• A RESOLUTION
AUTHORIZING THE CITY MANAGER TO MAKE APPLICATION
TO THE TEXAS HIGHWAY DEPARTMENT FOR FEDERAL ASSISTANCE
FOR THE PLACEMENT OF A LOW -SKID PAVEMENT OVERLAY ON
OCEAN DRIVE, FROM I. H. 37 TO ALAMEDA STREET,
PURSUANT TO THE FEDERAL -AID HIGHWAY ACT OF 1970 FOR
URBAN SYSTEMS; AND SUGGESTING THAT URBAN SYSTEM FUNDS
PROGRAMMED FOR OVERLAY PROJECTS ON SECTIONS OF STAPLES,
BALDWIN AND MORGAN STREETS TOGETHER WITH ADDITIONAL
CITY FUNDS BE USED ON THIS OCEAN DRIVE PROJECT; AND
DECLARING AN EMERGENCY.

WHEREAS, the City of Corpus Christi deems it necessary to level
up and improve the pavement friction on Ocean Drive from I. H. 37 to
Alameda Street because of numerous accidents resulting from skidding; and
WHEREAS, it is found that the City of Corpus Christi is unable to
provide the total cost of such improvements; and
WHEREAS, approximately $157,100 of Federal Urban System Funds
have already been programmed to level up and construct low -skid surfaces
on Staples street from Kinney Street to 17th Street; Morgan Avenue from
Port Avenue to 19th Street; and Baldwin Boulevard from Port Avenue to
Naples Street; and
WHEREAS, the completion of these level up projects are being delayed
due to parking that does not meet Federal requirements:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the City Manager, R. Marvin Townsend, be, and
he is hereby authorized to make application to the Texas Highway Department
to use approximately $157,100 of Federal Urban System Funds to level up
and construct a low -skid surface on Ocean Drive in lieu of the three sections
of Staples, Baldwin and Morgan Streets.
SECTION 2. That the City of Corpus Christi will provide additional
funds to complete this project, now estimated at less than $60,000.
SECTION 3. The necessity to immediately authorize the City Manager
to make application to the Texas Highway Department for Federal assistance
for the placement of low -skid pavement overlay on Ocean Drive as more fully
set forth herein creates a public emergency and an imperative public

necessity requiring the suspension of the Charter rule that no ordinance or
resolution shall be passed finally on the date of its introduction but that
such ordinance or resolution shall be read at three several meetings of
the City Council, and the Mayor having declared that such public emergency
and necessity exist, and having requested that such Charter rule be suspended
and that this resolution be passed finally on the date of its introduction
and take effect and be in full force and effect from and after its passage,
IT IS ACCORDINGLY SO RESOLVED, this the /,,V1 day of August, 1973.

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
