TENNIS CENTER, ALL AS IS MORE FULLY SET FORTH IN THE AGREEMENT ATTACHED HERETO AND MADE A PART HEREOF; APPROPRIATING $4,000 OUT OF THE NO. 111 TRUST FUND, ACCOUNT NO. 1740 INCLUDING $3,600 FOR THE ARCHITECT'S FEE AND $400 FOR INCIDENTAL EXPENSES; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED TO EXECUTE AN AGREEMENT FOR ARCHITECTURAL SERVICES IN CONNECTION WITH THE EXPANSION OF THE H.E.B. TENNIS CENTER, ALL AS IS MORE FULLY SET FORTH IN THE AGREEMENT ATTACHED HERETO AND MADE A PART HEREOF. SECTION 2. THERE IS HEREBY APPROPRIATED OUT OF THE NO. 111 TRUST FUND, ACCOUNT NO. 1740 THE SUM OF $11,ODO, INCLUDING $3,600 FOR THE ARCHITECT'S FEE AND $400 FOR INCIDENTAL EXPENSES. SECTION 3. W I T N E S S E T H: WHEREAS, THE CITY INTENDS TO CONSTRUCT CERTAIN IMPROVEMENTS TO THE H. E. BUTT TENNIS CENTER WITH THE SCOPE OF THESE IMPROVEMENTS MORE CLEARLY DEFINED AS FOLLOWS: (1) EXPAND THE EXISTING PRO SHOP ENCLOSED SPACE BY APPROXIMATELY 10' X 261 SIZE AND CHANGE PARTITIONS, ELECTRICAL, AS WELL AS RELATED WORK AS REQUIRED; (Z) ADD AN ENCLOSED LOUNGE ABOVE THE PRO SHOP APPROXIMATELY 261 X 401, WHICH IS TO INCLUDE SPACE FOR AN OFFICE, STORAGE, AND TOURNAMENT HEAD- QUARTERS. THIS WORK WILL BE COMPLETE INCLUDING PARTITIONS, ELECTRICAL, MECHANICAL, ETC. (3) PROVIDE OBSERVATION DECK, HANDRAILS, AND STAIRWAY AT THE SECOND FLOOR; (4) PROVIDE LIGHTING FOR FOUR (4) COURTS ADJACENT TO THE PRO SHOP WHICH SHOULD BE INCLUDED IN THE BID DOCUMENTS AS AN ADDITIVE ALTERNATE BID; AND (5) PRELIMINARY BUDGET FOR THE PROJECT Is $35,000, WHICH INCLUDES FEES AND CONTINGENCIES AND THE CITY DESIRES THE IMPROVEMENTS TO BE DESIGNED WITHIN THE EXISTING BUDGET; AND WHEREAS, IN CONNECTION WITH THE ABOVE LISTED SCOPE OF WORK IN THE H. E. BUTT TENNIS CENTER THE CITY EMPLOYS THE SAID ARCHITECTS AND SAID CITY AND ARCHITECTS AGREE AS FOLLOWS: - • JRRIMC 1/15/73 SST t .. . 1. PHASE 1 - PRELIMINARY PHASE (SCHEMATIC DESIGN PHASE THE ARCHITECT AGREES TO DO THE FOLLOWING WORK RELATED TO THE H. E. BUTT TENNIS CENTER: (1) REVIEW THE PROJECT WITH APPROPRIATE AGENCY OR AGENCIES OF THE CITY; (2) COUNSEL WITH THE CITY AGENCY OR AGENCIES ABOUT THE GENERAL PLAN AND SCOPE OF IMPROVEMENTS; (3) PREPARE SCHEMATIC DESIGNS OF THE PROPOSED IMPROVEMENTS WHICH SHALL INCLUDE PRELIMINARY FLOOR PLANS; (4) DEVELOP ELEVATIONS AS NEEDED FOR CONSULTATION WITH CITY AGENCIES; AND (5) PREPARE PRELIMINARY COST ESTIMATES FOR THE PROJECT AND SUBMIT SAID ESTIMATES TO THE CITY IN ORDER TO ASSIST CITY IN DETERMINING THE PRO- POSED CONSTRUCTION BUDGET AND ITS RELATIO'ISHIP WITH THE EXISTING BUDGET. 