HomeMy WebLinkAbout09872 ORD - 07/29/1970• 5JW:7/2V70 AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE A CONTRACT WITH AUSTIN ENGINEERING COMPANY FOR CON- STRUCTION OF THE FLOUR BLUFF AND NAVAL AIR STATION WATER TRANSMISSION LINES, PROJECT NO. 202 -68 -29.3 (PART A), EDA PROJECT NO. 08-1- 00747, SUBJECT TO FINAL APPROVAL FROM THE ECONOMIC DEVELOPMENT ADMINISTRATION; APPROPRIATING FROM THE NO. 202 WATER SYSTEM BOND FUND THE SUM of $1,077,725.58, OF WHICH $1,035 926 IS FOR THE CONSTRUCTION CONTRACT AND $111,799.58 IS FOR CONTINGENCIES, INCLUDING ENGINEERING FEES, INSPECTION, STAKING, RADIO- GRAPHIC TEST, LABORATORY TESTING, AND OTHER INCIDENTAL EXPENSES; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED AND DIRECTED TO EXECUTE A CONTRACT WITH AUSTIN ENGINEERING COMPANY FOR CON- STRUCTION OF THE FLOUR BLUFF AND NAVAL AIR STATION WATER TRANSMISSION LINES, .y PROJECT NO. 202 -68 -29.3 (PART A), EDA PROJECT N0. 08- 1- 00747, SAID CONSTRUC- TION TO CONSIST OF FURNISHING ALL MATERIALS, EQUIPMENT, AND LABOR NECESSARY TO CONSTRUCT, COMPLETE AND IN PLACE, APPROXIMATELY 26,900 L.F. OF 30" PIPE, 111,700 L.F. OF 20" PIPE, AND 4,000 L.F. OF 16° PIPE,AS IS MORE FULLY DESCRIBED IN THE PLANS AND SPECIFICATIONS, TO BE SITUATED EASTWARD ALONG HOLLY ROAD FROM SOUTH STAPLES STREET ACROSS THE CAYO DEL OSO TO FLOUR BLUFF DRIVE, THEN ALONG DIVISION ROAD TO LAGUNA SHORES ROAD WITH A SECOND LINE TO RUN NORTHEASTWARD ALONG FLOUR BLUFF DRIVE FROM DIVISION ROAD TO THE U. S. NAVAL AIR STATION, IN NUECES COUNTY, TEXAS, SUBJECT TO PRIOR FINAL APPROVAL BY THE ECONOMIC DEVELOPMENT ADMINISTRATION, ALL AS MORE FULLY SET OUT IN THE PLANS AND SPECIFICATIONS AND CONTRACT DOCUMENTS ON FILE IN THE OFFICE OF THE CITY SECRETARY, ALL WHICH ARE MADE A PART HEREOF BY REFERENCE, ACCORDING TO THE BID OF AUSTIN ENGINEERING COMPANY OPENED ON JULY 15, 1970, THE SAID BID OF AUSTIN ENGINEERING COMPANY BEING THE LOWEST AND MOST ADVANTAGEOUS TO THE CITY OF CORPUS CHRISTI, TEXAS SECTION 2. THERE IS HEREBY APPROPRIATED OUT OF THE NO. 202 WATER SYSTEM BOND FUND THE SUM OF $11077,725.58, OF WHICH $1,035,926 IS FOR THE CONSTRUCTION CONTRACT AND $41,799.58 IS FOR CONTINGENCIES, INCLUDING ENGINEER- ING FEES, INSPECTION, STAKING, RADIOGRAPHIC TEST, LABORATORY TESTING AND OTHER INCIDENTAL EXPENSES. _ 9872 s i SECTION 3. THE NECESSITY TO PROVIDE THE FUNDS HEREBY APPROPRIATED AND TO AUTHORIZE THE CITY MANAGER TO EXECUTE THE AFORESAID CONTRACT, SUBJECT TO FINAL APPROVAL BY THE ECONOMIC DEVELOPMENT, IN ORDER TO INCREASE THE CAPACITY OF THE WATER TRANSMISSION FACILITIES TO THE FLOUR BLUFF AREA AND THE U. S. NAVAL AIR STATION, CREATES A PUBLIC EMERGENCY AND IMPERATIVE PUBLIC NECESSITY REQUIR- ING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE 29TH DAY OF JULY, 1970.
