HomeMy WebLinkAbout11361 ORD - 03/14/1973N JRR:jkh:3- 13 -73; 1st w AN ORDINANCE CLOSING AND ABANDONING THE 20 -FOOT ALLEY NORTHEAST OF LOTS A- T; ',B -1, AND C -1 AND ALONG THE NORTHWEST SIDE OF LOT A -2, HABLUETZEL SUBDIVISION; RETAINING EASEMENTS FOR ALL EXISTING UTILITY AND SEWER LINES IN ALL OF SAID ALLEY; PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY. • WHEREAS, notice of the time and place for 'hol =ding a hearing cone wing the closing of an alley northeast of Lots A -1, B -1, and C -1,' and along the northwest side of Lot A -2, Habluetzel Subdivision, in the City of Corpus Christi, Nueces County, Texas, was given by publication � and registered mail to the last known addresses of the owners of property abutting that portion of the alley proposed to be closed and within 450 f � i ♦4F l feet df the area to be closed, and thereafter, pursuant to said notice, public hearing was held at Regular Council Meeting by the City Council t of the City of Corpus Christi on December 27, 1972, in-accordance with the .t provisions of the City Charter; and WHEREAS, it was determined by the City Council after such hearing that portion of the alley proposed to be closed is not needed now, nor will it be within the foreseeable future needed as a public alley, but easements for all existing utility and sewer lines are to be retained; and WHEREAS, it has been determined that it is to the advantage of the City to close that portion of the aforesaid alley, and retain a portion of said alley -' ~ NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That that portion of the alley running northeast of Lots A -1, B =1, and C -1, and along the northwest side of Lot A -2, Habluetzel Subdivision, in the City of Corpus Christi, Nueces County, Texas, be and the same is hereby closed for public use and abandoned to the abutting property owners, save and except the City of Corpus Christi hereby retains easements for all existing utility and sewer lines. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid r 11361 A• ? 4' or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3.
