HomeMy WebLinkAbout09661 ORD - 03/04/1970JXH:3 - -3 -70 AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A CONTRACT WITH SOUTH TEXAS CONSTRUCTION COMPANY FOR CONSTRUCTION OF THE NAVIGATION BOULEVARD IMPROVEMENTS FROM BEAR LANE TO STATE HIGHWAY 41+, PROJECT NO. 220- 67 -101I; APPROPRIATING OUT OF NO. 220 STREET BOND FUND THE SUM OF $630.30 TO SUPPLEMENT THE FUNDS PREVIOUSLY APPROPRIATED BY ORDINANCE NO. 9637, PASSED AND APPROVED BY THE CITY COUNCIL ON FEBRUARY 4, 1970, FOR A TOTAL APPROPRIATION OF $65,630.30, OF WHICH AMOUNT $59,970.60 IS FOR THE CONSTRUCTION CONTRACT AND $5,659.70 IS FOR CONTINGENCIES AND INCIDENTAL EXPENSES; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED AND DIRECTED, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE A CONTRACT WITH SOUTH TEXAS CONSTRUCTION COMPANY FOR CONSTRUC- TION OF THE NAVIGATION BOULEVARD IMPROVEMENTS, FROM BEAR LANE TO STATE HIGHWAY 44, PROJECT NO. 220 -67 -1011, SAID CONSTRUCTION TO CONSIST OF EXCAVATIONS, 8 -INCH CALICHE BASE, TWO- COURSE ASPHALTIC SURFACING FOR PAVEMENT WIDTH OF 24 FEET, 5,680 FEET OF CHANNEL EXCAVATION, OUTFALL STRUCTURES AND OTHER DRAINAGE FACILITIES, ALL AS MORE FULLY SET OUT IN THE PLANS AND SPECIFICATIONS AND CONTRACT DOCUMENTS ON FILE IN THE OFFICE OF THE CITY SECRETARY, ALL OF WHICH ARE MADE A PART HEREOF BY REFERENCE, AND ACCORDING TO THE BID OF SOUTH TEXAS CONSTRUCTION COMPANY, OPENED ON JANUARY 21, 1970, THE SAID BID OF SOUTH TEXAS CONSTRUCTION COMPANY BEING THE MOST ADVANTAGEOUS BECAUSE OF THE FACT THAT THE ONLY BIDDER FOR A LESSER AMOUNT HAS NOTIFIED THE CITY THAT IT WILL NOT EXECUTE CONTRACT OR FURNISH PERFORMANCE AND PAYMENT BOND. SECTION 2. THERE IS HEREBY APPROPRIATED THE SUM OF $630.30 OUT OF No. 220 STREET BOND FUND, TO SUPPLEMENT THE FUNDS PREVIOUSLY APPROPRIATED BY ORDINANCE No. 9637, PASSED AND APPROVED BY THE CITY COUNCIL ON FEBRUARY 4, 1970, FOR A TOTAL APPROPRIATION OF SUMS HEREBY APPROPRIATED AND PREVIOUSLY APPROPRIATED OF $65,630.30, OF WHICH AMOUNT $59,970.60 IS FOR THE CONSTRUCTION CONTRACT AND $5,659.70 IS FOR CON- TINGENCIES AND INCIDENTAL EXPENSES. 9661 SECTION 3. THE NECESSITY TO PROVIDE AN IMPROVED TRAFFIC FACILITY IN COOPERATION WITH CERTAIN PARTICIPATING PROPERTY OWNERS CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE 4 4 / DAY of MARCH, 1970.
