townsend displayed a map indicating the location of the
property whose owners object to the change of zoning and pointed out that only
seven of them are actually in the area proposed to be changed to "R -1B".
Motion by Turner that this application be tabled until the staff has had an
opportunity to contact the seven people indicating opposition who are inside the
area to be rezoned to ascertain whether or not they are aware of the
implications of the proposed change of zoning. The motion was seconded by
Hawkins and passed unanimously.

City Secretary Read stated that he had the ordinance pertaining to the .
James H. Pusley change of zoning before him. He called for the vote on the
ordinance and it passed unanimously.

Turner, seconded by Gulley, and passed unanimously, the Special Council
Meeting was adjourned at 4:55 p.m., September 9, 1981.
