HomeMy WebLinkAbout11749 ORD - 10/17/19731 JRR:jkh:hb:,10 /17/73 lst AN ORDINANCE AMENDING ORDINANCE NO. 11147, PASSED ON NOVEMBER 1, 1972, CLOSING THE ALLEY LOCATED BETWEEN LOT 1, BLOCK 2, TEMPLE ADDITION; LOT 1, BLOCK 2, CROCKETT HEIGHTS; LOT 1, BLOCK 1, SAN DIEGO ADDITION; LOT 1, BLOCK 8, CASA BLANCA ADDITION, TO CORRECT THE FIRST PARAGRAPH FOLLOWING THE DESCRIPTION AT THE TOP OF PAGE 2 OF SAID ORDINANCE SO AS TO CORRECTLY DESIGNATE THE OWNERS TO WHOM PORTION OF THE ALLEY SHALL BE ABANDONED BY THE CITY; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the City Council by Ordinance No. 11147, passed on November 1, 1972, closed the alley located between Lot 1, Block 2, Temple Addition; Lot 1, Block 2, Crockett Heights; Lot 1, Block 1, San Diego Addition; and Lot 1, Block 8, Casa Blanca Addition, in the City of Corpus Christi, and abandoned portions of the alley to the owners of abutting prop- erties; and WHEREAS, it has been determined that there exists an error as to whom portions of the alley was abandoned and it is the desire of the City Council to correct said in- accuracy at earliest practicable date: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Ordinance No. 11147, passed on November 1, 1972, closing the alley located between Lot 1, Block 2, Temple Addition; Lot 1, Block 2, Crockett Heights; Lot 1, Block 1, San Diego Addition; and Lot 1, Block 8, Casa Blanca Addition, in the City of Corpus Christi, and abandoning portions of the alley to abutting property owners, be and the same is hereby amended by amending the first paragraph on page 2, appearing at the top of the page, following the descriptions, to hereafter read as follows: "The 12.5 by 95.98 feet be abandoned to the owner of Lot 1, Block 1, San Diego Addition, and the 12.5 feet by 11749 95.98 feet abutting the addition to Lot 1, Block 2, Temple Addition, be abandoned to the owner of Lot 1, Block 2, Temple Addition; the 12.5 feet by 95.02 feet abutting Lot 1, Block 8, Casa Blanca Addition, be abandoned to the owner of said Lot 1, Block 8, Casa Blanca Addition; and the 12.5 feet by 95.02 feet abutting Lot 1, Block 2, Crockett Heights, be abandoned to the owner of said Lot 1, Block 2, Crockett Heights." SECTION 2. Except as herein and hereby amended, Ordinance No. 11147 shall be and remain in full force and effect. SECTION 3. All ordinances or parts of ordinances in conflict herewith are repealed to the extent of such conflict. SECTION 4. The necessity to immediately amend Ordinance No. 11147 as hereinabove set forth in order to accurately reflect the intent of the City Council creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the__,day of October, 1973.
