HomeMy WebLinkAbout11420 ORD - 04/04/1973JR.R:ml:4- 2- 73;1st • AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH ASPHALT MAINTENANCE CO., INC. FOR THE CONSTRUCTION OF DILLON LANE STREET IMPROVEMENTS; APPROPRIATING OUT OF NO. 220 STREET BOND FUID $25,000, OF WHICH $23,451.61 IS FOR THE CONSTRUCTION CONTRACT AND $1,548.39 IS FOR CONTINGENCIES AND INCIDENTAL EXPENSES ALL APPLICABLE TO PROJECT NO. 220 -70 -139; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute a contract with Asphalt Maintenance Co., Inc., for the construction of Dillon Lane Street Improvements, all as is more fully described in the plans and specifications and contract documents on file in the office of the City Secretary, all of which are made a part hereof by reference and according to the bid of Asphalt Maintenance Co., opened on the 28th day of March, 1973,-the said bid of Asphalt Maintenance Co., Inc. being the lowest and most advantageous to the City of Corpus Christi. SECTION 2. There is hereby appropriated the sum of $25,090 out of No. 220 Street Bond Fund, of which $23,451.61 is for the construction contract and $1,548.39 is for contingencies and incidental expenses, all applicable to Project No. 220 -70 -139. SECTION 3. The necessity to execute the aforesaid con- tract and to appropriate the sum hereinabove set out at the earlist possible date so that construction may commence, creates a public emergency and an imperative public necessity requiring the suspen- sion of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordi- nance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date 11420 Of its introduction and take effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the day Of April, 1973. HOWARD STARK MOTION That the ordinance amending Section 4 -4, Corpus Christi City Code, 1958, so as to prohibit the sale of alcoholic beverages as defined by Article 666 -25a, V.A.P.C., read on the first two of three readings on March 21, 1973 and March 28, 1973, be amended by inserting the following words between the words "sale" and "of alcoholic beverages" in the first sentence of Section 4 -4 prior to final reading of the ordinance: "for on- premises consumption ", the first sentence to hereafter read as follows: "No person shall maintain a place of business for the dis- pensing and sale for on- premises consumption of alcoholic beverages as defined by Article 666 -25a, V.A.P.C., within the corporate limits of the city within three hundred (300) feet of any church, public school or other educational institution or public hospital." moved and seconded the Motion.
