MEETING SI.PTEMBER 17, 1981 3+;00 BI OCK OF APOLLO ROAD 7:00 p.m. PRESENT: Mayor Luther Jones Mayor Pro Tem Betty Turner COUNCIL MEMBERS: Bob Gulley Cliff Zarsky City Manager Marvin Townsend • Assistant City Attorney Jay Dogey • City Secretary Bill G. Read ABSENT: Jack K. Dumphy Herbert Hawkins, Jr. Dr. Charles W. Kennedy The meeting was called to order in the 3600 block of Appllo Road by Mayor . Luther Jones. City Secretary Bill G. Read • verified that the necessary quorum' of the Council and the required Charter Officers were present to Conduct a legally constituted meeting. Mayor Jones introduced Jay Dogey who explained the state statutes, after which the Mayor introduced Marvin Townsend who in turn introduced Chief Planner Larry Wenger. Mr. Wenger pointed out on the map the areas being considered for annexation. Upon completion of the explanation the Mayor asked the City Manager to explain what services were available on the area under consideration for annexation. • City Manager Townsend explained that all city services were available and that the city would install street lights within a reasonable period of time, in the event the present street lighting was not adequate, the street lighting that now exists would be taken over immediately by the City. Police and fire protection will be extended immediately. The Mayor asked how many in the audience would like to address the Council and two people in the audience indicated that they would like to. The first speaker was a Ivan who explained that he had lots inside and outside of the City and that he had no objections to the annexation. itlLMED ,tP.19 NI Special Minutes September 17, 1981 Page 2 Mr. Poelma, Poelma Floors and Interior, 6767 Weber, was the next speaker who asked about extending sewer services. Mr. Townsend explained that the priority for the extension of sewer lines came as a result of petitions to the Council for such services and that Waste- water Services had a form they would be happy to provide and the interested people could circulate the petitions and present them to the Engineering Department. He explained the cost for connecting was $2.00 per front foot if connected within six months from the time of installation or $5.00 per front foot if connected after the six month period. The second speaker was ark Bratton, 3607 Bratton Road, who asked what percentage of the owners of property would have to petition before the City would extend sewer. City Manager Townsend again explained that the priority of bond elections would depend upon the presentation of petitions and if petitions were presented . • requesting extension of the sewer line, it would be placed in the next capital improvement bond program if it was determined to be high enough priority by the City Council. He further explained that if sufficient property owners petitioned, that the City would lay the sewer line through .private contractors by bid and that the property owners would be assessed at the above mentioned figures. Mr. Bratton asked if the owners had to start the petition or if the City would instigate the petition process. Mr. Townsend explained that if the area is annexed that sometime in•.the future the City would make such a survey, but he explained that if the problem existed that the most expedient way to do it would be for the owners to request • it. Mr. Bratton again asked as to the southwest boundary and Mr. Wenger explained that it was Bratton Road and would take in Bratton Road but would qo no further southwest. The Mayor asked Mr. Bratton if he knew of any opposition to the annexation and Mr. Bratton stated that he had not talked to anyone that was vehemently opposed to annexation this time, while a number of people • were • opposed to the last annexation proposition. '-1 ,. ecial Minutes ptember 17, 1981 rage 3 An unidentified woman inquired if they could be assured they would have city services extended since the property across the street from her was in the city and still did not have sewer. She claimed the sewer line that existed in the road in front of her house was put in by the Yellow Rose and he got his line immediately upon coming into the City. City Manager Townsend explained that he got the sewer line immediately when he came into the City because he paid the price to have the line' laid. • Mr. Townsend asked her if she understood the 'platting process and she stated that she did. He further explained that she would not be able to get any city services until she had platted her property. She asked how much the cost of platting would be and who had to pay it. City Manager Townsend, explained that the cost would have to be born by the property owner. She stated that she did not want to go through the expense of platting but that she had a survey that was provided her when she bought the property.. Assistant City Manager Lontos explained that the engineer •who made. the original survey would probably be able to prepare the plat for her. City Manager Townsend again explained that the services were in existence and that the only effort she would have to make would be to go through the platting process, make her application and pay the pro -rata share, of the cost of the sewer. Mr. Shoeford with American Disposal inquired that if a petition . was presented within the sixty days how long would if be before they could get sewer service. City Manager Townsend responded that the Council is now considering calling a bond election and if the petition was circulated and presented to the Council and the Council gave if sufficient priority, that it could go on the bond election and that as the money became available as the bonds were sold the work would begin. Assuming everything went reasonably well, the time would he approximately 18 months. Mrs. Johnson, South Texas: Sprinklers Service, explained that it had been said by some they were outside of the City in order to avoid paying City sales tax, but that they paid a City sales tax on all of the material they sold that ' was used inside the City. Special Minutes September 17, 1981 Page 4 Mr. Bratton again asked about the maintenance of the drainage that was adjacent to the property. He asked if the City did annex the property, would the City take over the responsibility of keeping the drainage ditch clean, a responsibility that is now in the hands of the County. Mr. Lontos replied that if it were taken into the City he guessed it would become the responsibility of the City. He stated that he had had the ditch widened and deepened and gotten into pretty good shape, but the County is not maintaining it. The Mayor and City Manager both stated that it was in the County and it was the responsibility of the County. The Mayor even offered to go with him to see the County Judge. Upon examining the map it was determined that the ditch_ in question would not be in the annexed area and would still be the County's responsibility. • The Mayor asked if there were any other comments or questions from the audience. There was no response. He then asked if any member of the , • Council would like to make a statement, but none of the Council Members indicated to make any. The Mayor concluded the meeting by stating that at each Wednesday's Council Meeting a period of time was devoted for petitions from the audience and welcomed anyone who was interested to attend a Wednesday Council Meeting and ask any questions or present any petitions, complaint or compliment. they desired. One of the gentlemen in the audience asked if they were not annexed could they get sewer and •City Manager Townsend explained that the only way they could get sewer service would be to voluntarily annex. An unidentified gentleman asked how long it would be before they got sewers if they were annexed. City Manager Townsend again explained the procedure and used the 18 month time limit again with the proper explanations of what could happen to delay it. An unidentified gentleman who arrived late asked another question that if the area was annexed would the massage parlors be closed down. City Manager Townsend explained that if this area was annexed the Police Department would notify the establishments that they were in violation of the ordinances and proper action would be taken. Icia1 Minutes itember 17, 1981 age 5 Assistant City Attorney Jay Dogey added that the City had a great deal more flexibility in the regulating and enforcment of such establishments than does the County and it would be much easier for the City to regulate them. Motion by Council Member Zarsky, seconded by Mayor Pro Tem Turner and passed unanimously that the meting be adjourned at 7:27 p.m., September 17; 1981.
