HomeMy WebLinkAbout10549 ORD - 11/03/1971ll:3:(1:JKH AN ORDINANCE CLOSING AND ABANDONING THE 10 -FOOT UTILITY EASEMENT LOCATED IN LOT 13 OF THE GLEN OAK SUBDIVISION OUT OF SECTION 53, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS, AS SHOWN IN THE MAP RECORDS OF NUECES COUNTY, TEXAS; AND DECLARING AN EMERGENCY. WHEREAS, THERE EXISTS A CERTAIN EASEMENT IN LOT 13 OF THE GLEN OAK SUBDIVISION OUT OF SECTION 53, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS, AS SHOWN IN VOL. A, PAGES 41, 42, 43 AND VOL. 35, PAGES 96 AND 97, MAP RECORDS OF NUECES COUNTY, TEXAS; AND WHEREAS, THE AFORESAID EASEMENT IS NOT NOW NEEDED BY THE CITY, NOR WILL IT WITHIN THE FORESEEABLE FUTURE BE NEEDED BY THE CITY OF CORPUS CHRISTI; AND WHEREAS, IT HAS SEEN'DETERMINED THAT IT IS TO THE ADVANTAGE OF THE CITY TO ABANDON THE EASEMENT HEREINABOVE DESCRIBED SO THAT THE SAME s MAY BE USED BY THE OWNERS OF THE SAID LOT 13, GLEN OAK SUBDIVISION, FOR OTHER PURPOSES: NOW, THEREFORE, BE IT ORDAINED-BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE EASEMENT, EXISTING IN LOT 13 OF THE GLEN OAK SUBDIVISION OUT OF SECTION 53, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS, AS SHOWN IN VOL. A, PAGES 41, 42, 43 AND VOL. 35, PAGES 196 AND 97, 14 MAP RECORDS OF NUECES COUNTY, TEXAS, AND AS RECORDED IN VOLUME 06, PAGE 302 OF THE DEED RECORDS OF NUECES COUNTY, TEXAS, BE AND THE SAME IS CLOSED AND ABANDONED FOR PUBLIC USE AND ABANDONED TO THE OWNERS OF SAID LOT 13, GLEN OAK SUBDIVISION. SECTION 2. THE FACT THAT THE PUBLIC CONVENIENCE AND NECESSITY WOULD BE BETTER SERVED BY THE CLOSING OF THE AFORESAID EASEMENT CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY,COUNCIL, AND THE MAYOR HAVING Yi DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY 10549 ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE,17111 -( DAY OF NOVEMBER, 1971. .