11. PHASE 11 - DETAILED PLANS AND SPEC,FICATION PHASE AFTER THE CITY HAS DETERMINED AND APPROVED THE SCOPE OF THE hORK TO BE PERFORMED, THEN THE ARCHITECT WILL BE AUTHORIZED TO PROCEED WITH PHASE II OF PROJECT AND THE ARCHITECT THEN AGREES TO PERFORM THE FOLLOWING WORK: A. DESIGN DEVELOPMENT PHASE: (1) PREPARE FROM APPROVED PRELIMINARY SCHEMATIC DESIGNS THE DETAILED PLANS AND SPECIFICATIONS; (Z) DEVELOP WORKING DRAWINGS TO LARGE SCALE; (3) MAKE NECESSARY FIELD SURVEYS REQUIRED FOR 1, DRAWING PLANS AND SPECIFICATIONS; (4) PREPARE LARGE SCALE WORKING DRAWING FOR STRUCTURAL, MECHANICAL ELECTRICAL, PLUMBING HEATINGj AND VENTILATING SYSTEMS, AIR CONDITIONINGS ETC.; (5) SUBMIT LARGE SCALE DRAWING AND SYSTEM TO THE CITY FOR APPROVAL; (6) REEVALUATE AND ADJUST THE ESTIMATE OF PROBABLE CONSTRUCTION COST IF REQUIRED; (7) -CONFER WITH CITY AND APPROPRIATE AGENCIES REGARDING DETAILED PLAN; AND . (S) THE ARCHITECT WILL MAKE AN EVALUATION OF GAS AIR CONDITIONING TO THE CITY AND IN NO EVENT SHALL PLANS BE APPROVED WITHOUT THIS EVALUATION. B. CONSTRUCTION DOCUMENTS PHASE: (1) PREPARE FROM THE APPROVED DESIGN DEVELOPMENT PLANS THE COMPLETE WORKING DRAWINGS AND SPECIFICA- TIONS DESCRIBING IN DETAIL THE WORK TO BE DONE TO CONSTRUCT PROJECT; -2- JRR /Mc 1/15/73 1ST 1 (Z) PREPARE NECESSARY BIDDING INFORMATION AND CONTRACT DOCUMENTS IN ACCORDANCE WITH CITY ESTABLISHED PROCEDURE; (3) REEVALUATE CONSTRUCTION! COST, IF NEEDED; AND - (4) PROVIDE CITY WITH FIVE (5) COPIES OF APPROVED PLANS AND THIRTY -FIVE (35) COPIES OF SPECIFICA- TIONS FOR THE PROJECT. C. BIDDING OR NEGOTIATION PHASE: (1) ASSIST CITY IN SECURING BIDS 13ASED UPON CON- STRUCTION DOCUMENTS; (2) ASSIST THE CITY IN EVALUATING PROPOSALS AND AWARDING CONTRACTS; AND • (3) PREPARE FINAL CONTRACT DOCUMENTS AFTER AWARD OF CONTRACT FOR THE REVIEW AND APPROVAL OF CITY. D. CONSTRUCTION ADMINISTRATION PHASE: (1) PROVIDE CONSTRUCTION ADMINISTRATION AS SET FORTH IN GENERAL PROVISIONS OF CONTRACT; (Z) MAKE PERIODIC VISITS TO THE JOB SITE TO DETER- MINE WHETHER WORK IS PROCEEDING IN ACCORDANCE WITH THE CONTRACT DOCUMENT; , (3) REVIEW SHOP DRAWINGS IF REQUIRED AND AS SUBMITTED BY CONTRACTOR FOR THE PROJECT AND RECOMMEND APPROVAL OR DISAPPROVAL TO CITY; (11) REVIEW LABORATORY REPORTS IF REQUIRED; (5) INTERPRET CONSTRUCTION DOCUMENTS, IF NEEDED, TO THE CONTRACTOR; (6) PREPARE MONTHLY CONSTRUCTION ESTIMATE AND SUBMIT TO THE CITY FOR PAYMENT. CONSTRUCTION ESTIMATES SHALL BE PREPARED BY ARCHITECT TO THE FORM SUG- GESTED BY CITY; • (7) PREPARE CHANGE ORDERS ON THE PROJECT AND SUBMIT TO CITY AND CONTRACTOR FOR APPROVAL; (8) DELIVER TO THE CITY ALL CERTIFICATES OF INSPECT- ING AUTHORITIES EQUIPMENT OPERATING MANUALS, BONDS, GUARANTEES AND RELATED DOCUMENTS; (9) MAKE FINAL INSPECTION ON PROJECT WITH APPROPRIATE