AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE AN
AGREEMENT WITH THE STATE OF TEXAS ACTING BY
AND THROUGH ITS STATE HIGHWAY COMMISSION,
CONCERNING THE CONSTRUCTION ILLUMINATION
IMPROVEMENTS FOR THE INTRACOASTAL WATERWAY
BRIDGES AND APPROACHES, AS MORE FULLY SET
FORTH IN THE AGREEMENT ATTACHED HERETO AND
MADE A PART HEREOF, MARKED EXHIBIT "A ";
APPROPRIATING OUT OF THE NO. 220 STREET BOND
FUND $15,500 REPRESENTING THE CITY'S SHARE OFi
THE ESTIMATED CONSTRUCTION COST APPLICABLE TO
PROJECT NO. 220 -70 -137; AND DECLARING AN EMER-
GENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the City Manager be, and he is hereby
authorized to execute an agreement with the State of Texas acting
by and through its State Highway Commission concerning the con-
struction of a roadway illumination system for the Intracoastal
Waterway Bridges and approaches between Stations 187 + 92 and K
237 + 40 on Park Road 22, as more fully set forth in ti.e said
agreement, a copy of which attached hereto and made a part hereof,
and marked Exhibit "A ".
SECTION 2. There is hereby appropriated out of No. 220
Street Bond Fund the sum of $15,500, representing the City's share
of such contract.
SECTION 3. The necessity to immediately authorize the
City Manager to execute the aforesaid agreement and to appropriate
the hereinabove described funds creates a public emergency and
imperative public necessity requiring the suspension of the Charter
rule that no ordinance or resolution shall be passed finally on the
date of its introduction and that such ordinance or resolution shall
be read at three several meetings of the City Council, and the
Mayor having declared such emergency and necessity to exist, and
having requested the suspension of the Charter rule and that this
ordinance be passed finally on the date of its introduction and take
effect and be in full force and effect from and after its passage,

THIS AGREEPfENT made this day of 1973, by
and between the City of Corpus Christi,. Texas, hereinafter called the
"Cite ", Party of the First Part, acting by and through its City Manager
and the State of Texas, hereinafter called the "State ", Party of the Second
Part, acting by and through its State Highway Commission.
WHEREAS, it is the desire of the State and City to construct Ln
illumination system to add continuous roadway lighting to the Gulf Intracoastal
\ Bridge and approaches between Stations 187 +92 and 237 +40 on Park Road No. 22
as outlined in Field Change Request No. 9. The State will construct or have
constructed this work and the City will pay fifty per cent (50%) of the
construction cost of this work, excluding preliminary engineering, estimated
to cost Thirty Thousand Three Hundred and No /100 Dollars ($30,300.00),
including contingencies and construction engineering. The City's estimated
share of the cost of this work amounts to Fifteen Thousand One Hundred Fifty
and No /100 Dollars ($15,150.00).
NW WEREFORE, it is understood that this proposed work, consisting of
the construction of an illumination system to add continuous roadway lighting to
the Gulf Intracoastal Bridge and approaches between Stations 187 +92 and 237+40
on Park Road No. 22 as outlined in Field Change Request No. 9, will be con-
structed by the State. The total estimated construction cost of this work
amounts to Thirty Thousand Three Hundred and No /100 Dollars ($30,300.00), in-
eluding contingencies and construction engineering. The City will pay fifty per
cent (50 %) of the construction cost of this work, excluding preliminary engineering,
and it is estimated the City's share is Fifteen Thousand One Hundred Do F�
and No /100 llars and the City will transmit to the State with
the return of this agreement, executed by the City, a warrant or check made
payable to the State Treasurer, Account of Trust Fund No. 927 in the amount of
Fifteen Thousand One Hundred Fifty and No /100 Dollars ($15,150.00), to be used
in paying for the City's share of the proposed work in the City of Corpus Christi..
It is further understood that the State will construct only those items necessary
for the completion of an illumination system to add continuous roadway lighting
to the Gulf Intracoastal Bridge and approaches between Stations 187 +92 and 237 +40
on Par:c Road No. 22 as outlined in leield Change Request No. 9 and fifty per cent
(507) of the construction cost of such items will be borne by cha City. In the
event upon completion of this work it is found that the amount previously collec-
ted is insufficient to pay the City's portion, then the City upon request of the
State will forthwith supplement this amount by an amount equal to the City's actual
share of the cost of this work less the amount previously paid into Trust Fund
No. 927. In the event the amount as paid is more than the actual cost of the
City's share, as herein established, then the excess amount will be returned to
the City. It is further understood that the work to be done on behalf of the
City, as herein provided, will include the cost of contingencies and construction
engineering.
IN TESTDIONY WHEREOF, the parties hereto have caused these presents to be
executed in duplicate on the day above stated.
