HomeMy WebLinkAbout09780 ORD - 05/27/1970•y w AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 61o6, AS AMENDED, UPON APPLICATION OF DOLLAR LAND CORPORATION, LTD., BY GRANTING A SPECIAL PERMIT ON A 2 -ACRE PORTION OF BLOCK A, PARKDALE SHOPPING CENTER, BEING MORE PARTICULARLY DESCRIBED HEREINAFTER, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FOR OPERATION OF A CIRCUS OR CARNIVAL GROUNDS FOR KIDDIE RIDES FOR A 2 -YEAR TERM; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, THE ZONING AND PLANNING COMMISSION HAS FORWARDED TO THE CITY COUNCIL ITS REPORTS AND RECOMMENDATIONS CONCERNING THE APPLICA- TION OF DOLLAR LAND CORPORATION, LTD. FOR AMENDMENT TO THE ZONING MAP OF THE CITY OF CORPUS CHRISTI; AND WHEREAS, PUBLIC HEARING WAS HELD AT WHICH HEARING ALL PERSONS WISHING TO APPEAR AND BE HEARD WERE HEARD, TO CONSIDER THE SAME BEFORE THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, IN ACCORDANCE WITH PROPER NOTICE TO THE PUBLIC, SAID PUBLIC HEARING HAVING BEEN HELD ON MAY 25, 1970 1 AT SPECIAL COUNCIL MEETING OF THE CITY COUNCIL IN THE COUNCIL CHAMBER AT CITY HALL IN THE CITY OF CORPUS CHRISTI; AND WHEREAS, BY MOTION DULY MADE, SECONDED AND CARRIED, IT WAS DECIDED BY THE CITY COUNCIL THAT TO APPROVE THE HEREINAFTER SET FORTH AMENDMENT WOULD BEST SERVE PUBLIC HEALTH, NECESSITY AND CONVENIENCE AND THE GENERAL WELFARE OF THE CITY OF CORPUS CHRISTI AND ITS CITIZENS: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1• THAT THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, TEXAS, PASSED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME, AND-IN PARTICULAR AS AMENDED BY ORDINANCE N0. 6106, AS AMENDED, BE AND THE SAME IS HEREBY AMENDED BY MAKING THE CHANGE HEREINAFTER SET OUT. m SECTION 2. THAT A SPECIAL PERMIT BE GRANTED FOR OPERATION OF A CIRCUS OR CARNIVAL GROUNDS WITH KIDDIE RIDES ON A 2 -ACRE PORTION OF BLOCK A, PARKDALE SHOPPING CENTER, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY TEXAS, BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEING A 2.066 -ACRE TRACT OF LAND OUT OF BLOCK A, PARKDALE SHOPPING-CENTER, AS SHOWN BY MAP OF RECORD IN VOLUME19, PAGE 49, MAP RECORDS, NUECES COUNTY, TEXAS, SAID 2.066 -ACRE TRACT OF LAND BEING MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS AS FOLLOWS: BEGINNING AT A POINT IN THE SOUTHWEST RIGHT -OF -WAY LINE OF 100 —FOOT WIDE SOUTH STAPLES STREETS SAID POINT BEING S. 310 061 10" E. 366.76 FEET FROM THE MOST NORTHERLY CORNER OF SAID BLOCK A, FOR THE MOST, NORTHERLY CORNER OF THE TRACT HEREIN DESCRIBED; THENCE S. 31° 061 10" E. WITH THE SOUTHWEST RIGHT —OF -WAY LINE OF SAID SOUTH STAPLES STREET, A DISTANCE OF 300.0 FEET TO A POINT FOR THE MOST EASTERLY CORNER OF THIS TRACT; THENCE S. 58° 53' 5011 W., A DISTANCE OF 300.0 FEET TO A POINT FOR THE MOST SOUTHERLY CORNER OF THIS TRACT; THENCE N.31° 061 10t1 W., A DISTANCE OF 300.0 FEET TO A POINT FOR THE MOST WESTERLY CORNER OF THIS TRACT; THENCE N. 58° 53' 50" E., A DISTANCE OF 300.0 FEET TO THE POINT OF BEGINNING. CONTAINING 2.066 ACRES OF LAND) MORE OR LESS; ALL AS MORE FULLY SET FORTH ON THE PLOT PLAN, APPROVED BY THE PLANNING COMMISSION, A COPY OF WHICH PLOT PLAN IS ATTACHED HERETO AND MADE A PART HEREOF AND SUBJECT TO THE FOLLOWING CONDITIONS: (1) THAT USE BE LIMITED TO TEMPORARY KIDDY RIDES OR SMALL CIRCUSES; (2) LIMITATION OF CONTINUOUS USE TO A SEVEN —DAY PERIOD; (3) NO MORE THAN ONE SUCH ENDEAVOR EVERY TWO MONTHS EXCEPT DURING THANKSGIVING AND CHRISTMAS SEASON; (4) THAT AN EXTENSION OF THE SPECIAL PERMIT BE GRANTED OVER A TWO -YEAR PERIOD; AND 1 -5/ THAT ALL OTHER REQUIREMENTS OF nB -411 GENERAL BUSINESS DISTRICT BE OBSERVED. IN THE EVENT THE BOARD OF ADJUSTMENT GRANTS ANY SPECIAL EXCEPTION OR VARIANCE TO THE 70NINO OPO INANCET APPL(CARLE TO THE PROPCRTY INCLUOED IN THE SPECIAL PERMIT HEREIN GRANTED, OTHER THAN THE ONE SPECIFIED IN THIS SPECIAL PERMIT, SAID SPECIAL PERMIT WILL BE VOID AND OF NO FORCE OR EFFECT WHATSOEVER. -2- SECTION 3. THAT THE OFFICIAL ZONING MAP OF THE CITY OF CORPUS CHRISTI, TEXAS, BE, AND THE SAME IS HEREBY, AMENDED AS HEREIN ORDAINED. SECTION 4. THAT THE ZONING ORDINANCE AND MAP OF THE CITY OF. CORPUS CHRISTI, TEXAS, APPROVED ON THE 27TH DAY OF AUGUST, 1937, AS AMENDED FROM TIME TO TIME, EXCEPT AS HEREIN CHANGED, SHALL REMAIN IN FULL FORCE AND EFFECT. SECTION 5. THAT ALL ORDINANCES OR PARTS OF-ORDINANCES IN CON- FLICT HEREWITH ARE HEREBY EXPRESSLY REPEALED. SECTION 6. THAT THE NECESSITY OF IMMEDIATELY MAKING AFORESAID CHANGE FOR THE PURPOSE OF MAINTAINING AT ALL TIMES A COMPREHENSIVE ZONING' ORDINANCE FOR THE CITY OF CORPUS CHRISTI CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER Y RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL; AND THE MAYOR HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE DAY OF 9 %O ATTES .