CITY OFFICIALS AND MAKE RECOMMENDATION FOR ACCEPT- ANCE BY CITY; AND (10) DELIVER TO THE CITY• °AS BUILT" CONSTRUCTION DRAWING UPON COMPLETION OF PROJECT IN ORIGINAL REPRODUCIBLE FORM. TENTATIVE ESTIMATE OF PROJECT FEE BASIS THE TOTAL PROJECT AT THIS STAGE IS ESTIMATED TO COSTS INCLUDING FEES AND CONTINGENCIES APPROXIMATELY $35,000. THE FEE OF THE ARCHITECT WILL -3- TIME TABLE: (1) PHASE I (PRELIMINARY WORK): ALL PRELIMINARY WORK SHALL BE COMPLETED AND PRELIMINARY PLANS SUBMITTED TO THE CITY WITH THIRTY (30) DAYS FROM THE DATE OF WRITTEN AUTHORIZATION BY THE CITY. (2) PHASE II: A DESIGN AND DETAILED SPECIFICATIONS SHALL BE COMPLETED WITHIN SIXTY (6O) DAYS FROM THE DATE OF WRITTEN AUTHORIZATION BY THE CITY. TERMINATION OF CONTRACT THE CITY SHALL HAVE THE OPTION OF TERMINATING THIS CONTRACT AT ANY TIME AND THE FEES OF ARCHITECT SHALL BE THE FEES DUE FOR SUCH PHASE OR PHASES AS ARE COMPLETED. THE FEE WILL BE ADJUSTED ACCORDINGLY AFTER THE FINAL CONSTRUCTION OF THE PROJECT IS COMPLETED. PAYMENT FOR AND IN CONSIDERATION OF THE SERVICES LISTED ABOVE THE CITY AGREES TO PAY THE ARCHITECT ON THE FOLLOWING BASIS: ' (1) UPON COMPLETION OF ALL WORK INDICATED IN PHASE I (PRELIMINARY DESIGN PHASE) AND UPON REVIEW AND APPROVAL OF SUCH WORK BY THE CITY, THE CITY WILL PAY THE ARCHITECT 15% OF THE BASIC FEE. (2) UPON COMPLETION OF ALL WORK INDICATED IN PHASE II - A (DESIGN DEVELOPMENT PHASE) AND UPON REVIEW AND APPROVAL OF SUCH WORK BY THE CITY, THE CITY WILL PAY THE ARCHITECT 20% OF THE BASIC FEE. (3) UPON COMPLETION OF ALL WORK INDICATED IN PHASE II - B (CON- STRUCTION DOCUMENTS PHASE) AND UPON REVIEW AND APPROVAL OF SUCH WORK BY THE CITY, THE CITY WILL PAY ARCHITECT 4C% 0'= THE BASIC FEE. (4.) UPON AWARD OF CONTRACT AiVD COMPLETION OF PHASE II - C (E'IDDING AND NEGOTIATION PHASE) THE CITY. WILL PAY THE ARCHITECT 5,'o' OF THE BASIC FEE. (5) UPON COMPLETION OF CONSTRUCTION OF PROJECTS PHASE 11 - Di THE CITY WILL PAY THE ARCHITECT 20% OF BASIC FEE AND WILL ALSO MAKE PROPER ADJUST- MENTS TO THE FEE BASED ON FINAL CONSTRUCTION COST. ' SCHEDULING OF WORK _ ARCHITECT AGREES TO COMPLETE WORK IN ACCORDANCE WITH THE FOLLOWING TIME TABLE: (1) PHASE I (PRELIMINARY WORK): ALL PRELIMINARY WORK SHALL BE COMPLETED AND PRELIMINARY PLANS SUBMITTED TO THE CITY WITH THIRTY (30) DAYS FROM THE DATE OF WRITTEN AUTHORIZATION BY THE CITY. (2) PHASE II: A DESIGN AND DETAILED SPECIFICATIONS SHALL BE COMPLETED WITHIN SIXTY (6O) DAYS FROM THE DATE OF WRITTEN AUTHORIZATION BY THE CITY. TERMINATION OF CONTRACT THE CITY SHALL HAVE THE OPTION OF TERMINATING THIS CONTRACT AT ANY TIME AND THE FEES OF ARCHITECT SHALL BE THE FEES DUE FOR SUCH PHASE OR PHASES AS ARE COMPLETED.
