HomeMy WebLinkAbout11318 ORD - 02/14/1973JRR:RWC:'kh:2- 14 -73; 1st • AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565 ET SEQ OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF CORPUS CHRISTI TITLE COMPANY BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON TRACT 1 FROM "R -111" ONE FAMILY DWELLING DISTRICT TO "B -4" GENERAL BUSINESS DISTRICT; CHANGING THE ZONING ON TRACT 2 FROM' "R -1B" 014E FAMILY DWELLING DISTRICT TO "A -1" APARTMENT HOUSE DISTRICT; AND CHANGING THE ZONING ON TRACT " FROM "R -IB" ONE FAMILY DWELLING DISTRICT TO "R -2" TWO FAMILY DWELLING DISTRICT, SAID TRACTS OR PARCELS BEING A PORTION OF CARL SHELTON'S 92.69 -ACRE TRACT, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS A.IENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; -AND DECLARING AN EMERGENCY. WHEREAS, THE PLANNING COMAISSION HAS FORWARDED TO THE CITY COUNCIL ITS REPORTS AND RECOMMENDATi ONS CONCERNING THE APPLICATION OF Corpus Christi Title Company- FOR AMENDMENT 1'O THE ZONING 1141P OF THE CITY OF COFPUS CHRISTI; AND WHEREAS, PUBLIC HEARING WAS HELD AT WHICH HEARING ALL PEP•SON9 WISHING TO AP'E4R AND BE HEARD WERE HEARD, TO CONSIDER THE SAME BEFORE THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, IN,ACCORDANCE WITH PROPEI' NOTICE TO THE PUBLIC, SAID PUBLIC HEARING HAVING BEEN HELD ON Wednesday, February 14, 1973 , AT Special COUNCIL MEETING OF THE CITY COUNCIL IN THE COUNCIL CHAMBER AT CITY HALL IN THE CITY OF CORPUS CHRISTI; AND WHEREAS, BY MOTION DULY MADE, SECONDED AND CARRIED, IT WAS DECIDED BY THE CITY COUNCIL THAT TO APPROVE THE HEREINAFTER SET FORTH AMENDMENT WOULD BEST SERVE PUBLIC HEALTH, NECESSITY AND CONVENIENCE AND TnE GENERAL WELFARE OF THE CITY OF CORPUS CHRISTI AND ITS CITIZENS: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, TEXAS, PASSED ON TIIE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUMC 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME, AND IN PARTICULAR AS AMENDED DY ORDINANCE NO. 0106, AS AMENDED, BE AND THE SAME IS HEREBY AMENDED BY MAKING THE CHANGE HEREINAFTER SET OUT. �.�3f8 SECTION 2. That the zoning on the following described parcels or tracts of land be as follows: Tract 1, from "R -1B" One Family Dwelling District to "B -4" General Business District; Tract 2, from "R -lB" One Family Dwelling District to "A -1" Apartment House District; and Tract 3, from "R -1B" One Family Dwelling District to "R -2" Two Family Dwelling District, said Tracts being a portion of Carl Shelton's 92.69 -acre tract, located at the southeast corner of Highway 77 and Brookhaven Drive, in the City of Corpus Christi, Nueces County, Texas, and more particularly described as follows: Tract 1 Being a tract or parcel of land containing 7.9 acres, more or less, situated in the Gregorio Farias Original Grant, Abstract No. 592, in Nueces County, Texas: BEGINNING at a point in the south boundary line of Brookhaven Sub- division as shown by map recorded in Volume 23, Page 32 of the map re- cords of Nueces County, Texas, same point being at the intersection of the ccn:_erline of Brookside Drive, for the northeast corner and POINT OF BEGINNING of this tract; THENCE with the proposed extension of the centerline of said :Brook- side Drive S 10° W 520 feet, more or less; S 35 °20' W 130 feet to the southeast corner of this tract; THENCE N 54 °40' W 550 feet, more or less, to the east right -of- way line of U.S, highway No. 77 for the southwest corner of this tract; THENCE with said right -of -way line N 10° E 530 feet, more or less, to the most westerly southwest corner of said Brookhaven Subdivision for the northwest corner of this tract; THENCE with a portion of south boundary line of Brookhaven Subdivision S 800C2'20" E 360 feet; S 9 °57'40" 1� 90 feet; S 80 °02'20" E 170 feet; S 9 °57'40" id 40 feet; S 80 °02'20" E 30 feet to the POINT OF BEGINNING. Tract 2 Being a tract or parcel of land containing 16.3 acres, more or less, situated in the Gregorio Farias Original Grant, Abstract No. 592, in Nueces County, Texas: BEGINNING at a point in the south boundary line of Brookhaven Sub- division as shown by map recorded in Volume 23, Page 32 of the map re- cords of Nueces County, Texas, same point being at the intersection of the centerline of Brookside Drive, for the northwest corner and POINT OF BEGINNING of this tract; THENCE with said south boundary line S 80 °02'20" E 259.08 feet to a corner of said Brookhaven Subdivision and a corner of this tract; THENCE continuing with said southerly boundary line N 35 °19'30" E 245 feet, more or less, to the most northerly corner of this tract; -2- 3 THENCE S 39 °10' E 770 feet, more or less, to the most easterly cor- ner of this tract; THENCE S 35 °19'30" W 750 feet, more or less,. to the most southerly corner of this tract; THENCE N 54 °40'30" W 760 feet, more or less, to the southwest corner of thin tract; T11rNCE with the west boundary line of this tract, the proposed extension of the centerline of said Brookside Drive N 35 °20' E 130 feet, more or less; N 10° E 520 feet, more or less, to the POINT OF BEGINNING. Tract 3 Being a tract or parcel of land containing 25.2 acres, more or less, situated in the Gregorio Farias Original Grant, Abstract No. 592, in Nueces County, Texas: BEGINNING at the southeast corner of Brookhaven Subdivision as shown by map recorded in Volume 23, Page 32 of the map records of Nueces County, Texas, for the most easterly corner and POINT OF BEGINNING of this tract; THENCE with the southerly boundary line of Brookhaven..Subdivi.sion N 54 040130" W 1080 feet to an inner corner of said subdivision for the most ncrtherly corner of this tract; THENCE continuing with said southerly boundary line S 35 °19'30" W 650.feei:, more or less,... to the most westerly corner of this tract'. THENCE S 39 010' E 770 feet, more or less, to an inner corner of this tract; THENCE S 35 °19'30" W 750 feet, more or less, to the southwest corner of this tract; THENCE S 54 040'30" E 340 feet, more or less, to the northwes'c boundary line of Country Estates Subdivision No. 2 for the southeast corner of this tract; THENCE with said boundary line N 35 °19'30" E 1600 feet, more or less, to the FOINT OF BEGINNING. SECTION 3. THAT THE OFFICIAL ZONING MAP OF THE CITY OF CORPUS CHRISTI TEXAS, DE, AND THE SAME IS HEREBY, AMENDED ASHCREIN ORDAINED. SECTION 4. THAT THE Z014ING ORDINANCE AND MAP OF THE CITY OF CORPUS CHRISTI, TEXAS, APPROVED ON TfIE 27TH DAY OF AUGUST, 1937, AS .AMENDED FROM TIME 7.0 TIME, EXCEPT AS HEREIN CHANGED, SHALL REMAIN IN FULL FORCE AND EFFECT. SECTION 5. THAT ALL ORDINANCES Oft PARTS OF ORDINANCES IN CON- FLICT HEREWITH ARE HEREBY EXPRESSLY REPEALFD. -3- SECTION 6.
