Read Jolist- Mayor Luther Jones called the meeting to order in the Council Chamber of City Hall and stated that the purpose of the special meeting was to conduct public hearings on five zoning applications. City Secretary Bill G. Read verified that the necessary quorum of the Council and the required Charter Officers were present to conduct a legally constituted meeting. Application No. 238-1T, Mr. W. H. Hammonds, Amendment to the Zoning Ordinance to amend Article 31, Newly Annexed Territory, by amending Section 31-5 by adding thereto one new subsection to be numbered 31-5.49 setting forth zoning class- ifications of "B-4" General Business District on Tract A and "A-1" Apartment House District on Tract B when annexed to the City of Corpus Christi, Texas. Tract A consists of 10.56 acres and Tract B 5.5 acres and both tracts are located on the southwest corner of Rodd Field Road and Saratoga Boulevard. Assistant City Manager Tom Utter informed the Council that four notices of the public hearing had been mailed; one in favor and one in opposition had been returned; and that the Planning Commission and Planning Staff both recommend approval. Mayor Jones ascertained that no one wished to speak in regard to this zoning case. A motion was made by Mayor Pro Tem Turner that the hearing be closed, seconded by Council Member Zarsky and passed unanimously. A motion was made by Mayor Pro Tem Turner that the zoning of "B-4" be granted on Tract A and "A-1" on Tract B for Application No. 238-1T; seconded by Council Member Zarsky; and passed unanimously. City Secretary Read polled the Council for their vote on the ordinance and it passed as follows: SEPI 91994 .ates Special Council Meeting March 2, 1983 Page 2 ORDINANCE NO. 17507 AMENDING THE ZONING ORDINANCE BY AMENDING ARTICLE 31, NEWLY ANNEXED TERRITORY, BY ADDING TO SECTION 31-5 A NEW SUBSECTION, 31-5.49 SETTING FORTH ZONING CLASSIFICATION ON SAID AREA OF LAND DESCRIBED AS TRACT A AND TRACT B, PORTION OF LOT 8, SECTION 20, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS; AND DECLARING AN EMERGENCY. The Charter Rule was suspended and the foregoing ordinance passed by the following vote: Jones, Turner, Dunphy, Gulley, Hawkins, Kennedy and Zarsky voting "aye". * * * * * * * * * * * * * * * Application No. 283-2, Mr. David May, for a change of zoning from "R -1B" One -family Dwelling District with "SP" Special Permit to "B-1" Neighborhood Business District on Lot 5, Block 6, Koolside Addition, located on the west side of Airline Road, approximately 300' north of Kimbrough Drive. Mr. Utter informed the Council that 23 notices of the public hearing had been mailed and three in favor and none in opposition had been returned. He stated that both the Planning Commission and Planning Staff recommend denial. Mr. Larry Wenger, Director of Planning, located the area on the zoning and land use map, described the land use in the surrounding area, and showed slides of the vicinity. He stated that the premises are presently occupied by a Quick Change Oil operation; the lots are very narrow; and if free-standing signs were approved as the applicant has requested on these lots, they would tend to obliterate the signs of the other small shops in the vicinity. He stated that none of the other shops in the area have free-standing signs. Mr. David May, the applicant, spoke in favor the application and informed the Council that his neighbors do not object to the free-standing sign and the only ones who are opposed are members of the City staff. He displayed pictures of free-standing signs further down Airline. Mayor Jones noted that there was a free-standing sign at the Ken Combs Realty Company and inquired if it was in accordance with the existing zoning at that location. Mr. Wenger stated that it is an illegal sign but Mr. Combs is in the process of applying for a special permit for a free-standing sign. Speaking in opposition to this zoning case was Mrs. Dorothy Corcoran, 734 Chase Street, who stated that there is no need for a free-standing illuminated sign because the building is so bright there is no way anyone could possibly miss seeing it. She stated that she objected to the design of the building because it is a blight on their neighborhood. rotes Special Council Meeting March 2, 1983 Page 3 Also speaking in opposition was Mrs. Gretchen Matthews, who stated that she lives in the vicinity and all of the neighbors were very upset when that building was constructed with all of the bright colors. No one else spoke in regard to this zoning application. A motion was made by Council Member Zarsky that the hearing