HomeMy WebLinkAbout11532 ORD - 06/20/1973" VRR /Mc 6/19/73 1ST' AN ORDINANCE AMENDING ORDINANCE NO. 11463 DATED APRIL 25, 1973, WHICH DETERMINED THE NECESSITY FOR AND ORDERED IMPROVEMENT TO AUSTIN SCHOOL AREA STREETS, UNIT NO. 1, TO REDUCE THE RATE OF INTEREST FROM SIX AND ONE - HALF PERCENT TO FIVE AND ONE- QUARTER PERCENT AND TO;;� PROVIDE FOR AN EXTENSION OF MONTHLY INSTALLMENTS ' BEYOND SIXTY IN NUMBER ON OWNER OCCUPIED PROPERTY SO THAT MONTHLY PAYMENTS WILL NOT EXCEED TEN DOLLARS PER MONTH; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT ORDINANCE NO. 11463, PASSED AND APPROVED BY THE CITY COUNCIL ON APRIL 25, 1973, DETERMINING THE NECESSITY FOR AND ORDERING THE IMPROVEMENT TO AUSTIN.SCHOOL AREA STREETS, UNIT NO. 1, BE AMENDED BY AMENDING UNNUMBERED PARAGRAPH 9 OF SECTION 2, APPEARING ON PAGE 2 OF SAID ORDINANCE NO. 11463, TO HEREAFTER READ AS FOLLOWS: "THE COST ASSESSED AGAINST SAID OWNERS AND THEIR PROPERTY, SHALL BE 'PAYABLE IN MONTHLY INSTALLMENTS NOT TO EXCEED SIXTY (60) IN NUMBER, THE FIRST OF WHICH SHALL BE PAYABLE WITHIN THIRTY (30) DAYS FROM THE DATE OF COMPLETION OF SAID IMPROVEMENTS AND THEIR ACCEPTANCE BY THE CITY OF CORPUS CHRISTI, AND ONE INSTALLMENT EACH MONTH THEREAFTER UNTIL PAID, TOGETHER WITH INTEREST THEREON AT THE RATE OF FIVE AND ONE- QUARTER (5 1/4 %) PERCENT, WITH THE PROVISION THAT ANY OF SAID INSTALLMENTS MAY BE PAID AT ANY TIME BEFORE MATURITY BY THE PAYMENT OF THE PRINCIPAL AND ACCRUED INTEREST THEREON. THE TOTAL NUMBER OF MONTHLY INSTALL- ' MENTS ON OWNER OCCUPIED PROPERTY MAY BE EXTENDED BEYOND SIXTY (60) IN NUMBER SO THAT, AT THE 044 ER'S REQUEST, THE TOTAL MONTHLY PAYMENTS WILL NOT EXCEED TEN ($10.00) DOLLARS PER MONTH. ANY PROPERTY OWNER AGAINST WHOM AND AGAINST WHOSE PROPERTY AN ASSESSMENT HAS BEEN LEVIED MAY PAY THE WHOLE ASSESSMENT CHARGEABLE TO HIM WITHOUT INTEREST WITHIN THIRTY (30) DAYS AFTER THE ACCEPTANCE AND COM- PLETION OF SAID IMPROVEMENTS." - EXCEPT AS HEREIN AND HEREBY AMENDED, THE PROVISIONS OF ORDINANCE NO. 11463 SHALL BE AND REMAIN IN FULL FORCE AND EFFECT. SECTION 2. IF FOR ANY REASON ANY SECTION, PARAGRAPH, SUBDIVISION, CLAUSE, PHRASE, WORD, OR PROVISION OF THIS ORDINANCE SHALL BE HELD INVALID OR UNCONSTITUTIONAL BY FINAL JUDGMENT OF A COURT OF COMPETENT JURISDICTION IT 11532 JRR /Mc 6/19/73 1ST N SHALL NOT AFFECT ANY OTHER SECTION, PARAGRAPH, SUBDIVISION, CLAUSE, PHRASE, WORD, OR PROVISION OF THIS ORDINANCE, FOR IT IS THE DEFINITE INTENT OF THIS CITY COUNCIL THAT EVERY SECTION, PARAGRAPH, SUBDIVISION, CLAUSE, PHRASE, WORD, OR PROVISION HEREOF BE GIVEN FULL FORCE AND EFFECT FOR ITS PURPOSE. SECTION 3. PUBLICATION SHALL BE MADE ONE TIME IN THE OFFICIAL PUBLI- CATION OF THE CITY OF CORPUS CHRISTI, BY PUBLISHING THE CAPTION OF THIS ORDINANCE, STATING IN SUBSTANCE THE PURPOSE OF THE ORDINANCE. SECTION 4. THE NECESSITY TO AMEND ORDINANCE NO. 11463 AT THE EARLIEST POSSIBLE DATE CREATES A PUBLIC EMERGENCY AND IMPERATIVE PUBLIC NECES- SITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION BUT THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE AND PUBLICATION, IT IS ACCORDINGLY SO ORDAINED, THIS THE �a.2 DAY OF JUNE, 1973• ATTES ' T CITY SECRETARY MAYOR . m (1 1 7 _ TH CITY OF CORPUS C RISTI, TEXAS APPROVED: DA JUNE, 1973: C T RN Corpus Christi, Texas 010 day of Qlcm 19_2.3L U TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
