AN ORDINANCE CLOSING THAT PORTION OF LINK DRIVE FROM SAHARA DRIVE, IN A NORTHWESTERLY DIRECTION FOR A DISTANCE OF APPROXI- MATELY 120 FEET, LOCATED IN MEADOWLARK PARK, UNIT 1, IN THE CITY OF CORPUS CHRISTI, TEXAS; AND DECLARING AN EMERGENCY. WHEREAS, NOTICE OF THE TIME AND PLACE FOR HOLDING A HEARING CON- CERNING THE CLOSING OF THAT PORTION OF LINK DRIVE FROM SAHARA DRIVE, IN A NORTHWESTERLY DIRECTION FOR A DISTANCE OF APPROXIMATELY 120 FEET, LOCATED IN MEADOWLARK PARK, UNIT 1, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, WAS GIVEN BY PUBLICATION AND REGISTERED MAIL TO THE LAST KNOWN ADDRESSES OF THE OWNERS OF PROPERTY ABUTTING SAID STREET AND WITHIN 450 FEET OF THE AREA TO BE CLOSED, AND THEREAFTER, PURSUANT TO SAID NOTICE, PUBLIC HEARING WAS HELD AT REGULAR MERTING OF THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI ON WEDNESDAY, JULY 22, 1970, IN ACCORDANCE WITH THE PROVISIONS OF THE CITY CHARTER; AND WHEREAS, IT WAS DETERMINED BY THE CITY COUNCIL AFTER SUCH HEARING THAT THE PORTION OF THE STREET ABOVE DESCRIBED IS NOT NOW NEEDED FOR STREET PURPOSES, NOR WILL IT WITHIN THE FORESEEABLE FUTURE BE NEEDED FOR STREET PURPOSES; AND WHEREAS, IT HAS BEEN DETERMINED THAT IT IS TO THE ADVANTAGE OF THE CITY TO CLOSE THE ABOVE DESCRIBED PORTION OF LINK DRIVE SO THAT THE SAME MAY BE USED BY THE ABUTTING PROPERTY OWNERS FOR OTHER PURPOSES: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT LINK DRIVE, FROM SAHARA DRIVE, IN A NORTHWESTERLY DIRECTION FOR A DISTANCE OF APPROXIMATELY 120 FEET, LOCATED IN MEADOWLARK PARK, UNIT 1, MORE FULLY DESCRIBED HEREINAFTER, BE, AND THE SAME IS HEREBY, CLOSED FOR PUBLIC USE AND ABANDONED TO THE OWNERS OF THE ABUTTING PROPERTY: 9873 FIELDNOTES for that portion of the right -of -way of Link Drive to be closed shown by map of Meadowlark Park Unit 1 recorded in Volume 34, Page 121 of the Map Records of Nueces County, Texas. BEGINNING at the most easterly corner of Meadowlark Park Unit 1 for the most easterly corner and POINT OF BEGINNING of this tract; THENCE with•the southeast boundary line of Meadowlark Park Unit 1, the southeast right -of -way line of Link Drive, S 290 00' 40" W 120 feet to the most southerly corner of this tract; THENCE in a northwesterly direction with a circular curve to the left whose radius center bears S 890 00' 40" IV 50 feet, said curve having a central angle = 79° 30' 4311, tangent o 41.59 feet, for an arc distance of 69.39 feet to the most westerly corner of this tract; THENCE N 290 00' 40" E 97.91 feet to the northeast boundary line of Meadowlark Park Unit 1 for the most northerly corner of this tract; THENCE with said boundary line S 60° 57' 10" E 60 feet to the POINT OF BEGINNING. SECTION 2. THE FACT THAT THE PUBLIC CONVENIENCE AND NECESSITY WOULD BE BETTER SERVED BY THE CLOSING OF THE AFORESAID STREET CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPEN- SION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDI- NANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE 29_DAY OF JULY, 1970- ATTEST: a� CIT SECT ETARY OR APP VED: Tr. THE CITY OF CORPUS CHRISTI, TEXAS %y ',CTING CITY ATT EY TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas • Corpus Christi, a as day of 19 7a For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