be closed, seconded by Council Member Dumphy and passed unanimously. A motion was made by Council Member Zarsky that the zoning of "B-1" be denied but in lieu thereof that a special permit for a sign that meets the requirements of "B-1" zoning be approved; seconded by Council Member Gulley. The vote on the motion was as follows: Dumphy, Gulley and Zarsky voting "aye"; Jones, Turner and Kennedy voting "no"; Hawkins absent at the time the vote was taken. Mr. Utter informed the Council that approval of this special permit would require five affirmative votes since the Planning Commission recommended denial. A motion was made by Council Member Kennedy that the "8-1" zoning on Application No. 283-2 be denied. The motion died for lack of a second. Council Member Gulley inquired if the Planning Commission had considered a special permit, and Mr. Wenger stated that the Planning Commission discussed a special permit and they did not recommend that it be revised to allow for the sign either. Mr. Utter stated that there is no technical reason to send this application back to the Planning Commission. A motion was made by Council Member Gulley that Application No. 283-2 be sent back to the Planning Commission to consider the possibility of a special permit allowing for a smaller sign; seconded by Council Member Dumphy; and passed unanimously. * * * * * * * * * * * * * * * Application No. 283-3, Kaffie Brothers for a change of zoning from "A-1" Apart- ment House District to "AB" Professional Office District on Lot 2, Block 1, J. D. Bernard Subdivision, located on the west side of South Carancahua Street, approximately 176' north of Park Avenue. Mr. Utter informed the Council that 14 notices of the public hearing had been mailed; four in favor and none in opposition had been returned; and both the Planning Commission and Planning Staff recommend approval. A motion was made by Mayor Pro Tem Turner that the zoning of "AB" for Application No. 283-3 be approved; seconded by Council Member Dumphy; and passed unanimously. ORDINANCE NO. 17508 AMENDING THE ZONING ORDINANCE UPON APPLICATION OF KAFFIE BROTHERS BY CHANGING THE ZONING MAP IN REFERENCE TO LOT 2, BLOCK 1, J. D. BERNARD SUBDIVISION, FROM "A-1" APARTMENT HOUSE DISTRICT TO "AB" PROFESSIONAL OFFICE DISTRICT; AND DECLARING AN EMERGENCY. The Charter Rule was suspended and the foregoing ordinance passed by the following vote: Jones, Turner, Dumphy, Gulley, Hawkins, Kennedy and Zarsky voting "aye". * • * * • * * * • * • * * * Assistant City Manager Tom Utter suggested that Application No. 283-4 and 283-5 be considered simultaneously since they are both in the same area. Application No. 283-4, Gardendale Baptist Church for a change of zoning from "R -1B" One -family Dwelling District to "R-2" Multiple Dwelling District on Lots 17 and 18, Block 10, Gardendale Addition, located on the northeast corner of Holly Road and Burton Lane. Application No. 283-5, Dr. Lowell J. Kepp for a change from "R -1B" One -family Dwelling District to "R-2" Multiple Dwelling on Lot 16, Block 10, Gardendale Addition, located on the north side of Holly Road, approximately 237' east of Burton Lane. Mr. Utter stated that both the Planning Commission and Planning Staff recommend approval and there was very little opposition expressed on these two zoning cases. No one spoke in regard to the applications. Mr. Wenger displayed slides of the area and pointed out the location on the zoning and land use map. A motion was made by Mayor Pro Tem Turner that the hearing be closed, seconded by Council Member Kennedy and passed unanimously. A motion was made by Mayor Pro Tem Turner that the zoning of "R-2" be granted on on Application No. 283-4 and 283-5; seconded by Council Member Kennedy; and passed unanimously. City Secretary Read polled the Council for their vote on the ordinances effecting the foregoing zoning changes and they passed as follows: ORDINANCE NO. 17509 AMENDING THE ZONING ORDINANCE UPON APPLICATION OF GARDENDALE BAPTIST CHURCH BY CHANGING THE ZONING MAP IN REFERENCE TO LOTS 17 AND 18, BLOCK 10, GARDENDALE ADDITION, FROM "R -1B" ONE -FAMILY DWELLING DISTRICT TO "R-2" MULTIPLE DWELLING DISTRICT; AND DECLARING AN EMERGENCY. .,utes Special Council Meeting March 2, 1983 Page 5 The Charter Rule was suspended and the foregoing ordinance passed by the following vote: Jones, Turner, Dumphy, Gulley, Hawkins, Kennedy and Zarsky voting "aye". KEPP BY CHANGING THE ZONING MAP IN REFERENCE TO LOT 16, BLOCK 10, GARDENDALE ADDITION, FROM "R -1B" ONE -FAMILY DWELLING DISTRICT TO "R-2" MULTIPLE DWELLING DISTRICT; AND DECLARING AN EMERGENCY.
