HomeMy WebLinkAbout11351 RES - 03/14/1973• JRR:HG:ml:3- 12- 73;1st r A RESOLUTION ENDORSING AND SUPPORTING PASSAGE OF HOUSE BILL 173, AS PASSED BY THE TEXAS HOUSE OF REPRESENTATIVES AND CURRENTLY PENDING IN THE.TEXP_S SENATE WHICH VALIDATES PROCEEDINGS BY CITIES FOR.THE ISSUANCE OF AND LEVY OF A TAX FOR BONDS TO ACQUIRE BUILDINGS AND FACIL- ITIES FOR AN UPPER LEVEL COLLEGE AND WHICH PROVIDES FOR CONVEYANCE OF SAID BUILDINGS AND FACILITIES TO THE STATE WITHOUT CONSIDERATION; DIRECTING THE CITY SECRETARY TO MAIL COPIES OF THIS RESOLUTION TO THE NUECES COUNTY DELEGATION SITTING IN THE 63RD LEGISLATURE; AND DECLARING AN EMERGENCY. WHEREAS, House Bill 173 in the current legislative session has passed the Texas House of Representatives and is pending in the Texas Senate; and WHEREAS, said House Bill 173 validates action of cities in issuing bonds to acquire buildings and facilities for an upper level college among other things; and WHEREAS, said House Bill 173 authorizes cities to deliver such bonds ant convey such buildings and facilities to the State of Texas without consideration and authorizes acceptance of such conveyance; and WHEREAS, it is imperative to the economical, social and educational well being of the citizens of the City of Corpus Christi that said House Bill 173 pass and be approved by the Governor: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Council of the City of Corpus Christi, Texas endorses and supports passage of House Bill 173 currently pending in the Texas Senate and entitled "an act vali- dating proceedings heretofore had by cities in Texas for the issu- ance of and the levy of a tax for bonds issued to acquire buildings and facilities for an upper level college; validating such bonds; authorizing such cities to complete the delivery of such bonds to the purchasers thereof and convey such buildings and facilities and the site or sites therefor without consideration to the State 11351 . 7 Y of Texas; authorizing the acceptance of such conveyance; providing for severability and declaring an emergency." SECTION 2. The City Secretary is hereby authorized and directed to mail copies of this Resolution to the Nueces County Delegation sitting in Austin in the 63rd Legislature. SECTION 3. The necessity to secure passage of House Bill 173 so as to validate bonds issued for the purchase of buildings and facilities for an upper level college and authorize conveyance of same, thereby enhancing the economic, social and educational well being of the citizens of this City,creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and '_he Mayor having declared that such emer- gency and necessity exist, and having requested the suspension of the Charter rule and that this resolution be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO RESOLVED this the ///-tkday of , 1973.
