PRESENT Mayor Luther Jones Council Members Jack K. Dumphy Bob Gulley Herbert L. Hawkins, Jr. Dr. Charles W. Kennedy, Jr. Cliff Zarsky ABSENT Mayor Pro Tem Betty N. Turner City Manager Edward Martin City Attorney J. Bruce Aycock City Secretary Bill G. Read Mayor Luther Jones called the meeting to order in the Council Chamber of City Hall and stated that the purpose of the meeting was to conduct public hearings on three zoning applications. City Secretary Bill G. Read verified that the necessary quorum of the Council and the required Charter Officers were present to conduct a legally constituted meeting. Assistant City Manager Tom Utter announced the public hearing on the following application: Application No. 1282-10, Ms. Ceola Punchard: for change of zoning from "R -1B" One -family Dwelling District to "A-1" Apartment House District on Lots 3 and 4, Kennedy Place, located on the west side of Kennedy Avenue, approximately 150' south of West Broadway Mr. Utter noted that both the Planning Commission and the Planning Staff recommend denial of the request but in lieu thereof that "R-2" Multiple Dwelling District be approved. He stated that there was no response to the notices of the public hearing and informed the Council that the applicant had agreed to the recommended zoning of "R-2". Mayor Jones ascertained that no one in the audience desired to speak in regard to this zoning application. A motion was made by Council Member Charles Kennedy that the hearing be closed, seconded by Council Member Jack Dumphy and passed unanimously. MIGROFILM SEP 191984 I a _flutes Special Council Meeting February 2, 1983 Page 2 A motion was made by Council Member Dumphy that the Council concur with the recommendation of the Planning Commission and the Planning Staff and grant the zoning of "R-2" on this application; seconded by Council Member Cliff Zarsky; and passed unanimously. * * * * * * * * * * * * * * * * * * * * * * * * * Assistant City Manager Utter announced the public hearing on the following application: Application No. 1282-11, Mr. Peter Roel: for change of zoning from "I-2" Light Industrial District to "A-2" Apartment House District on Lot 3A, John's Industrial Subdivision located on the west side of Old Brownsville Road, approximately 188' north of Bear Lane. Mr. Utter informed the Council that both the Planning Commission and the Planning Staff recommend denial of the "A-2" zoning but in lieu thereof that the zoning of "A-1" be approved. He stated that there was no response to the four notices of the public hearing that were mailed. Mr. Larry Wenger, Director of Planning, stated that the applicant has agreed to the recommended zoning of "A-1". No one in the audience indicated a desire to speak in regard to this zoning application. A motion was made by Council Member Zarsky that the hearing be closed, seconded by Council Member Gulley and passed unanimously. A motion was made by Council Member Dumphy that the Council concur with the recommendation of the Planning Commission and the Planning Staff and grant the zoning of "A-1" on this application; seconded by Council Member Zarsky; and passed unanimously. * * * * * * * * * * * * * * * * * * * * * * * * Mr. Utter announced the public hearing on the following application: Application No. 1282-12, E. H. Moore Homes, Inc. & J -R Builders, Inc.: for change of zoning from "R -1B" One -family Dwelling District to "R-2" Multiple Dwelling District on Tract 1 and to "R -1C" One -family Dwelling District on Tract 2, Tract 1 being 6.98± acres and Tract 2 being 18.43± acre, both tracts out of Lot 1, Section 19, Bohemian Colony Lands, located on the south side of Cedar Pass Drive, approximately 1,650' west of Everhart Road. Assistant City Manager Utter informed the Council that both the Planning Commission and the Planning Staff recommend approval of this request and that in response to the notices of the public hearing, none in favor, one in opposition from the area of notification and one in opposition from outside the area had been returned. Minutes Special Council Meeting February 2, 1983 Page 3 Mr. Wenger located the area on the zoning and land use map, described the land use in the surrounding area and showed slides of the vicinity. No one spoke in regard to this application. A motion was made by Council Member Dumphy that the hearing be closed, seconded by Council Member Gulley and passed unanimously. A motion was made by Council Member Dumphy that the requested change of zoning be granted, seconded by Council Member Gulley and passed unanimously by those present and voting. * * * * * * * * * * * * * * * * * * * * * * * * * In the temporary absence of the City Secretary, Acting Assistant City Secretary Dorothy Zahn polled the Council for their votes on the ordinances effecting the foregoing zoning changes, and the following were passed: ORDINANCE NO. 17461: AMENDING THE ZONING ORDINANCE UPON APPLICATION OF CEOLA PUNCHARD, BY CHANGING THE ZONING MAY IN REFERENCE TO LOTS 3 AND 4, KENNEDY PLACE FROM "R -1B" ONE -FAMILY DWELLING DISTRICT TO "R-2" MULTIPLE DWELLING DISTRICT; AND DECLARING AN EMERGENCY. The Charter Rule was suspended and the foregoing ordinance passed by the following vote: Jones, Dumphy, Gulley and Zarsky voting "aye"; Turner, Hawkins and Kennedy "absent". ORDINANCE NO. 17462: AMENDING THE ZONING ORDINANCE UPON APPLICATION OF PETER ROEL, BY CHANGING THE ZONING MAP IN REFERENCE TO LOT 3A, JOHN'S INDUSTRIAL SUBDIVISION, FROM "I-2" LIGHT INDUSTRIAL DISTRICT TO "A-1" APARTMENT HOUSE DISTRICT; AND DECLARING AN EMERGENCY. The Charter Rule was suspended and the foregoing ordinance passed by the following vote: Jones, Dumphy, Gulley and Zarsky voting "aye"; Turner, Hawkins and Kennedy "absent". ORDINANCE NO. 17463: AMENDING THE ZONING ORDINANCE UPON APPLICATION OF E. H. MOORE HOMES, INC. AND J -R BUILDERS, INC., BY CHANGING THE ZONING MAP IN REFERENCE TO TRACTS 1 AND 2 OUT OF LOT 1, SECTION 19, BOHEMIAN COLONY LANDS, FROM "R -1B" ONE -FAMILY DWELLING DISTRICT TO "R-2" MULTIPLE DWELLING DISTRICT ON TRACT 1 AND "R -1C" ONE -FAMILY DWELLING DISTRICT ON TRACT 2; AND DECLARING AN EMERGENCY. The Charter Rule was suspended and the foregoing ordinance passed by the following vote: Jones, Dumphy, Gulley and Zarsky voting "aye"; Turner, Hawkins and Kennedy "absent". * * * * * * * * * * * * * * * * * * * * * * * * * * * * There being no further business to come before the Council, on motion by Zarsky, seconded by Gulley and passed unanimously, the Special Council Meeting was adjourned at 4:46 p.m., February 2, 1983.
